  1. I think brokensoldier previous situation is very close to mines. Only difference if I'm correct is that my award came tdiu and scheduler simultaneously as where brokensoldier got this Tdiu first then couple of month in the same year got new ratings that bumped him up to 100 scheduler with a new single page award. I'm now thinking from my earlier post pics from va.gov in my 2 separate looking claims for 1 was tdiu and other was an increase.. The tdiu one is closed and shows complete and granted. The 2nd one for increase had SOC letter sent with one or more granted but not closed.. I'm thinking once I send the page where I'm agreeing with a signature on my award with no further intention to appeal...i too should get a single award letter like brokensoldier to show my scheduler 100 and thus closing my tdiu. The tricky part is that it might surpass my 1 year of employment on April 2020 before seeing that letter. Brokensoldier..thanks for finding your award letter and posting it earlier.
  2. I was at 80 or 90 when I filed for increase and tdiu back in 2017. I got some increase but tdiu was denied. I did a NOD and asked for DRO review. VA received my appeal on July 30 2018. I recently was granted tdiu p&t..so it took 19 months. I don't know why it was granted but I believe I had a very good c&p exams shortly after filing NOD. In my current job at the dmv requires at least 1 year before allowed to file FMLA. Before filing with my appeal, I went to see a VSO at the DAV office at the main hospital..They sat with me and seem to be not so interested in helping me as well. Kept in saying I shouldn't appeal without more evidence. I had no further evidence when I filed the NOD and only thing was that favorable c&p exam done at the VA hospital. Never used a lawyer nor a va serv rep. Got out of active duty around 2013.. Started from 20%..40%..50%..70%..80%..90%..and lastly the 100% recently.. My timeline. I never had to go see a occp specialist or visited outside of va doctors. Just don't give up sir.. Good luck.

  4. Thanks lancejoseph for your info for Monday. I don't have smc-s but rather k which pays 119? Not sure but every penny helps. I do not have any mental issues. Apnea 50, planters 30, Diabetes rad 30, lower back 20x3, Diabetes II 20, knees 10x2, tinnitus 10, others 10x2.. I was at 90 prior to my new award giving me tdiu and raising my old back rating 3 contentions to 20% which prompted me to 100 barely..close to 95. Buck52, See above to see all my disabilities.. Never had or given smc-s. I guess calling Monday and asking questions will give me better understanding. Finding out what gave me the TDIU is important..was it my increase from my 3 increases from 10 to 20 or something else. It's just scary to keep working and having them lower my rating back down cause I maintained gainful employment for at least a year if I do plan to work till April 8th 2020.
  5. Hey Buck52, Please don't opt out on me brother. Your comments are greatly appreciated. Don't give up on me. We are all here to support each other and find the tools needed to win claims. I'm not here posting b.s. to make myself look good or bad. I tell it like it is and it's not looking good. Like Pete said earlier, I can't live on 90% like before with only that as my income to support my wife and 2 small kids and 2 college boys. I'm still young 49yrs old but had real issues with flare ups that causes great pain even standing for a min or two was painful. I had to be resourceful working at the dmv to seat down as much as possible to get by and many nights couldn't sleep from tossing and turning to find a place where the pain was eased. I had no other choice to work. Now, I need support with good morale to put up with this. Yes, I'm reaching out to all to help me with my dillemmas. I know that no one else here will suffer any consequences this might bring me later if so I wish to continue my employment as it would GREATLY affect me and my family. Thanks again for all the great feedbacks. I don't see or haven't seen any negative comments yet..besides me being the idiot I am for bringing this on myself.

  8. Lancejoseph. I'm not sure if you have read.thru all comments from me and others. You know my current situation. I just got this award letter today. I've been working since April 2019 till currently. So you think I can still continue working and let va know this until I hit my 1 year mark and then that makes me maintaining gainful employment thus will then revert back to my scheduler?? No re-exam, no reduction letter?? I highly doubt that will be the case since they deemed me employable so my disabilities somehow improved.. I'm certain it will cause me further headaches. Thanks for your comments and hope you can further enlighten me on how I should go about this.
  9. Buck52.. I believe wht Richard is saying is hell no I can't work. Tdiu doesn't get revoked unless it was a fraud. He does make sense and I better make a quick decision soon or face re-exam reduction letter and all sorts of craziness.. I made the mistake initially for asking to appeal tdiu. At that time I never guessed I could work but took it to feed my family. Sad and depressed. Only my fault for not thinking this through.
  10. Richard, I think your educated experienced opinion on my award make sense. Others here had different circumstance than mines. Either they got the TDIU first then p&t later in time and never worked like broncovet..but for brokensoldier sort of contradicts what ur saying coz he had tdiu then 100 scheduler and his award letter on ebennie never states TDIU but only scheduler. Very interesting.. Brokensoldier. Is this correct with your story of tdiu then scheduler at a later date? If so, how far was the TDIU to scheduler coz you said about working this coming march? Yes. It seems like I got my award letter with both Tdiu and scheduler with different effective dates. I must stop working or face later problems with repaying portion of retro and re-exam for fraud or to reduce my benefits. My MRI and diabetes don't lie so I feel confident about no fraud.. My 2019 tax was for not full year since I started work on April 8th 2019 which was only 21-24k which should be below poverty level for family of 4. Not sure when or if I should send in the 21-4140? If I should disclose the dates. Since I just got the TDIU this year if they will audit or seek SSA or IRS my tax info on 2019. I'm not more on leaning towards quitting work asap before hitting my year mark on April 2020. Should I even bother now in calling va Monday to get more clarifcation?? Thanks all again. More stress now than ever.
  11. Buck52, Understood.. So you are allowed both Tdiu and schedular but only paid on one... Would working gainfully be allowed since schedular 100 has no limitations?

  13. My DRO appeal with only 1 call from va was like this.. I filed NOD and received a c&p exam right away then few months later received a phone call from somebody I can't remember stating all my facts and do I have any further evidence to add before it gets sent up.. I said I had no new or additional evidence on my appeal but agreed its good to go and no changes.. First he said if I had 10 or 15 mins to talk and that it was being recorded and stated he makes no decisions to my claim. I had a favorable c&p exam..after I filed the NOD. It seems like forever but after 19 months of waiting without any communications besides above..i got my decision recently.. Waiting on BBE. Tdiu seems like approved but I wanted schedular..3 increases ive asked for got approved but not all..

  15. I took some snapshots of what it's shown on VA.gov.. I was never TDIU previously.. Only 90. Yes, I will wait till my packet arrives but curious coz I do have a lot riding on this being schedular or tdiu. Ebennie and va.gov might not be all accurate but I don't think it has any lies in 'em. Must be some truth to the award letter on ebennie. I'm just perplexed and anxious to which I am. Not all seems to be clear and dry...just wait for packet coz I do have behind issues to which outcome might affect me greatly.
  16. So it is 95% so why does all seem to point towards TDIU? Strange.. It should moot the TDIU of I meet the 100 schedular..The ebennie award letter has the 100% unemployability effective date as 10/06/2017.
  17. I never had TDIU P&T before. My highest rating is 50% for sleep apnea. Maybe my calculation was off. 50, 10x5, 20x4, and 30x2...not 95 but 94?? Maybe I should just not rely on ebenefits and wait for the envelope to arrive. Thanks all for the replies.. Much appreciated. I was mistaken earlier. Followed your directions with benefits letter with all boxes checked.. It was similar to yours but had employability on it..it must be for TDIU.. Just don't understand it if the math has it 95. Why wouldn't it be schedular and moot tdiu.. Will await the brown/white envelope but now I'm certain its tdiu..

Gross and net pay same..$4158.32 Effective date: Dec 1st, 2019 Combines Evaluation: 100 percent My DRO appeal was in receipt on 07/30/2018.. It just closes with decision on 02/21/2020.. Never received a phone call or any letters..Just not sure if it's schedular or tdiu..but all signs looks to be tdiu...just weird how my disabilities adds up to 95 and shows 100 which I thought to be schedular. For those in dro appeal as me maybe curious of timeline.. I did a c&p exam as soon as I filedmy NOD..very shortly afterwards. Had a favorable exam with a va Examiner who spent a lot of time talking and giving me his phone# if I ever needed help filling out any forms.. It was mainly increase my back and diabetes increase.. I was really low balled prev with only 10% for my back by my Examiner.. Now only increased to 20 but its hard to get 40 now with all the rom and difficult criteria. Wish I knew how to post my c&p exam on here to help anyone with similar issues.

  22. Hello all, I've been a big fan of this site and would like to thank all for the great insights pertaining to all. My questions follows.. I filed a NOD in receipt on July 30th 2018 as va.gov showed. It was for a DRO review. I filed for 3 contentions for increase and TDIU. Which always shows as 2 different claims on VA.GOV site. My current rating before NOD was at 90%. For total of 12 rated issues. Recently this week showed up on VA.gov and ebenefits as granted 100 TDIU but on ebene I did the math.. 50%, 10%x5, 20%x4, 30%x2.. This should add up to 95% which makes it 100 schedular so I thought... Below are what I saw from ebene. I'm just confused coz if 100 by schedular the TDIU should be moot.. Also, my disability on ebene shows 100 disabled. I want to have 100 schedular. Haven't received the brown envelope yet with decision letter. No retro pay yet. I'm bad at pasting all info from ebene on this post... Ebene benefit summary breaks down with checks: 1. You have one or more serv related disabilities. YES 2. Your combined serv connected disabilities are 100%. 3. Your current monthly award is: effective date of last change amount and date.. $4158.32 / 12/01/2019. 4. You are being paid at 100% due to your unemployability due to your service disability. YES 5. You are considered t&p so let due to your serv connection. Effective dates of your T&P disability dates are 10/07/2017. 6. You are being paid SMC due to your service type severity..etc... YES Everything here looks like tdiu 100 but my total math on my ebene shows 95 which us 100. My retro is another thing..if schedular..it seems as since my increase on the NOD was effective on 11/27/2019 that made me 100 by va math and the TDIU stated above was for 10/07/2017 effective. Any help would be greatly appreciated. Thanks in advance.
