  1. Thanks for passing that info along Bertha. I have been denied for Cloroachme and now have diabetes.type 2. At 70 % tdiu and P&T ,would the fight be worth a 10% and a extra 20% ? I fought those guys for so long it is nerve racking to even consider what steps one has to follow to get the VA to admit fault. Tired ole vet ,Jim Stokes
  2. I took my jury duty notice to my ptsd nurse prationers office .I told her there was trial coming up of a woman who put her baby in the dryer and killed it. I could not handled that case as I might do my own justice. She wrote a note to the judge via mail .I was excused. In my area of the country ,the judge can put a warrant out for your arrest for not showing up on the day you're suppose to.
  3. In my opinion ,unless you have very strong documentation from a VA shrink ,they most likely will send you for a c&p evaluation. That being the case if you feel you are entitled to a higher % ,if you don't request it you'll never get the raise.

  5. Bertha, we ask you on this, because Jim said you were so busy. But thanks for answering so quick. The school is called Rhodec International School of Interior Design. It was approved when I started and they were approved before I ever began. Now they have the main operation in the UK. But I only use US tutors and a US office in Quincy, Mass. for all my work. The VA school laison told me that it didn't matter, that they had a small office here and all the diplomas come out of the UK. I was not the only student this happened to. She said there is too much technical school and not enough of basic study, (english, math, etc.) I ask her how do they approve technical school if that is the case, for they only train on the technical part of a particular job. This is a very extensive course in Interior Design. Drafting, Materials, History, and on and on. Everything there is to do with a houses inside and out. The school is working with an attorney trying to get there certification back, but you know with the VA how long that could take. This went into affect as of Oct. 5, 2005, and the school did not recieve the letter until just recently and they immediately put the attorney on it. The school got a letter back from the VA yesterday. I do not know what it said, but they are fighting. Shouldn't I have been eligble for the rest of my benefits, maybe grandfathered in as they say? The whole thing just seem unfair to me. I still have a lot of work to do and believe me this course, you have to buy a lot of equipment to get through it. I would appreciate any info you can give me.   6. This is very offbase but is it possible to call a cue on the VA for educational denial? Point in question, My wife has been attending a distant learning school from Quincy ,Mass. for nearly 3 years. The Buffalo ,N.Y. VARO is in charge of cetifacations . They have all of a suden dropped this school from their rolls as no longer being qualified because they are home based in London, England. Does the VA have the right to do this after she has been attending for 3 yrs. and only has another year to finish ? She is still entiled to another year of Ch. 35 benfits,
  7. Thanks Bertha , I saw his dd214 and a letter from the dept. of the army ( I think it was ) that listed his medals that wasn't on his orginal 214 . He is suppose to come over agin this week,I will read him your messeage here as well as the sites you listed on eariler post on 101 st AB. I read some of the post on that site but, I was never " in country" so
  8. Thank 11th Armored. He told me yesterday that he was qualified for CIB but was not on his dd214 . The State Service office file a sf 160 for a updated dd215 but they only added the Air Medal and Army commendation. He was in country from 13 June 1969-Nov 19 1969. His parents got him out on a hardship ,but he still had to make reserve meetings. What are the qualifications for cib he said he was in several fire fights and mortal attacks. Probally had a lazy co. clerk.
  9. Thanks both of you for your help. The man I am helping does not even know how to turn on a computer. He spent all day at my house yesterday . We were trying to write his notice of disagreement and get it post marked before the deadline today. He just got the turn down day before yesterday, but they said his time limit will run out 1 April,2006 . The New Orleans VARO has been in a trauma since the storm Katrina . They are not back in their building on Loyola Ave. yet. Bertha ,my wife and I worked until 10:30 pm last night trying to find the guys in his unit. He said Carlie co. so I will go with that. We have a list of names and addy's of men in his squad from 1969 . We have been doing a people search bot of course in 37 years people tend to move or die out. I will check out what you girls have recommended , although I have some 101st bookmarked already. I have to say i am a poor choice for help, but this person doesn't have any other resource .   10. Trying to help my neighbor find vets of 101st airborne 1-501 charlie co. 1969. Needing after action reports . They spent most of their time in the bush at Black Virgin Mountain . He has a 11B10 mos ,and the air medal along with all the other stuff everyone back then got. The VA has turned him down due to lack of information in his stressor. Any idea's ?
  11. Thanks Vicki ,My daughter did a search on the net for me and located this man. I talked to him this morning and he said his wife insisted that he go talk to a veterans service officer at the Biloxi VA yesterday. They assured him his wife and child would be taken care of in his absence. He said he was already on the Agent Orange rester's. My mind is some what settled as I assured him if there was ever anything I could do just ask. I should add that although folks my age know that dying is a part of living ,we need to make sure our loved ones are taken care of after we leave.
  12. At the DAV office I'm affiliated with your were assigned by your last Initial to a service officer . The DAV has the best trained service officers ,but there are lazy ones in every situations . They are by far the most overworked. Just remember it is YOUR case to win or loose . YOU have to do the leg work ,by that i mean you have to get the right information to win YOUR claim. No service officer can do it without your input . That is why you have to educate your self right here at HADIT by reading and asking questions so you can talk intelligent to your service officer and file your own paper work with a copy to your service officer. As far as call backs on telephone ,if they returned all the calls they receive they would be on the phone constantly. They have to read every decision made by VA that they have power of attorney over, even if it means their weekend . I have met several DAVSO and have mucho respect for their work.BTW one day a week is set aside for just new training of constant new rules that are changing everyday. My two cents
  13. I ran into a fellow ptsd counseling buddy that I had group therapy with a couple years ago. We had both been going to the N.O. VA before Katrina,but now we are both going to Biloxi VA. I didn't even recognize him as he has lung cancer from A.O. Although he said he was 100% ptsd, he has less than a year to live from the cancer. I asked had he filed a claim for that situation he said no" I'm already 100%". His wife was with him and I told him he should file a claim today for his wife protection for DIC . We were standing in the hall way talking so it was a brief encounter . I am now at home with a guilty conscience for not getting his phone number or even his first name to do a telephone search to ensure he files a claim even though he is already 100% at least it would be on his record . His wife piped in I don't know what I am going to do should he pass . He even used to talk about his little girl that I asked about of which he said she is now 6 years old. Folks my heart is so heavy about this situation I have tears streaming down as I type this . I am concerned about his wife an child if he passes . If the N.O. VA was still open I could get his information, but it may be years before it's opened again. I was told by a friend that 300 records was lost in the flood that were waiting for C&P's .Makes you wonder how many of those people will die before the VA gets around to them again, as all C&P must be accompanied by your VARO service records . Thanks for letting me feel my pain here.

  15. Bill glad to hear from you buddy. I am sorry about your mess up with the S.S. I would make an appointment first with the local S.S. office and speak to some one face to face explaining exactly what you have expressed here. I would also make a beeline for the local federal representative or federal senators office and tell them you complete story as stated above. Do you know which stage of denial your case is in? The first 2 an attorney is not usually needed, but by the 3rd. your case must go before an administrative law judge. Sounds to me as if the S.S, system is jacking you around ,hoping you will give up and go away. I hope that only makes you stronger in your fight. That is YOUR money they are holding not some clerk's behind a desk. Bill I am not an expert on this but I did have to fight them to the court system. I assure you at that point you will need a lawyer as they can drill you pretty good with their occupational expert. Good luck and if I can be of future assistance don't hesitate to ask. Jim Stokes
