  1. I fired my VSO a while back partially due to the knowledge gained here at this website. Best thing I ever did(not that I am condoning doing that to folk). It's just that I am capable of dealing with the legalities and regs...and again I stress...not all of us are capable...by all means use a Veteran's Advocate if your not comfortable handling all the aspects of your claim. But since firing my deadweight no-good SOB..I have won a major appeal and some minor claims on my own. I have seen much more action on my claims and appeals representing myself. Just my circumstance tho..not the norm...I hope.
  2. I even sent them additional evidence by fax..with the request to waiver R.O. review..and they acknowledged receipt within 7 days.
  3. Oh it is absolutely, 100%, unequivocably true! I am pleasantly shocked. Like I said tho..there's got to be an angle as to why they are processing it so fast. I am the exception..without a doubt.
  4. I am rated as undiagnosed illness(I call it desert storm syndrome). One of the cluster of my conditions is a skin disorder. They have given it a diagnosis..thereby eliminating it from undiagnosed..as follicolitis..what a crock..later called excema..then dermatitis...it spreads intermittently and now is controlled with a real good pill..after shots of steroids...What is really helping it is my allergy shots. Hope that info helps in some small way.
  5. Hard to believe..I know.. Called Washington D.C. BVA 1-800...your case is being reviewed by the attorneys..it will take 2-6 months to complete. The R.O. has to be behind this cause I slammed them with 2 NODs asap right before they shipped the C-File out. Will wonders never cease!

  8. I Know, its been a while since I rocked and rolled(posted). Just been lurking..didn't feel I had anything to contribute. But I do have something fresh....seems my CUE(Carlie) is about to be won! Just a matter of how they word the award. It won't increase my % but it is the principal! Basically they said I don't have the condition and I never was diagnosed active duty with it. I have since discharge been prescribed medication for it. (By the VA) I have SMRs(soldier medical records) that show more than several complaints and diagnoses of it. My argument to the VA was in in effect the above. The C&P examiner stated to me: I am telling you now that this condition is service connected! It's up to the rater at what %. (His exact words) I thanked him and told him this has been the best C&P I ever had! Guess I was lucky to get an forthright..upright examiner...most of the time it don't pan out like that. By the way...the condition is allergic rhinitis...do you believe they werer stonewalling me on this?
  9. My file is in the appeals team with the "Adjudicator". I have 3 active claims pending..2 on appeal and 1 CUE. My research came up with several different definitions for this Title..person gathering all the info, person rating, and person following up after a rating. Anyone out there know exactly what the "Adjuicators" duties really are?
  10. Carlie, I thought over your suggestion. I have a good patient/doctor relationship with the Derm Doc. He actually has called me after I left a message with the clinics's front desk people and saw me that day. They were not gonna let me see him without another consultation request from my PCP..that would've taken way too long. I really don't want to do anything that might potentially give him heartburn. For all I know he might gladly look over my SMRs and provide a Nexus opinion. Then again, he might give me crazy eyes and not want to be burdened with non-treatment issues. I think I'll just let the claim process run its course and deal with the nexus issue at the C&P exam, if there is one requested. If they already service connected me for skin problems..would they even require a nexus?
  11. Thanks for the input, I'm gonna go for the increase..if they say it's not folliculitis then I'll file a new claim for dermatitis/excema. I mean to me it's all skin rashes..whatever they label it. We'll see.
  12. I'm not sure if I should reopen my 0% rated folliculitis (They gave it a 7899-7806 diagnostic code) for increase, or file a new claim for dermatitis/excema (code 7806). Brief Summary: Initially claimed skin rashes, They came and went on various parts of my body during active duty which was medically documented. When the C&P exam took place The Dermatology examiner noted that forehead and temple rashes were in remission and that both buttocks had rashes that were less than 5% of the body. I was awarded service connection at the 0 percentage rate. That was around 8 years ago..the rashes kept resurfacing on various parts of my body since then. More recently I have been experiencing more widespread breakouts that have covered large areas..i.e whole leg, whole trunk etc.. I have been treated for these more severe reoccurrences at the VA with topical corticosteroid creams and steroid injections. I also have had my wife take pictures. The skin condition has been diagnosed as various different things..folliculitis, excema, dermatitis and psoriasis! I am leaning towards reopening the 0% and requesting an increase in rating due to increased severity. What approach should I take? Thanks for any and all input!
  13. As a Veteran and a claimant..U should elect DRO De Novo Review during the process. Not that it will do any good..but that is the best option available in the process at the given time. Who luvs ya baby!
  14. I left out the most important part of my thread... When I finally got a copy of my C-File(as Pete recommends) after reviewing the countless pages..I found invaluable evidence in support of my claim. Without going into detail. Pete pointed me in the right direction!
  15. Pete is the man.. He gave me some advice that really rocked my world! You are spinning your wheels until you get a copy of your C-file. Lo and behold! I listened to his advice..procured a copy(Big box...maybe 1 or 2 thousand pages). The key to winning my 4plus year appeal..was 3-part. Part 1: Fired my POA(Power of attorney) VFW by the way. Can't give Pete credit on that move..sponged it off of Berta! I could whine and complain about my jagoff of an advocate..but I won't for the simple fact that his predecessor was awesome! Part 2: I submitted, sometimes redundently..medical documentation ..and statements from witnesses...evidence of my conditions. Part 3: I had a doctor connect or relate my active duty symptoms to my present symptoms...IE: A Nexus! Took me a long time but they finally capitulated and awarded me what was due to me as an American Soldier with disabilities. I am really superficially covering my personal case..listen to these elders..and adhere to their advice..it brought me victory out of the hands of defeat. Oh and as a by subject: The Retro...it ain't no thaing but a chicken waing..gone in 60 seconds.. Home improvements...property taxes...personal debts..not that it was'nt a Godsend..but it ain't all that! Long Live Hadit.Com!
  16. Like Pete always says..Your spinnin Your the wheels until you get the C-File. His advice was on the money for me. I found invaluable evidence in my file that ultimately assisted in winning my appeal. Sheesh!

  18. Pete..Berta..T-Bird..and all you other guys and gals who I absorbed wisdom like a sponge absorbs water. After 4 yrs plus I finally won my appeal on the sleep apnea issue. I can't thank U guys enuff!!!!! It has been a blessing that I found this website! YES!
  19. Hang in there Wings.. U must be talkin with the paper mill attorneys..grind em out slam dunk only bottom feeders. I feel, just by your conviction that U have a bonafide claim. We all have our unique..specific details concerning our respective claims. I am sure your evidence has merit. As smart as you are...if U have to..U can represent yourself..and win! Jeez..I'll help you for free..give the 25% to your favorite charity.
  20. Ricky.. Sometimes I wonder if It would be better off if I got someone other than my regional VARO on the 1-800 line. In the last 4 weeks I have gotten this info out of my Home VARO: 1) Appeal in the pre-development team of the Appeals section 2) Appeal with the DRO in the Appeals section 3) Appeal with the Rater in the Appeals section 4) Appeal in the pre-development team of the Appeals section. WTF? I'm goin cuckoo for cocoa puffs tryin to make sense of their hamster wheel of a process. Patience is a virtue...breathe in..breathe out....Ahh... Nah..I still have Hadit with the inefficiency.
  21. At first..they tried that on me..In the method of election contact..I chose E-Mail..but they called me. So..I promptly sent another IRIS..stating..hey..I chose E-Mail..why am I getting phone calls? Not that phone calls are all that bad..Like Free Spirit said..I want a record of communications. I guess it's a crap-shoot as to who Ur VARO is...but mine is good on the IRIS.
  22. Some of U guys know about my old posts...Pete and Berta chiefly. For those that don't...I have an appeal on a condition..that two VA C&P examiners have documented: As likely as not..and more likely than not, had it's onset during active duty. I have gone thru the Hamster Wheel for 4 years on this issue. Apparently..as per IRIS..a decision will be done "quickly". I have to tell U...The IRIS guy has been phenomenal leading up to this "quickly" statement. Without going into detail..this civil servant has been outstanding as far as my inquiries go. I put him in for recognizance. Maybe I was lucky..maybe it was a coincidence I got a good one...in any event...I should hear something "quickly". To the gist of my post: whaty is the VA's definition of "quickly"? I bet a dollar to a donut it's over a year. But to summarize my thoughts: Take advantage of the IRIS system...it has done me right.
