  1. Thanks vetquest. I also hope they dont request another exam. If 2 isnt enough, I dont know what else they could be lookin for. Bad enough this is a reopened claim from 1985, They granted the right to reopen...Now that its been C&P 100% approved by their doctor, would they go back to 1985 or the date they approved reopening? 2010
  2. In my 9th year of this long wait...BVA denied 2years ago, only for CAVC to remand back. BVA remanded for new c&p because BVA didnt feel the opinion of outside PTSD dr was enough to grant service connection for ptsd. december 13th 2019 had c&p exam and their Doctor found that my PTSD was indeed Service connected. My questions are, 1} Can they still deny the SC? 2} will this be another long process? Any reply in this regard is appreciated
  3. How long after cavc Remands a claim? I submitted a 90 wavier, so no other evidence to submitt. The claim is currently showing that its awaiting a judge opinion. Do it then take another year or so for decision? And after a decision have to be rendered from the lower RO? I was granted {BY BVA} reopening of a claim I first filed in 1985, then BVA denied it.. May 2019 the Court remanded it back to BVA. Its August, and nothing's changed. what is the normal time now? The court instucted BVA to expedit the claims. But I wouldnt think they would obey that order. USCAC THE REMAND.pdf
  4. Hi, I am Zmudy, and I want to share something that everyone using a lawyer for appeals should know. Last year after Trump signed the Bill that instituted a New policy/Law where the appeals court {bva-cavac} paid the attorney for cases where the veteran was awarded. This new law it turns out has now caused the attornies to drag their feet to the last deadline date. Basically because the court removed the lawyers access to sometimes half the award, to hourly pay, and in some cases less than 8% of the award. So now the lawyers are sending in their bills with as much work hours as they can come squeeze into their worksheets. And the only way to get close to what they previously thought they were getting, is to Slow down the process. This tactic for some of us is another DELAY....Only this time it is the attorneys who are stuck with cases they've would've normally been in a hurry to finish. They are trying to juice the courts at the expense of VETERANS. Meanwhile, its guys like me who is again in another LINE at the lawyers office. My lawyer since november 2018 now waits until the very last deadline date to submit her briefs, waivers, and arguments. I didnt understand why until after my claim was remanded and the cavac had the lawyer file their award request. In the package was hourly rates for things that took probably 2 hours, the lawyer made it look like it took 2 weeks. The case then went to the bva, where a 90 waiver was mailed out a month ago. The waiver consist of 3 prons check questions. It took a month for them to CHECK one and Fax it to BVA. I then looked at all their submittals since last year and discovered that veterans with lawyers are in another conspiracy to delay our claims.. Its sad ...What now? sue the Lawyers?
