  5. No. I just back the Claim and they lumped everything together and awarded me SMC L-1 based on needing A&A

  9. Good Afternoon, Could you please direct me in the following. I have 2 A&As that the VA grouped together under A&A. My wife is a physician that takes care of me for PTSD keeping me safe from hurting myself/others (also states that I am in danger of hurting myself/other in my psych evaluation from VA that awarded me 100% PTSD Rating and for total loss of both feet and spinal issues where my wife injects me daily, provides physical therapy for me and changes and addresses my wound care, not to mention all Acts of Daily Living. So, my question is do I file for a higher level of increase for SMC O because of 2 A&As (Or even on A&A and Loss of use SMC-O, or do I file for a Higher Level of Care based on the additional things only a medical professional can provide? Should I really get a lawyer? Thank you very much

  11. Good Afternoon, I was approved for Aid & Attendance which I am very grateful! My question is that I was informed that the VA placed all of my SC Disabilities under Aid & Attendance. This includes SC 200% PTSD for keeping me safe, SC 200% Loss of Use of Both Feet and SC 100% Complications of Stroke to name a few. Aren’t Loss of Use and PTSD Keeping me safe separate with only one of them needed to establish Aid and Attendance? Wouldn’t it be considered R1? Thank You All!
  12. Hello Everyone, I received my claim back today. The VA awarded me Aid and Attendance SMC L1 based on every condition I have from 100% Rated Loss of use of feet, 100% Rated PTSD, 100% rated Stroke and even 50% rated sleep Apnea. I have ratings totaling 650%. Can the VA lump everything together? loss of use and being kept safe because of PTSD are 2 additional and separate listed items under SMC. I’m so confused. Thank you for answering and giving me advise!
  13. BTW, I have read that you can be awarded only one full step for a second unrelated 100% disability after SMC L1. I have not seen it for the half bumps. Thank you Mark
  14. Thank you for the reply! Unfortunately, it does not address how many half bumps you can receive unless I missed it, I’ve read through Asknods information many times and GREATLY Appreciate his contributions and unrelenting fight for veterans! Thank you

  17. Hello Everyone, some months back after receiving SMC L1 for A&A, I filed for a half bump increase due to a 50% unrelated disability (Sleep Apnea). To my surprise, this turned into a Higher Level Review (HLR). The result was my A&A was turned into SMC S1 bashed on the VA’s determination that the rater granted for non service related disabilities. I found that odd due to the fact that I am rated 100% PTSD with the Psychiatrist Evaluation clearly stating that I was a danger to myself or others. I really didn’t know how to appeal and decided to leave it alone until my other claim came back. I just received the results of my new claim awarding me A&A for 100% rated loss of use of both feet. I was awarded SMC L1. Which brings me to my questions: 1. Shouldn’t this have been awarded at least SMC N 1/2 based on another 100% rated disability and then another half step for my unrelated 50% Sleep Apnea? 2. How do I turn this into what I believe should be SMC R1 due to 2 A&A? The VA said I would need to file a new claim, contradicting what the website says. Do I just upload Buddy Letters in the new Buddy Letter forms with the Psychiatrist Evaluation (highlighting the danger to self/others) I am sorry if this doesn’t make sense and is confusing.   18. Thank you for the responses you all. My Higher Level Review was for Aid and Attendance supposedly given out prematurely. They also that the rater used things that were not service connected even though none of them were listed on my rating sheet under Aid and Attendance. I am rated 100% for PTSD and I have a lot of service rated back and nerve conditions leading to loss of use of my legs. I am Bedridden for even being in a wheelchair is extremely painful due to my rated back issues. My wife changes my bandages when treating my bedsores and give me daily injections of insulin with monitoring of sugar levels and blood pressure checks for rated hypertension, enimas when needed for my rated IBS. I just know if by the doctor putting me down for 13 hours a day would circumvent me being VA rated for being bedridden. I hope that clarifies things a little more. Thank You again
  19. Hello, It is nice to be here. I think I posted in the wrong area. Please forgive me. I’m having difficulty learning how to post something. I was approved for SMC L1 and put in a request for a half step due to a stand alone condition. This turned into a Higher Level Review. The VA stated that the rater used things that were not service related. I have 3 different cancers, diabetes and a stroke that are not rated at this time. I am a 100% permanent and total vet with many spine and neck issues that effect me an am also rated 100% for stand alone PTSD. Due to my many nerve a disc problems, I am bedridden with loss of use of my legs. My wife is physician that has to quit working to take care of me. She is my caregiver and also my doctor at home for she administers my medicine, take care of and treats bed sores, physical therapy, acupuncture, blood pressure checks, etc. on top of that she does the feeding, grooming, showering, and keeps me from harming myself because of my PTSD. The VA has found me incompetent as well. I just had a Aid & Attendance exam because they failed to ever do one. Everything seemed fine and I told the doctor that I am bedridden and only get out of bed into a wheelchair with the aid of my wife, to take a shower, attend any necessary medical appointments by the VA and very seldom, my wife will take me outside for a few minutes. Unbeknownst to me, the doctor fill out the form I later found out that he has]d me wheelchair bound and bedridden for 8 hours at night and 5 hours during the day. My question is, did the doctor mess the claim up for being bedridden and messing up the chances for R1? I didn’t know there was such thing until it hear that 2 L’s equal O and if one is for Aid & Attendance then it’s R1. I hope this is understandable to you all and I thank you for your time.

    Hello, I was sent to an Aid & Attendance Exam. My wife is my provider who is a physician who has to stop working to take care of my bed sore, injection, physical therapy, feeding, bathing, etc. I have a lot of spinal nerve problems that keeps me bedridden. Unbeknownst to me, the exam physician stated that I am bedridden 8 hours a night and 5 hours during the day. I found this out through a rep that read the exam. I clearly stated to the physician that I am in bed all the time except when my wife gets me in a wheelchair and gets me in the shower. My question is, did the physician just screw me out of being truly bedridden? Thank you very much in advance. Mark
