  3. Berta Can I file for SMC for scars? I have about a 7" scar on the right side side of my fore hear & a scar from the out side of one eye brow across the nose to the out side of other eye brow. As U know I am 100% T & P from the 2 Shore Patrol & me dancing in Japan in 1967 also I am L1 I had a piece of my Brain hanging in a sinus which cause me to have menengitis 4 times & the one over my eye brows it was determined I had a hole in my head. I have seen other people on here put in claims for scars & the one on my head looks like half a frontal lobotomy. HA Sincerly GARY Also I was rated 100% T & P in 1997 so this is over 10 years. I have read about rating being protected after 10 years. Could U please explain THANK U
  4. Since he has had a decision in his case I would reccomend a Lawyer if he can find one to take the case. It took me 7 years on my own then I got a Lawyer & he got it approved in 2 years or less. Total on my part 9 years...............GARY
  5. Pete, It really doesn't do any good to worry about these raises any way as what they will be that's it & the Vets have no say in it. Hey, read something where SS may be different than Vets increase. Know any thing about this or will it be like always where they will be the same? It is something to speculate on & see who's right & who's not & if I was to bet my money would be on U as I have been following your answers & U are on the button most of the time, heck ,maybe all the time as I just read & am not that up on what's going on with the VA BUT. I did get an L1 approved by myself & that suprised the hell out of me. OK...Question.....The RO approved it at L1,which is the lowest rate,& I got my back pay & am being payed for it & have till Oct.31 this year to NOD it & if I sent some new information pertaing to claim would all that go to BVA or would they settle it at the RO? Also, I take it I would still receive the SMC L1. Am I correct? Can the RO approve a NOD or would that with the new evidence go to the BVA? Or should I file a NOD & then send in new evidence later or vice versa Sincerly. GARY

  7. Ruby, Since they have made a decision NOD it then see if U can get a Lawyer interested or go to the BVA GARY
  8. T.....I have to say what the VA is doing is far from dumb. As I have stated on here before ....I read some where that only about 8% of Vets ever file a NOD so the VA is coming out way on the high side. Also, if one doesn't know of a site like this one, they have no idea what the ultimate goal of the VA is & my opinion ( Not very smart but I can have an Opinion HA) is that the VA does all this to frustrate the VET & they will just give up or miss a due date of which the VA has none. Or maybe just maybe the Vet will die & no one will have any idea they could still pursue the case. The best thing the US (VA) could do is stop being in so damn many wars & then there wouldn't be so many Vets messed up by the incompetance that runs amuck in the VA/& or military. I also read the Military was using Agent Orange at 600 times it's stated amount to get the result they desired As all of these stupid things that are done come to light I would say the majority of Veterans are not even aware they are eligible for an award or figure it was so ong ago it wouldn't do any good any way to apply. What the VA ought to do is send a shredder to each Vet that applies & tell him/her to put their claim in there & that is the new way claims are being handled. HA Also, I believe these Raters figure they have a GS Rating so they are not worried about being fired & the person who runs these RO's don't want to lose their job by approving to many claims.   11. Pete, Thanks for that bit of information. It seems I get every thing screwed up now days as some damnn Psycholigist said I had "Dementia" & he may be right as I can't remember a damn thing from day to day. They even have me on meds for that & per chance I do have that it may lead to Alsheimers so I have to get on the ball & do something. Know what ever is happening has given me a hell of a temper (I'm only 5'6") & is gonna get my butt whipped real good if I don't get that under control. But, I'm at home almost all the time so I guess in a way that is good for me. HA At least they wouldn't be getting no cherry as 2 Shore Patrol whipped up on me real good in 1967 & started this entire mess. I really thhink I would rather be in a private run place as I have been in a couple of VA Hospitals & not sure if I would want my Wife in one for the condition she has. But, Thank U for the information & I'll get in touch with a Social Worker at a VA Hospital (We have 2 in St.Louis) & see what I can do. Again, Thank You for all the information GARY

  15. OK...Here's the deal & Pete has given me some ideas & "Thank U Pete" On with the story. My wife is in a Rehabilation place for help with her arm But, she has been breaking to many bones here at home & my question is if my Wife & I both moved to an Assisted Living place what would the VA do? Add more money because of me or figure a way to take some? GARY
  16. Ok...Here's the deal. I now draw A & A & so does my Wife. But, at present she is in a rehabiliation home because she broke her arm & they are suppossed to help her Question....What if my Wife & I both moved into an "Assisted Living place" Any ideas on mmoney we would get or lose? Thank U GARY

To whom it may concern.......I have used this form & it helped me get my claim approved but the one thing that is the real kicker is one has to have a very good "NEXUS" The Doctor is giving his opinion that it happened in the military....Also, if U can ask the Doc if this is going to be a positive or negative report.....On my Epilepsy (With the help of a Lawyer) & 9 years (& 7 without a Lawyer) I got the Epilepsy approved & 2 Buddy Letters. I won by "Benefit of doubt" Also, the Doctors are required to fill out these forms so the ole "I can't fill them out" is either a lie or ignotance I have a Shrink who said I was 100% PTSD chronic & severe & filled out the paper will with a more likely than not but I was turned down because the Rater said "This type of (NEXUS) incident is not what causes PTSD" I had pictures of things they said never happened but was still shot down But, the Epilepsy one they were unable to deny. Also, if one should get approved this way do not stop seeing the VA Doc That's why a lot of guys/& or gals get knocked off Ptsd because once they are approved they stop going. At present I am 100% T & P & SMC L1 & I also have my Wife on SMC L1. I don't propose to be an expert on this subject but I think if U want a good opinion ask Pete 53 or Berta Sincerly GARRY

  22. Purple, A reasonable question. OK Here goes & if U have any questions please respond She is on SMC because of HEP C,periphal neurophy {Where the nerves on the front of both legs hurt constantly,sha als o has Cirossis of the Liver form the Hep C,she has diabetis, cryroglobonemia (A disease of the bone marrow & some others I have forgot} She is unable to lift her leg high enough to get in a bathtub,she has broke her legs & her nose because of all of this. She is almost unable to walk she is so shaky on her feet & has to use a cane or walker or at worst a wheel chair. This is why the Hospital sent her to the rehab place. Takes a lot of pills to help with the {She goes to a pain clinic) pain which she says "Just takes the edge off & that's all" GARY

  24. Berta This question is for my wife. She was ib the Hospital because she broke her arm at the very top (A humus bone or something) OK,,After the Hospital stay she has been sent to a Nursing Hme sort of sit up for physcial threaphy,she's right handed & broke her right arm & has trouble walking. She is to be there 3-4 weeks, Like U know I am 100% T & P & L1 & my wife is entitled to Champ 35 benefits & also is SMC L1 & my question is will Champ 35 pay the expenses on this as it is going to be quite a bit of money & she also has Medicare. Any answers greatly appreciated. I hope I gave U enough information & if not just ask. Sincerly, GARY
