  1. 5/13/13 filed claim for total left parotidectomy ~ squamous cell cancer of parotid gland metastasized through out neck. Agent Orange exposure. BVA grant 3/22/19 ~ received most of retroactive pay 5/8/19 (in different increments a total of six deposits made to my account all on 5/8) ~ had C & P exam 5/9/19 for additional residuals ~ received another determination of rating 5/14/19 ~ have not received retro pay for adjusted rating as of 5/28/19.
  2. Is it possible that your evidence suggests unemployability? "There are two rules that have been established in regards to what the BVA must consider. One rule says that the BVA is required to address all possible legal theories that would service connect a disability or death benefit claim as long as the theory is reasonably raised by the evidence in the record. The second rule says that if there is evidence that of unemployability on the record, the BVA must address the issue of entitlement to a 100% rating due to individual unemployability regardless of whether or not the veteran specifically raised this issue."
  3. I hope you filed the claim. If not, do it ASAP. Prostate cancer is presumptive condition and it's pretty easy to file. My husband was diagnosed in 2017 with prostate cancer ~ vietnam vet (in country with DD214 showing so). Erectile dysfunction claim also. Claim filed 12/17 was granted in 2/18. $3336.15 per month ~ it is a lot of money to not file the claim. My husband was like your father ~ really didn't want to file the claim. His doctor point blank told him to do it & did all the DBQ's immediately following diagnosis. Filed online through ebenefits. You might have to go through VA.gov now. Submitted DD214, DBQs, surgery papers, pathology report.
  4. Just a guess but VA is required to combine additional claims that relate to original claim. So while judge administrative assistant reviewed claim and knew of additional disabilities connected to that claim they would be added on as "inferred". "VA should not initiate development of an inferred issue unless the evidence indicates VA may be able to grant the benefit." It sounds like your evidence indicated more that just the claim you filed.
  5. My husbands status update says "a judge is reviewing your appeal" "1-2 months for decision". Claim filed 5/13 ~ docket 7/15 ~ had hearing 11/18 ~ been at vlj since 12/18.
