  1. Well I got a letter from my VSO today saying that a law firm reviewed my case and feel the BVA may have erred in my recent decision. This firm is willing to represent me for free but I have to pay a nominal filing fee. I’ve talked to this VSO maybe 5 times in 11 1/2 yrs this has been ongoing (including 2 times a week and a half ago when the decision came out) They simply could not be reached, would not return calls to say the least and the handful of times they were more vague than Peggy…..and NOW they are suggesting I get an attorney. I am physically sick over this. Do any of you think since they remanded the SCM that I could possibly write a statement pointing out my ratings and simply ask why couldn’t they give me the SMC-L for the LOU since that granted the SAH on LOU 100% P/T—-and since they didn’t give me the A/A I had originally asked for. They granted SAH on loss of use lower extremities 100% p/t which the Va.gov site says that should be an automatic “L” since I already have “S”- but instead of giving me “L” - I now see it says Remand- increased rating Special Monthly Compensation and there has also been a compensation issue (they added) since August 2020. So with my IU p/t and SMC -S awarded LOU both lower extremities 100% P/T (which should have been an automatic “L” from what I’m understanding…..Why would they remand SMC??
  3. I was under the impression that with the 100% for loss of use of the lower extremities the SMC-S would become SMC-L but there is no mention of SMC-L in the decision. It shows SMC was remanded??? Why would they not grant “L” and remand the SMC? Everything i’m reading on the government site states it will be an automatic increase. Under additional benefits on ebenefits-it still shows S-1 and entitlement to SAH is granted. Please help me understand. I feel totally let down. Thanks M

I already received the backpay in Sept 2020 when the SMC S1 was granted….but there has been no mention of aid and attendence or anything about service connection for external popliteal nerve paralysis (which they added this contention in 2015-external Popliteal nerve paralysis). I couldn’t understand with 3 C/P exams from VA facilities and their doctors all stating severe LE radiculopathy that they continue to lowball it…and I’m only able to be mobile with my walker or wheelchair (as observed through many test and stated by their doctors) ….the new rating date that appeared was originally 3/11/22 then changed to 4/08/22 and has remained like that. I was praying by chance it may finally be my A/A being awarded. There is still like 6204 claims before me until the judge gets back to my remand.   5. This is my same claim, bva remand appeal dating back to Jan 2011. ( I have been rated 60% IU for 21 years prior to smc s1 awarded in Sept 2020) After years of denials, dro reviews, soc, ssoc and etc. I was finally afforded a 2-C/P exams at the end of 2019 and 1 in Jan 2022 as well as a review of all medical records (requested by RO also in Jan 2022) Exams were for aid and attendance, cervical degenerative arthritis, upper extremity radiculopathy, lower extremity radiculopathy/sciatic nerve paralysis, knee flexion etc. ALL exams were favorable-doctor stated severe for sciatic nerve paralysis, severe radiculopathy LR extremity and moderate for LL extremity, however I was denied everything in Aug 2020….I then wrote a letter disagreeing with all decisions…In Sept 2020 they granted SMC S1 and gave me 20/20/20 radiculopathy ratings for upper extremities and cervical arthritis- and remanded again….Last month April 2022-after the Jan 2022 exam—they gave 10% flexion each knee, 20 % radiculopathy lower right extremity, 10% radiculopathy left lower extremity, 20% limitation of extension each lower extremity—- they added external popliteal nerve paralysis- in 2015 as a contention for service connection (I have right foot drop) but nothing was said either way about service connection for external popliteal nerve paralysis or for aid and attendence (radiculopathy is horrible in hands and I can’t grasp, hold things, cook and ‘other things”)….and I’m only mobile and ambulatory with my walker, or wheelchair -(doctor stated this each time in all c/p exams) but a new rating date of 4/8/2022 appeared under SMC S1….any ideas on what it might mean….Peggy and White House Hot line says it will go back to BVA Judge who issued remand instructions- VA.gov just says review SSOC. Any insight will help….Please my nerves are frayed. Still Hanging on…. Matti
  6. I sent the IRIS inquiry it was the same verbiage as the 800 # (Peggy) almost word for word. I called the White House number last week and was transferred to a guy name Larry who put me on hold for 47 mins- so I finally hung up...called the White House number yesterday -told the about Larry never coming back to the phone- they put me on hold - came back in just a couple of mins-and said nothing had changed...
  7. I am new to posting so if I’m in the wrong spot - please let me know. I have an appeal that was remanded by the BVA in 2018. I called to check my status with Peggy and as the person was taking my call was looking at my info- he said well it’s already being tracked....and that it was in the national work queue since Dec 12, 2019 and hasn’t been looked at since that time. My question is-what do they mean that it’s already being tracked? Thanks sincerely Matti
