  3. RAB I suggest you resubmit your question by entering it as a new question. You have it buried in a string on a old question and it may get lost. Go here for some info on your issue https://www.va.gov/disability/eligibility/special-claims/temporary-increase-after-surgery-or-cast/ In any case, yes you SHOULD submit for an increase!
  4. Chamilton As Bronc points out you need to submit medical evidence that your conditions have gotten worse. This can be accomplished by just submitting a claim for an increase and letting the VA system determine thru a C&P exam if your conditions have changed. You you can also get your own independent medical eval and submit with your request. I would suggest going to https://militarydisabilitymadeeasy.com/search.php and finding out what criteria is used to evaluate your symptoms and try to estimate objectively if you feel your conditions have worsened. You can then better determine what a new rating could possibly be. But understand that if you enter this process without any medical evidence of your own, you are at the mercy of the VA examiner at the C&P. Back and joint issues are rated mostly on how well you can extend and bend, so if you submit an objective opinion from another doc, it is much more likely to result in a favorable outcome for you. Do your research on getting a medical eval from the outside source and see if it makes sense to you from a financial cost point of view. You are then in a better position to figure out your next move.
  5. We are also sorry for you Shrek. Not a lot we can say that can possibly make things better. I don't know the circumstances but if he left behind family of his own, try your best to stay connected to them. My condolences my friend.
  6. I firmly believe that there is a gremlin that works on the night shift at ebennies. And he also has a first cousin who works at va.gov. How else can we explain these mysteries? But Usaf9498, I do think eventually they show back up. Fortunately, you do make an excellent point for us to remember. Save your own hard copies, make a copy of what you have downloaded on the VA sites, and, if necessary, just download them again with a note that they were "removed" from My Documents.
  7. Sentinel24 Congrats!!! Great accomplishment. Now since you intend to do more on your disabilities going forward, keep on reading and learning here on Hadit. It will continue to benefit you and your family as you learn and you will also be able to help others as you grow. I might add, you might consider making a donation as a subscriber; one hand washes the other, so to speak.   8. cavscout1967 No; if you submitted your claim and the date of the "finding" is 9-5-19 in your case, that is your effective date. For payment purposes, your payment starts from the first of the following month. Since it is a month behind, your payment for Sept. will show up as a direct deposit in your account on Oct.1st. In other words, your effective date is used for other purposes, but it is used to start your payments starting the next month. If you already gave them the info for your direct deposit, check it on the first on your bank statement and/or check ebenees for your payments.

  10. Richard is correct. You didn't "report" an in-service event. I mean you did have several, your mos, your proximity to tanks firing, qualification with small arms, etc. are all in-service. I can't believe you didn't say your thought it was because of those factors.I mean, you went for a C&P for a VA disability! All you would have had to say was you got it because...! O.K. get a copy of the dbq exam and see what it says. It is possible that the examiner made the connection for you. Possible, but not likely. If it is negative, you have to submit new evidence; as Richard suggests, on a supplemental claim.You will need to get a new dbq from your own doc, (Audiologist) and he should state that it was caused by in-service activity; it isn't a stretch; these exposures do cause tinnitus. If you explain in detail your doc will diagnose it. You will also need to address in a Statement in Support of your claim why you didn't cite some experiences in the service that made you think it was caused while on active duty. Maybe you forgot to say something to the examiner??? Maybe you were nervous??? You should address why. So, since you didn't tell them you thought your tinnitus was caused by service, let me ask - how is your hearing? Is is compromised also? Did you submit a disability for that also? If you have a problem with tinnitus, you also may have a hearing loss originating from the same exposure as the tinnitus. That is rated as a separate disability also.
  11. Brokensoldier244t is, unfortunately correct (again!) You really don't know anything is for sure until you get your decision letter in the mail. Not knowing what you went for and if there was back pay involved, you could also check your payments on ebenies, or your bank statement if you bank on on line. Sometimes the money shows up before your letter. But still, you won't know what the decision is until the mailman comes. If you do get a deposit, however, that would be a favorable sign something was positive. One other thing you might try; if you are stage 4, you could cal the info line (Peggy) at 1-800-827-1000 and tell them you current health status. You might be able to shake something lose. But, remember, don't bet the farm until you see it in writing. Good luck.
  12. I would second what Kuwaitin08 said. I'm not a big fan either. It has to be a plain as the nose on your face that they missed something very factual that can't be compromised. Many examples but: your mos is machine gun; your going after hearing disability, and the rater says your mos xyz is in the less likely category for noise exposure. If the DRO doesn't correct it, you can certainly file for CUE. The point being that one of the raters who reports directly or indirectly to him made the decision you have on your claim. They just don't appreciate it they have to correct a mistake by their own department and would rather find a way to concur with the original finding. IMO
  13. SPO You really aught to start a new thread. This has 7 pages; you want all your stuff together, not mixed in. To answer your immediate question, the IMO establishes your nexus; without a nexus, you lose. The dbq talks to the severity of your symptoms, especially to a disability you are trying to establish. If you don't get a favorable dbq during your C&P exam, that is kinda defeating. So, to combat that, you have a dbq from your own doc. You really need both in my opinion. In the imo, look up what kind of info he needs to include, especially the magic words "more likely than not"...
  14. James, I am going to give you the best advise you got since you heard "dinner's ready." Have your friend file. Today. Tomorrow for sure. It is up to the VA to source it out; veterans don't have to be map readers to submit a claim. But his EED date is losing day for day. Get him to submit with all those coordinates locations listed. If you can confirm any were within 12 mikes you can always appeal if they deny anyway. Or you can add to his claim more evidence. Look up to see if his ship is already listed as being within. It also depends on dates he was on board compared to the log dates remember. But get him to submit before the end of the month! By the way, thanks for helping out our veteran brother; it's what we do.
  15. Hi Sphynix06 It should be your last comment: property assessed at $300k gets to new value of $240k. So if you meet the requirements for disabled per the state statute you get to keep a few bucks, Best thing to do is take a copy of your decision letter showing your current combined disability and talk to your town assessor. They have to have a copy in order for you to get the reduction anyway.

  17. And, if you were towin your appeal, there would be two back pays; it would never be done quick enough to combine them together.
  18. When you win, it's done, unless there was fraud involved and they find out later. Obviously, big problem. But no, if you win at any level and then appeal for EED, higher rate etc., that action doesn't affect what you already won.
  19. Berta, I agree 100%; old policies are cop-outs for the many who work at these VSO's. Or, maybe it is lack of leadership, training or just plain lazy. And Mr. Weidman should be held accountable if he said that; get him to correct the record and emphasize the truth. As to getting BWN veterans to submit now in order to lock in their claims, it's like shoveling against the tide. The few I've talked to always have an excuse. Inertia is a wicked thing. Fear of "messing up" their claim by submitting "early" is another hurdle. The VA has been screwing us over, especially us older guys, for so long, they just don't trust the VA to do ,or mean, what they say.So veterans procrastinate, or just give up because of how they were treated before. The VA wins again!
  20. Oceanbound It is what you expected; and we wish it wasn't so. But we can't change what is, either. So, go after it now. Make the case and get some compensation for all the pain and suffering and all that was negative all those years. Very best to you on your quest.
  21. Scottishere99 You can try if that is your regional office, but they normally are not responsive to request like that. You need to request via. FOIA form 7259. Most on Hadit send a request to Claims Intake Center, PO Box 4444, Janesville, Wi. 53547-4444. Send to both. It normally takes months however; I don't know how to move that needle.
