  1. Thank you for the responses. It is a moot point now. My brother passed away on the morning of christmas eve.
  2. My thinking was that I was getting the temp 100% from september 2017 for 13 months and those smc s-1 few months, are from when I started the claim on 7/20/2018 until the 13 months ran out. Talked to my amvet rep today, we will be filling sleep apnea secondary to major depression disorder. ***********Also, the paperwork for the right ankle says there isn't any evidence of treatment for it in my military medical records when in fact there is. Would that be a CUE? Anyhow, it is a great result. I tried to calculate the value but wasn't sure the final number that got reduced to 90%.
  3. Just saw on ebenefits that may claim completed and looked at the disabilities tab and the benefits tab. The Benefits tab had this: Entitled to special monthly compensation under 38 U.S.C. 1114, subsection (s) and 38 CFR 3.350(i) on account of status post left total knee replacement (previously rated as s/p left knee meniscal tear residual, osteoarthritis) rated 100 percent and additional service-connected disability of major depressive disorder (claimed as depression), independently ratable at 60 percent or more from 07/20/2018 to 11/01/2018. Rating Date : 12/28/2018 ***********QUESTION: Does this mean that SMC S-1 only happens for 7/20/2018 through 11/01/2018? I don't understand what this is impling? Also, my new scar on my knee does have pain.
  4. My brother was honorably discharge with medical reasons in the early 80s. The medical diagnosis the got him discharge was that he developed schizophrenia. I thought he was getting disability for all these years, but my mother told me that back in the 80s she went to the va to ask about getting a claim and they told her he couldn't get one. Naturally there is nothing in writing on this. They also said because the Army gave him money (severance? I don't know as I haven't seen the paperwork) and that made him ineligible for a disability claim. This sounds like BS because if he wasn't mentally fit, how could he legally have a meeting of the minds to agree to such terms assuming such things exist. He can't do much to help himself. Can't work. Any suggestions? btw, they are 2000 miles away, I don't have any of the paperwork (medical records/dd214) to look at. His mental illness is factual but I wonder what might not be true in all of this.

  7. I have a claim in for sleep apnea. This will be secondary to my existing service connected left knee (US Navy surgery in 1984) linking through couldn't fully exercise/obesity. A VA Doctor who is going to fill out the sleep apnea/osa DBQ is will to write a nexus letter provided he has something he can fill out. Is there a form letter for osa secondary to a condition linked through obesity that I could print for him?
  8. These are not military medical records, they are VA medical records. Everything has been exhausted in their search. Assuming they are gone, how might this affect my claim? Yes, they have records after 2000 to now.
  9. Today a letter arrived from the AV regarding my claim and said they couldn't find my VA medical records from 1990 - 2000. They ask me to provide copies if I had them and other medical records. I don't have any. How will this affect my claim?
  10. I don't have a nexus form yet, I will be going to get one from the amvet guy on Monday. I have only seen one good one and I would use a copy of that if I had one.
  11. Well, they are suppose to issue those special polarizing sunglasses due to the environment. I has been know for decades that the amount of UV light in Antarctica is harmful to your eyes. UV is a contributing cause of cataracts. Since I wore prescription eye glasses and they was never prescribed a pair by the U.S. Navy, they caused a situation which didn't assure protection and contributed, to some degree, to the condition. As to the sleep apnea, it seems only reasonable to due both claims at once. I found in my medical records the obesity after wintering-over in Antarctica. People in working in Antarctica naturally put on weight as your body chemistry goes wacky and requires much more calories. But as a backup, they could say it happened after the service, for which I still have obesity due to my service connected left knee. FYI, my dd214 says honorable medical discharge. Which was for my left knee. I am going to the sleep clinic at the VA this week with a nexus form. They signed off on one for someone last week who has a cpap machine like I do.
  12. I don't have any nexus statement. I am getting letters from two chiropractors I had been treated by for since 1996. Can the VA doctors sign a nexus form? Also, the C&P doctor said during the exam he believes that these are 100% service connected.
  13. Just curious, do we put in the codes we are requesting to be awarded if the claim goes through, or does the code number get resolved through the process? For example, I have: Moderate C4-C7 intervertebral disc height narrowing and uncovertebral joint hypertrophy. Moderate degenerative disc disease throughout the thoracic, lumbar spine. Grade 1 L3 anterolisthesis. Anterior wedging at T11, T12. I put in for degenerative disc disease but wasn't sure if I should have used numbers. What are we suppose to do?
  14. 1) I spent a year in Antarctica and prior to deployment, we were told during training that we would be issued special polarizing sunglasses due to the amount of ultraviolet light exposure. I wear glasses and the polarizing version are much more expensive. They were never issued. Now I have cataracts and want to put this in for a claim as UV light is a factor for cataracts. Where can I go to show that they were suppose to issue such gear? The National Science Foundation issues those special sunglasses to their people to protect them. How to find out gear requirements for duty assignments? 2) I wintered-over at McMurdo Station Antarctica. I am service connected for the left knee from losing the ACL when I was deployed. Most people gain a lot of weight down their due to the body's response to the weather conditions. I have an entry in my medical records for obesity after I returned. I also started snoring during the winter. I believe that is when my sleep apnea began but who heard of sleep apnea in 1983? I was just "snoring" right? I also gained weight over the years post service due to my left knee and had to have a total knee replacement last year. I am on a sleep apnea machine because I stop breathing 46 times per hour. Can I put in a claim for SA for both service connected AND for secondary at the same time? My idea is that one of the two is the reason, rather than fighting for one and appealing if I don't get it then having to start a new claim, why not do both at the same time?
