  1. I was legacy appeals from 2014, I had my bva hearing with the judge on Dec 12th 2019, assigned to veteran law judge on March 10th, 2020, decision by March 12, 2020
  2. Im currently fighting the VA, filed a claim in Sep 2019 for OSA secondary to my service connected lower back and shoulders (which overall contributed to weight gain). I had a nexus and dbq completed by a private physician, I have an active diagnosis with the VA, issued a cpap, and my c&p examiner at the VA also opined that the OSA is related to service. I got the denial for it in March 2020; so Im working a Higher Level Review now. Not to discourage you! Just wanted to answer your question (willing to update my post once the HLR comes back (phone call can be any day now).

  4. I talked to the Phoenix RO two days ago and they said they are still going to work, processing claims, etc. They just dont allow anyone in the building if they don't work there, to include suspending teleconference hearings.
  5. I had checked the outage calendar a few days ago when ds logon was down and this was planned for yesterday and today. No new claims, dependents, and one more thing could not be done.
  6. I did lot of research for timelines while waiting for my hearing and for what to expect after my hearing. I was legacy appeals and chose not to RAMP in Feb 2019. I hope this does help any other veteran wanting to know the process and hopefully the timeline helps. This is my experience for appeal with the VA and as always every case is unique and different. Im willing to follow up with any questions people might have. Tried to get lawyers involved but they said they wouldn’t touch my case (all the major ones you would find on google). So I just kept pushing along using the DAV for insight to the RO when needed or to file correspondence for the case. You know the rating you deserve!, the BVA law judge literally said VA erred and this should have been granted in 2014 but the C &P examiner failed to do their job accurately in my July 2014 exam. My follow up C & P exam conducted in 2017 warranted a 70% rating and the examiner noted everything correctly (however since the case was on appeal RO could not use the evidence to rate me at that time the exam was completed). Best Advice I can give is KNOW YOUR CASE! Know one knows your case like you and when talking to the judge, it helped I knew what the criteria was so I could talk to those points. File everything on-time, accurately, and with a way to show it was given to the VA. Find a hobby because worrying, over planning, and checking ebennies 20 times a day will drive you crazy. Don’t let your claim fall through the cracks but know that every day you worry, you drain yourself! Finally, NEVER GIVE UP!!!   7. The best I can think of to help answer your questions is provide an overview of how PTSD is rated with the VA. Its not going to answer your questions directly but it should get you into the right direction when you see how they determine the severity and pay for each.
  8. Thank You! Yes I do believe moderate is 20% myself, im just shocked it was overlooked which is why I thought I'd ask; just in case anyone might know why. ATM im 94% if they increase both the 20% each it will take me to 96%; which is why I was hoping to get as much info on this now so Im prepared for that talk with the Senior Reviewer.
  9. Everyone was helpful in my last post, thought I would get more feedback. In Sep 2019 I filed for an increase on already service connected and rated conditions as it has gotten worse. I received my decision back just two weeks ago and they said no to the increase. When I filed, it was a Fully Developed Claim and so I asked my private chiropractor (has a phd) to fill out a DBQ and they agreed too! The VA still decided to to have me attend a C&P exam with the DBQ on file. So I went to the DBQ exam conducted at the VA itself (today the exam released on myhealthevet). Can I get people's opinions on if I should fight this. I find it odd that a rater would miss something but I've learned that you all might be able to shed light on why.   10. Thank You for the help in understanding bilateral. I was not aware the 10 percent for my leg other leg condition gets rolled into the bilateral factor; missing that 10% kills the 95. I do have a few issues on HLR that I will post about for opinions. But Im almost there! Once again thank you for breaking down how bilateral are determined and calculated!
  11. Long time lurker and wanted to ask a question I cannot find or word properly. I have my rating sheet (provided to me from the DAV) and recently received an increase. I had used the combined rating table and the numerous calculators to see if what my rating would be with the change. I keep coming up with 95% rounding to 100% Can I please have others check my work to ensure I’m correct and then the most important part, I cannot find what/who can review and change this (hoping to avoid a 6 month waiting period but understand if that’s what needs to happen). Essentially the steps to take should I be correct. Thank You in advance for double checking my work. Mental Health 70% (my increase) Back 40% L Arm 20% (bilateral factor) R Arm 20% (bilateral factor) Left Leg 10% (bilateral factor) Right Leg 10% (bilateral factor) Gerd 10% Tinnitus 10% L Leg (separate from above) 10% My math takes those ratings with the bilators factors into account (for the two ratings); The problem is Ebennies and the DAV systems show me 90% combined.
