Berta, My Daughter did find the FTCA statement on one of the papers I got & was talking with Son ( Lawyer) in Phoenix & he says " One has to show damages to do any good" Also, find below statement from VA Employee saying " She had informed VA before this happened with the VA Dental that they were doing it wrong & was ignored" It seems to be getting more interesting every day News for Former VA hospital employee warned ... Berta, I was talking to my Son over the net last night 9 He's a lawyer in Phoenix, & he said " There may be some Vets sueing over the Stress & Anxiety Issue even if nothing shows up & the possiblity of a Class action suit" & I told him I didn't think that would fly What do U think? Also, I was wondering.. really don't want to pay for one but do you think it may be necessary to also get a Blood Test from an outside source but I don't believe the VA would leave theim selves open to another Major news Story over doing hokey blood teats Ya, the Certified letter thing threw me for a loop Sincerly GARY
  3. I saw several people down there & the last one I saw was the one who told me I could file a claim & gave me a sheet about Blood Borne Diseases.. Understanding Blood Borns Diseases is what it says I also received another page that says"Claim for damage,Injury, or death & another one "Financial Compensation after an injury" & another " Financial Compensation after an injury." He stated something to the effect that I could file a "Tort Claim" which is like a "Lawsuit" against the Hospital & is a one shot deal OK..On pamplet it says " I can file a Tort Claim or hire an Attorney to file a Tort or I can file a Benefits Claim" it says in paper work On my Certified letter it says " Dental Review Call Center will be manned 7 days a week M-F 8 am till 6 pm & Satursdays 8 am - 4 pm Also, it says " We deeply regret blah blah blah" No one said anything about an 1151 just gave me paper work I noted & also ( Kind of Funny) they gave me the biggest box of condoms I have ever seen & gave me a years Perscription for them ( Well, maybe not funny) Berta, no my Wife is not schedluded to be tested & no one mentioned anything like this Sincerly GARY

OK I received a letter from the St.Louis VA saying " I may have been exposed to Hepatitis B,Hep C & HIV Letter said to come in & get a blood test if one wants & "Don't worry" as its no big deal problem as someone wasn't cleaning Dental Tools correcttly & you may have been exposed to these diseases I was at the VA Hospital today & my Daughter called me & told me about the certified letter I had received & what it said I had a blood test & they said they would have the results in about 2 weeks Everyone very reassuring that its very unlikely anyone has anything so stay calm Find article about this below Not sure what is going on but sounds rather serious to me....Was told I could file a claim or a tort claim on this but guess that depends on the blood tests Also, we're to be retested in 6 months Does anyone know if it's possible this stuff won't show up in a blood test & one still has it?.....GARY Veterans receiving dental care may have been exposed to ... OK,,,heres what I am wondering My Daughter is the caregiver for me as my Wife at the present she is also a care giver for her Question is as follows...Is she eligible for any money or whatever from the VA? OK...I got out of the Military in 1967 & I am 100% T & P Also, SMC L Any advice or whatever or sites woul be highly appreciated Sincerly, GARY

OK As I said " I have a couple of questions" which are as follows My nephew is getting a medicial retirement from the Army as he broke/bent or what ever his trigger finger & is unable to shot a rifle & the Army wanted to send him back to Iraq but they wanted to amputate his finger first His mom talked him out of the operation & he is now getting a Medicial Retirement rated at 65% Can anyone tell me where I can look up the rates of pay for medicial retirements & I have given him the name of hadit so I suppose he will be here as soon as he can I also have another question from a Vet who is in a similar situation as me His Wife got ill & he has to put her in a Nursing home & he is a disabked vet & he says the Nursing home wants 6k a month for her to be there ( Sounds like a lot of money to me) But, he said " she could be in there on Medicade" but he said the catch is one has to be broke before one is eligible He also asked me if Medicade would count his disabilty pay towards the family money because if they don't she would qualify Also, he was wondering if Medicade could attach his VA Disability for any payments due I think ( I may be wrong) but from talking to him he wants to know if his disability is just for him or is it community property Meaning can his VA disability be forced to pay for a Nursing home or is it a seperate I hope I have explained this right & if there is a similar post it is because I also gave him the hadit address Any help will be appreciated GARY

OK Took Wife to hospital today & seems I'm not giving her proper care at home so I have to put her in a Nursing Home I can understand Drs point of view to a certain degree as she does need to be in one but it depress' the hell out of me It seems every couple of months shes back in the hospital for the same things & I think they believe she is being put to the side at home which is not true but she has finally admitted that she needs to be somewhere she can have medicial help all the time So, what I am faced with ( My daughter found out today) is any where from 5 -$6,000.00 per month for her care I have been told I can go the Medicade route but it seems they suck all your money out of U till U are broke then they will pick up the cost of caring for her. I don't want to do this as I have never been on any sort of Welfare System thingie & really don't want to start now & being completly broke is not a good way to be in life OK My question is.. Will the VA pick up any of the cost for her Nursing Home costs? OK I'm GARY which I'm sure a few around here remember who I am. I'm always looking but seldom post anything but try to stay up with what is going on on the site I'm 100% T & P Compensation & I have a SC rated at L Berta & Pete will remember me when they read this Also, I have grave concerns about her being in a Nursing home as I have seen notices about if someone U know in a Nursing Home has any broken bones,etc,etc be sure to report this to the proper authorites This is one of the reasons we have been very reluctant for her to go in one of these places but it seems the time has come so we have to If anyone can help me I would sincerly appreciate it as she is in the hospital now & will be released to a Nursing Home when she comes out & I have to have some where for her to go I feel I should have looked into this earlier but I never really thought the day would come that this would have to be done Any ideas at all would be sincerly appreciated because at the present I am at a total loss of what to do I will check back & see what replies I get & I want to Thank All who answer & all the people on this site because without U the VA would have spit me to the side of the road If anyone wants to send any ideas directly to me my E mail Address is gdsnide@hotmail.com Also, I wish to say " I appreciate all the knowledge everyone has shared with me on this site especially Berta as she had to hold my hand for years" If, anyone does answer to my E Mail at my site Please put hadit in the message some where so I can see who it is from as I am scared of all the Virus' & all that stuff on the NET Sincerly, GARY
  10. Carlie Thank U for the reply My Wife & I just finished talking to the VA Guy & he explained how to use the debit card from the other acct. VA we have but we still have to keep receipts on every thing bought out of the VA Acct Hence, we can use debit card, Then put money from VA Acct in the Debit card acct & make sure to hold on to receipts in case they are ever needed Well, thats better than not being comped any way Again...Thank U GARY

OK,,I'm Gary..I must say the talent here is awesome I don't post much but have hadit E mailed to me every day so I try to keep up with what is going on OK heres my question The VA ruled I couldn't take care of my VA Comp so I hade to appoint a Fudicary which is my Wife who I have been married to over 40 years Now I have been told I muust have a checking acct just for my VA Comp & only my Wife can write a check out of it Which sounds reasonable I suppose But, heres the tricky part No debit card for anyone which means a check has to be written for every single thing that is bought This is not the age of checks as every thing is electronic & besides writing a check for every thing one buys causes a lot of problems If one writes a check every time then one has to go thru the process of showing ID & getting the check approved ( I think thats how it works) this is going to cause a lot of hardships as neither my wife or I drive & a lot of times we have one of our kids pick up stuff we need when they are out Now, if they were to try & purchase something with a pre signed check I believe this is where the hassle starts & I think it may even be turned down as most people use debit cards ( Which we have been doing &/or credit cards) Buys thru the Internet is done as I would have to send a Check signed by my wife to get said item Also, the VA Person we have been talking to has said " receipts for every transaction are not needed but if they are asked for it would be best if we have them He also said this is a new situp the VA is sitting up Has anyone run into this & is there any way around this ? The Acct is sit up as my Wife as a federal Fudicary for my VA Comp With out a Debit &/or Credit Card lfe would get a bit complicated.. Also, with this type of acct there are no debit cards to be sit up Any help in this matter greatly appreciated GARY
  14. C I did once see a guy at the VA (He worked there) & he didn't have any legs doing Office Wokr But, I guess that would not be good as he can't sit long this may be why hes getting turned down but this also would have to do with his Education GARY

McQueen, Listen to what this lady says because, well, heres the story It took me 9 years & a Lawyer to get comped at 100% T&P First, if I had never had found hadit this would have never happened If T-Bird had never have started Hadit ( Which is a great thing she did) I would never have met Berta...Who, in my mind was of more help in me getting comped than my Lawyer was because she definately knows the ins & outs of the VA System I must say 9 years is a long time to hang out trying to get a claim approved but as I read before I started with the VA "The only way to lose is to quit" But,10 years is bordering on insanity but hang in there Good Luck in your Adventures with the VA GARY

H, I forgot to say on your other post is if U want to see if U have a Valid claim for SS is to contact a SS lawyer ( No charge till they win for U)..Then they get 20% of original money U receive & no more. Here's the kicker ..If a SS lawyer won't take U on that means U have a very poor case but as I said on your other post " Good Luck" GARY
  17. H, I was denied SS the first time & had to get a Lawyer for the ALJ to approve me... I never even considered it till 1996 my World had all went to hell. I had my own business for about 25 years & then POOF down the toilet then I has to fight SS even though they knew all about my Head problems........Then the VA is another animal & it took me 9 years & a Lawyer for them to understand what was up..Thanks to Berta ( To whom I will be forever grateful) & other members Im now at 100% T & P & also SMC at the L rate &, if I may, I can tell U if U are working the VA will find out At present the VA has me on appox. about 20 pills a day & I am Thankful that I don't have to pay for all those pills as I believe it would cost me about $2,500 a Month for them So that would mean I wouldn't be taking them Also, from what I have read on here is that if the VA finds U were being "TRICKY" with your claim they will come after U for any monies U have received. My advise would be to be straight up with the VA as they will find out as they keep very good records & they can come after U But,SIR, good luck in your endevors GARY

My theory is that 2 arguments that can't won is Religon & Politics & besides on this site it is forbidden...The sooner everyone understands that they'll make your job a lot easier, I agree, Political Posts should be deleted...Every one here knows not to post about politics Besides any thing about the subject that was posted about I believe there is no one who understands any thing about this idea GARY

  22. Pete, I forgot if I asked U this or not but I need some information on getting paid from the VA for having my Bathroom remolded Did the same as U. I had a Tub replaced with a Shower but my problem ( or I think it's a problem) is that I have paid for it already & I am thinking maybe I could get the VA to pay for it some way Would U be so kind as to post the paper work U used to get your's approved Thank You GARY
  23. The VA did that to ms & I have my Wife as my Fudiciary & the money goes into an account with both our names on it as it has always since we got married. Got married in 1968 Berta even told me " A rating like that may even turn out to be helpful if in the future the VA tried to down grade my Percentages" GARY
