  1. Do Congressman and Senators have the pull necessary to make a difference in a VA claim?
  2. Is this worth a call to my Senator/Gongressman?
  3. Can anyone suggest a lawyer in the central Florida area?
  4. I injured my knee in 1986. I filed a VA clain in August of 2007. Even though my DD214 state "EPTS not service agerveted - no disability", after looking at the SMR's the VA has granted me 30% disability. There is no evidence the injury existed prior to service. I was 18 at the time, and when the Army said no disability, I never questioned it unitll a college professor encouraged me to file. I don't even want to think about how much money this would add up to.
  5. I injured my knee in basic training. I had arthroscopic surgery that revealed a torn ACL and torn meniscus. Since I had not been in 180 days, and told them I sprained my knee prior to enlisting, I was seperated as EPTS not service agervated. The army told me this is a pre existing injury that was not agervated while in service, so no disability. Fast forward 20+years and a total knee replacement. On the advise of a college professor, I filed a claim with the VA. The VA has granted me service connection for this injury. Is there any way to get retro pay for some of the 20+years that I missed because they lied to me?
  6. Here is the letter that my doc wrote, it has been submitted as evidence along with anti-inflammatory prescription, pain medicine prescription, and the prescription for the knee brace. Mr. Steven is a patient of mine that underwent a right total knee replacement on 12/07/06. He has some intermittent pain and swelling in his knee On exam, he has 0-130 degrees of flexion. X-rays demonstrate a well-aligned right total knee replacement. I feel that his pain and swelling is attributed to the functional use and possible overuse of the joint. He has been given an anti-inflammatory medicine to control pain and swelling, and we have prescribed a knee wrap to assist with support and stability of his joint.
  7. Yes, he wrote a script for a medically necessary brace. I submitted it as evidence. here is what my doc wrote:
  8. Should you point out every single descrepincy that you discover in a C&P exam. For example, after looking at my C&P exam result for the 1348th time, I noticed the following: IS WEIGHT BEARING JOINT AFFECTED: YES DESCRIBE GAIT: NORMAL Well the doc never had me walk, if she did she would have seen the obvious limp that I currently walk with. ALSO IS THERE LOSS OF A BONE OR PART OF A BONE: NO The surgery reports that I submitted clearly state how much of my ferur and tibia where removed. Should I bring this to their attention?
  9. Berta, I have submitted the following additional evidence with the NOD letter 1. 2ea. buddy statements from co-workers that attest to the issues I still have. 2. Letter from doctor which backs up my statements in the NOD letter 3. Copy of medically necessary letter for a knee brace 4. copies of perscriptions for anit inflamatory and pain medication
  10. Please review the attached NOD and provide some feedback. This will be my first one. NOTICE_OF_DISAGREEMENT1.pdf
