  1. Greetings and Soon to be Merry Christmas and Happy New Year once again fellow Hadit Members, Computer Geeks, “Staff” and the like minded and A smile to you “B” and “C”… Josh, the Caribean Outcast in Colombia. with you here… Today, 12/23/2009, I am once again vowing to rattle some cages at the Houston VARO and find out what is happening with my 1151 after all these years. Furthermore, I need to find out if they have tracked down or located the ORIGINAL MRI´s I had previously submitted---- and… and… and …. was informed they were unable to locate those images earlier this year. {2009}… And what about the special handeing request that was never acknowledged. Also Looking to see if my information is up to date? Does anybody know if at the Houston VARO Ursela Henderson is still the Director at 1 713 383 1720 the HRO FAX is 1713 393 1715 Valerie Martinez (What is her title there?) @ 1-713-794-3655 Shannon Kelly 1-713-383-2652 Diane Bernrich 1-713-383-2652
  2. Simple question I have the FAX Number for the MN PMC as 1-612-970-5211 Can anybody confirm that? Thanks Josh And my claim is still in la la land IN Houston TX... The VFW Person I had there in no longer with the VFW there. I received NO NOTE NO word no nada... Why has my claim been overlooked and left incomplete. It would apper that MY claims mailman did not folow up anything I had requested or wrote. What a CHUMP! Now I need to backtrack and see WTF they have. JOSH
  3. Greetings all, Hoping somebody here in HADIT has the Houston Regional Office FAX Number to send information on two seperate issues both related to claims filed. Anybody there have it? Thanks Josh
  4. Berta thanks for your input.... Having had surgery this past week and spending the 2 weeks prior glued in bed, hadn´t had time to really review and consider your input. Thank You.... As I get more information I'll keep the board posted on this long drawn out event. And yes it looks like shredder gate here.
  5. Berta so good to see you , Pete, and Carlie still here chugging away. smile As you can see I am up late this evening and had to check the note left on te board. I knew you three would be here and check on this. Folks from the old days it seems. Berta one comment you made regarding the MRI was regarding the reading or nerative details. This MRI had no narative details attached Berta. How can this be explained, I showed up to the VA ER and told the DOD about the medical error I had found in my case which was started by the HMO I had when in Boulder. That was a hugE MISTAKE! As you may remember I was erroneously diagnosed with MS when the problem was bacterial encephalomyelitis. Rather than giving me antibiotics, the Kaiser Doc put me on immunosupressives. I realized later in the discovery of this error, the doc KNEW EXACTLY what he had done and wanted it to be covered up. This doc started dsong me with the Imuran (used for kidney transplat patients for tissue rejection issues) to alter the blood tests so the raging infection would be "hidden" from being identifed in the basic CBC results. Anyway, I WANTED TO SUE SO BAD i COULD TASTE IT, I went to the VA nievely thinking they would help at least STOP THE INFECTION That I had be let sit in for two years at that point. HOW WRONG I WAS! The va kept up the game and continued keeping a close eyes on me. Kaiser Permanente was the HMO and they were so bold as to break into my appartment and steal the only copy of the original records from Boulder Comunity Hospital replacing it with a totallu revised and reeddited version. What could I do, go to the police and report it. Yea right... a patient has his home broken into by the good doctors of our community, who could and would do no wrong (Boulder mentality). They would have send me to the frigging mental ward. maybe I'm wrong there but I would find it very hard to believe if it had not happen to me! Of all the pages that were altered, I still had ONE PAGE left of a before and after version that was indisputably alterd. I have saved that page like it were gold since it is the only hard proof of what had happen was really happening.. Anyway, with regard to that now "misplaced MRI" there was NO reading page in the records. It would seem nobody wanted to document the fact that a patient with multiple active brain abscesses clearly observable on the MRI's could be diagnosed with MS and then be totally stuffed into the trash. Just so you know,I did not find the actual UNREAD MRI for years because of being stuffed into the medical non recycleable trash. There was NO READING ever submitted for that MRI and they never thought I'd go through the radiology files and find it. The misdiagnosis was clearly known to thos involved in my case and I was being avoided like the plague or todays H1NI swine flu. Being stuffed into a nursing home in Milwaukke Wiscinsin, who would have thought that this knowing Vet would meet a girl on the Internet who had a courtesy plane ticket to fly me to Colombia to get IV antibiotics. Gio, illegally sent the oral antibiotics I needed to survive long enough to get my passport and fly down here. Gio arranged a Doctor and hematologist here to review my case the day I arrived and they, seeing the information and MRI's, got a subclacular line put in the next day. Sheesh, what some will do to stay alive..... Now, all these years later I still wonder how this will all turn out and the information I have learned die with me. I don't know for sure but from what I have found, I'd be very surorised if the information gained in my case wouldn't unlock so of the musterys of that disease, BUt what the hack I'm a nobody who fiund out the hard what how powerful and inhuman doctors can be. The doc in Denver who sent me for that MRI walked up to me sitting in the wheelchair, looked around, smiled and ask me "Do you think we are trying to kill you?" Claearly the answer was YES. but I was able to survive. Today's reality survivor shows, have nothing to share been there, done that. Survivor must know recharge his batteries and get ready for a new day, Will continue this story later complete with documents if anyone is interested in the juicy details held in the printed pages I have saved for so many years at this point. How did this ever happen to me... I am here in Colombia dealing with snakes, but I have dealt with snakes before. Snakes that walk and have the power to give the venom of their chosing. hmmmm what thought go through my head when I remember back all these years and how things have turned out. Oh yes, just what is the defense against Shreddergate cases? I will be calling t he Houston RO on Tuesday and checking up on the "progress" Let you all know then. Josh Oh adding new photos and have another snake to add Berta.
  6. Greetings all hope all is well with you. I called the Houston Texas RO Claims office recently and ask about my 1151 claim. After looking up my claim the claims director indicated my claim should have been reviewed long ago. Considering the incident began in 1993 and was submitted in 1999 after getting out of the nursing home I had been in for nearly 3 years, you would think it would have moved further. they indicate the claim was filed in 2002 (I need to check my archived files for exact dates)still along time before an answer.) Well, the Claims Officer I spoke with at the time said "Although, your paperwork should have been sent to Washingtom, long ago it is still here. All I could say was EXCUSE ME? He went on to say he would make sure that it would have prompt attention, that was 3 months ago and still nothing. He did go on to say in the conversation that the Washington Reviewer was coming to Houston to review files and so the records would be kept in Houston and be reviewed ASAP. I said great and here we are no answer. I was expecting an August reply but nothing. Does what I am typing here sound like BS to you all? It's not and here I sit and wait... Would a reviewer or review "team" ever be sent to a RO to do such a thing and if so has anybody at the Houston RO been told or know anything about this? Oh yes. During that call I ask about MY ORIGINAL set of MRI+'s which I had proof of submission were and he idicated "we typically do not review that type of information. And they were not in the files Again EXCUSE ME.... That is the absolute picture image of what YOUR DOCTOS LET GO FOR YEARS and you don't review it? What?????????? This is a still developing story and I will be calling again when I get into the city next week. Again if anybody knows or has information regarding the socalled DC reviewers going to the HOUSTON RO, olease let me know. I am in South America basically out in the jungle and need more green.. Just not green snakes like you see attached- Joseph Joseph Cartagena, Colombia Boulder Colorado
  7. Hoppy, I understand your suspician. No, I was not playing doctor. I went way out of the way to get medical help and to have to be flown by a then strtanger to another country is outrageous. Thank goodness that the angels were with me then. Hopefully still with me.

  9. Carlie, Hoppy, Berta and others, Please read and check out the attachments. They will, in brief, fill you in on some of the evidence submitted and what I was dealing with. And thank you all for advise you have offered Time to review the options and plan the calls and conversational content. All clues and comments welcome.... Also, Tell me does it sound like a good Story/Novel? Josh 20000714DrReynolds_to_Hadit.bmp 6182009_Hi_Hoppy.doc Hearing_Request_to_Hadit.bmp
  10. Sheeesh I was away Berta and missed your reply Off to read it now Thanks ever so much.
  11. Oh yes Berta, Also is a good idea about the IRIS Complaint direction. I am not the complaining "kind-of-guy" but am willing to learn how do do it without being aggresive. Thanks I'll keep the board here updated. ..... Josh
  12. Berta This is what IRIS Replied with ...................... Your appeal is still with your local VARO. Until you receive notification that they have transferred your file to the BVA in Washington, DC, your local VARO remains the best place to obtain information. I suggest you visit the web site at www.va.gov and double click on the link for Veterans Benefits Administration (Compensation and Pension) and e-mail directly to the regional office. You can also dial the toll-free number (1-800-827-1000), and be connected to a Veterans Benefits Administration counselor at the local VA regional office who is better able to assist you in your request and answer any questions. -------------------------------------------------------------------------------- From: giojoshcol [mailto:GIOJOSHCOL@telecom.com.co] Sent: Monday, June 08, 2009 6:55 PM To: BVA Ombudsman Subject: BVA Claim Status Request Importance: High Dear BVA Omsbudsman, My name is Joseph A. Hertrich and I have been waiting for years to get closure regarding the sequesnce of events which finally led to an 1151 Claim. That claim is currently still "being processed" within the VA offices AND HAS YET to reply OR acknowledge key evidence submitted for the Claim’s Review Process. That evidence was an SERIES of MRI images dated 10/13/1995 (see attached sigle image) from the Denver Veterans Administration Hospital and acknowledged as having been received by your offices. Where is the claim at this stage and what is being done? In addition I have the increased need of motorized transport and have determined a John Deere Gator Utility Vehicle would best suit my needs as we live in the outback in Colombia, South America. How can the VA assist me in acquiring this needed Utility vehicle as transportation. Can the VA provide this in place of the motorized wheelchair I currently own? The price new is around $20,000 and clearly more economical than a full car, What do you say? Needing your assistance, Joseph A. Hertrich
  13. Greetings Berts. It is the VARO in Houston Texas. My VFW SO is "supposed to be there" but who knows. He never answers anylonger and that is for no reason. If ou have a contact, I sure would appreciate it. Joseph Hertrich (Josh)
  14. Administrative Silence, Good Afternoon Hadit Members, I have not posted messages to this board in a considerable amount of time BUT needed to come back here to get “you all’s” advise. My claim goes back years but it seems the VARO in Texas has not forwarded my claim to the BVA for review as per a message from IRIS. They keep on overlooking the obvious errors that were made in diagnosis, which forced me to literally fly to Colombia, South America to get treatment and survive. The ORIGINAL MRI Films, which I submitted, have seemingly been mislaid, and even my contact at the VFW which is my POA does not answer my emails anymore. I have been filing appeals all the way along and still they do not look at what I send nor acknowledge t hey have received it. I have a copy of all that was submitted which is a 3- ring binder of information, PLUS the MRI’s in digital form and a receipt notification. How can I “bop” somebody and get their attention? Does the VA have a process which moves a claim out of a seeming “Administrative Silence Zone “and gets it back in the path to finish. I have posted the claim several times here including the MRI Copy for others to see. Berta has been helpful in the past with her input but if there are others…..Carlie (Hi Carlie) or more who may be able to get me their secret to getting their stuck or frozen claim moving, please tell me what it is. It seems there was the name of a process that can be initiated but the name escapes me at this point. If anybody knows the name please post it! Also what to do about the “mislaid Evidence?” Thanks all, Respectfully… Joseph (josh)
  15. Good Morning Carlie No I have not received anything that would indicate the claim was transfered to the BVA. This information was given to me by the VFW rep "mailman" who does nothing but forward emails it seems. hmmm This system works ,,,Hmmmmm sometimes.... Possibly .....maybe... maybe not...
  16. Greetings once more Hadit Members. I have not been in for a considerable time but now that my claim has been forwarded to the BVA for review, how much time can that take? Secondly. is there a way to check the claim's progress? Thanks Josh Hi to Berta, Carlie, and others from the "Old Forum" Hope life finds you well. TBird have not sent in my contribution yet as there still has been no decision. When you get a Donation from me, it will be a message the claim was FINALLY reviewed and approved. BTW They "misplaced" the MRI{s that show the error in full detail ... missed brain absecess. Should have been pretty hard to miss those you see on the attached image. that is unless the MRI is UNREAD.
  17. Greetings Hadit Members. Long lost member here looking to get an idea of what is next. Brenda if you are still around I know you would know such things as this... I have had my claim go in what seems repeated circles at the Houston RO and they always avoid looking at the clearly hands down proof that they goofed, When A Regional Office repeatedly does not include information that was sent in but not reviewed, what cam a person do? Is it really possible they can stonewall and not read information and still deny a clearly valid claim? Is that Where does a claim go after it has moves through the RO level.. Does it finally get to be reviewed by "The Great OZ?" What can I expect next of will it possible get remanded as I was constantly writing and asking about the MRI's and they never even breached the subject in any of their reviews? Thanks and I hope all is going well with the group here...
  18. My wife`s and my heart's go out to you for your loss. Cancer is a beast she has dealt with and the fear it causes is horrible.
  19. Your statement... "It is not wise to become a totally disabled vet unless you have about $200,000 in the bank." Ahhhh John your figure is at the lowend of the estimates. Personally I would have liked to have about 500K or considerably more of course. Josh .
  20. Thanks Berta..smiley to you :) Still have not heard back from the RO in TX regarding the 1151....hmmmm They really do not want to answer because they know I will be all over them again.... If they come back and say those images I have are MS and NOT a multiple brain abscesses, I will let the WORLD KNOW just what MS is... A convienient cover up of medical errors since they can always say "We have no what is the cause and solution not to mention the National MS foundation would lose millions of dollars in research funds and the poor human white rats for experiment drug treatments. any way again .... Thanks Berta for the info Josh
  21. Greetings Hadit Members, I am getting ready to send my EVR and Medical Expense Report in to MN offices but have a PO Box (11000). Since I live outside the country and need to send them by air courier I need a street address for delivery. Also, who would I have there to sign for them? Thanks Josh
  22. Dear ¨"Speaking Out" Those days are long over.. I filed the Tort and it was denied... I would have gone to federal court if I had been there (In the US) Because I had to "run" to Colombia to a girl I met on-line who provided the doctor antibiotics, and nursing care... Long story... One for the Silver Screen actually.. Everybody has one I´ve learned but the story behind this case is amazing.. I actually have a document from the State of Wisconsin where it is written I am dead and even gives the date of my death. I´ve had records altered and even was flown to Colombia by a girl, at her expense no less and we had never even had met... Now I am alive and live in´Colombia South America... That Girl is Giovanna, she is my wife, and I´m so glad for it and love her dearly. After she brought me here in 1999 I returned to the US, the doctors were amazed, I was out of both the nursing home (which I was in for 2.5 YEARS) and the electric wheel chair.. SuperQuad was on his feet again. Hmmm How did this all begin and when and where will it ever end?
  23. For those of you who want to see a finished 1151 SSOC reply, it is attached with the missed MRI abscesses. josh This one nearly killed me............. but I am here in Colombia South America on the Carribean Sea......... slowed down.. but still breathing. 1151_hadit_copy.doc
  24. No Berta the 1151 was not approved yet but there can be no question it will be approved this time with the photographic evidence (MRI's that went unread) that this 1151 claim SHOULD BE APPROVED. Wow I was thinking about it from what date should the retro be calculated... When the event occurred or when it was filed as a claim? Thanks Berta Josh And when I get the approval, The Hadit Board will know it in more ways than one.
