  1. I have already gone the voc rehab route and they gave me a letter stating that I was not in medical condition to complete the program. I am going to get another opinion on the 10th, plus my VA doc wrote a letter explaining my unemployability from her previous diagnosis of MDD and PTSD with psycosis she states that I am unemployable and I am not to be around people. I'll scan both copies for posting once I find my Voc Rehab letter.
  2. I just don't know what the next steps are... do I file another NOD or send in the Form 9 or is there a CUE and what form goes with which? I have checked all over this area and have not found a good VSO so all I am using is the state of Virginia's VSO and they are terrible to say the least. I wish to fight this myself all I need is education from the elders and I'll do the rest.

  4. Did the VA acknowledge this letter? Not yet she wrote the letter on March 3rd after she found out I was denied. Did she give a full medical rationale for her unemployability statement? She refered to her extensive medical evaluation stated the gaf of 44 and stated that she stands by her claim. The problem I have is a rogue psychiatrist that states that I am narcicistic with dsthymia (his evaluation was covieniently posted as part of the reason of denial)( he evaluated me in under 10 minutes on an emergency visit,and thats all the time he spent with me until my full appointment) So my psycologint wrote that I am unemployable. I am putting together my scanner so I can show my SOC and Increase letter. Are you claiming the PTSD as secondary to the MDD? Yes I am, I thought by putting GAD instead of PTSD it would be more acceptable as this is non combat PTSD I hope I didn't screw up there. I also placed a second claim in for PTSD 3 years ago and that was denied as well. And my one year decision on that one is up on March 9th. I guess what I am asking is wording on the VA Form 9 and should I send in the form with statements like duty to assist and benefit of doubt, as I had 3 doctors stating I have PTSD and the one doctor they decided to accept was the 10 minute evaluation by the one doctor. Or do I wait and send the new letter (by my VA doctor)with the evaluation I am getting on my own by another outside doctor.
  5. I already had my c&p in october and so the va said that the c&p doc didn't state whether I could work or not so unemployability was denied. I also know that having mdd and ptsd is not allowed because of similar conditions but could the va rate me with ptsd if its higher. this has taken around 4-5 yrs and I am tired fighting.
  6. I need some help with my form 9 but I don't know where or what to write. I have had 50% for migraines and just received 30% for MDD, in my SOC it states that I have PTSD but the IMO didn't state whether I was able to work or not so my TDIU was denied. The only thing I have done was to get a letter from my Phd doc and she wrote that i was unemployable due to a gaf of 44 and that I had MDD and PTSD with psycosis. I also scheduled an another IMO for march the 10th but if I don't need it I wouldnt mind not going. Any help would be appreciated as I am clueless on what to do. I can scan my soc and my increase letter but its alot of pages. Thank you in advance.~~~Fosk

I complained about not being able to see a thing on the 800 number e-benifits had as I had already signed up through myhealthevet for second level, how excited I was to find out e-benifits said it was the RO fault for not adding the information so I sent an IRIS and they said it was e-benifits fault.........I was sooooooo mad that I put my comlaint on the blog they just introduced for three days and finally someone answered my complaint and told me to wait a few days and they will make corrections for me and guess what....someone actually put my e-benefits page up finally showing all my information, it took a few months but, what gets me is that there are people with some sort of authority manning the blog posts and yes they got me straight.
  8. Unless the VA provides someone full time to answer these blogs I don't see this going anywhere. If you notice there are many people writing and very little answers.
  9. With the day so blustery around here now that Ida has come to visit, I thought to take the time and wish every veteran and family a happy holiday and well wishes for a speedy claims process. :)

  12. Maybe a 10 million vet march on a holiday.... Veterans day, Memorial day or the 4th of July. In this day and age the national media would be all ears if the generals sent tanks,as well as an angered population. I would like to meet all of you there, instead of us grumbelly'ing that it wouldn't work.... even if I had to stand alone, but, I'd rather be with my brothers and sisters. Just a thought for now!   13. Called my Congressional office and asked them to stop with the inquisition, the man on the other end asked why? I explained that many others have gone this way and all it did was delay claims processing and that it is pulled out of a stack and put last again. He promised me he will send a liason to check and see where it is in processing and if they can expidite my claim, and he said he will call me back by Tuesday the 10th. I told him I have a ssa hearing on the 24th and whatever decision is made I may need the information for an alltogether different claim.

  15. I wrote Santa also, and he said he only deals with toys not Veterans claims. Although if Santa was working a claim it just might get done before Christmas. As far as writing the White House if all the vets on this website wrote in and took the time to write the President in general (counting on the thousands of members) instead of writing negative "it'll never work" blogs, then this will get the wheels turning once again. I am not taking it personally, just don't like to quit and I am not articulate enough to look up case law and write as well as some of you do. Please send or write the White House in lieu of gifts by Santa....lol. http://www.whitehouse.gov/contact
  16. Just for that extra boost to get it out of ratings I wrote to the White House, I tried a congressional inquire but its still taking forever even with a hardship. Hey I have nothing to lose and all to gain.
  17. I was told today that I should not call anymore to ask about where my claim is at because it is in ratings right now. The operator told me " we can no longer discuss or to let you know of any decisions that are made to your claim. And, to stop calling and just wait for my letter in the mail." I was so mad that I called back only to find out it's true. The memo went out Friday to all the operators.
  18. I too have been waiting since March of 08 and have called weekly as my claim is in Roanoke. I have recently found out that the VA shipped my claim to West Virginia but, I was told also by a rep that they will not ship one claim at a time so my claim is in a box waiting to get filled with a backlog of claims of other veterans claims folders. Again take it for what its worth, but, at the VA claims processing the left hand doesn't know what the right hand is doing. Beleive me I wished I had an answer months ago....It has been in and out of ratings since July (ready to rate) Even asking a congressman to help is like adding gas to a fire, their hands are tied and can't get the VA to move any faster. I even was written to by an IRIS manager and told my hardship was very real and that was on Dec. 3rd. Just a suggestion....don't let it consume you and be patient because waiting a year or more is the norm. I wish you well and good luck to you.
  19. I understand ... maybe some butt kissing is in need, but, I was trying the squeeky wheel thang...lol. I just wanted to get it in under a year because in my claim I have a cue mixed in to a new claim. ... I didn't mix them they did. I was also hoping I didn't have to file an NOD before decision time. After several phone calls I made and letters that you sent, you now have all the information that you have asked for ...can you be honest with me and let me know where my claim is at I also know it's been only 4 months and am just curious. Mr Fosk Mr. Fosk: We received your claim on 03/27/08. Right now, claims take approximately 9-12 months to process. Your claim is currently with our adjudication department, and we have had your claim for 4 months. This means that it will take between another 5-8 months before your claim is completed. You will receive written correspondence at your address when the claim is completed.

  22. I called to check on my status and the lady told me it was in a very good spot and that it was awaiting a signature. I asked for my increase to be back dated to 1988 to 9/07 as I had not received a response from VA on my initial increase. I also put in for PTSD, cardio disease and degenerative disk disease. There is something troubling though and that is... they told me they received a letter from the Virginia parole board, and, I have never been in trouble with the law, what could that mean? I called as many people as I could from my local police dept. to the parole board itself and nobody has a record of my name in the system. Any input would be appreciated.

I went to the VA dental clinic in Hampton and they fixed a broken tooth and did a root canal, just yesterday this tooth cracked in half, although I had no pain due to the root canal I was denied dental care on the tooth that they originally fixed and this happened in under a month. I asked them to quote me the regulation and all I received was a quote of emergency services only. Does anybody have anything to the contrary?

I never knew I had ptsd until december of last year when I took the written test then the next test that had the 650 questions, I just thought I was an angry depressed individual because nobody took the time to give me any testing, and I never knew to ask. I was always diagnosed as having chronic depression caused by the migraines but, come to find out my anger etc... was caused by the ptsd so the va thinktank thinks. I have no clue myself, I am on more medications since I quit smoking and drinking than I can shake a stick at....lol. But, I did have depression as a secondary to migraines and it was denied even though they (ro) overlooked my treatment in the mental health department while in service. So I just may have to give an NOD and the ptsd as a new claim. ummmmmm maybe? I also now have a claim with social security and that has taken a while.... I was turned down the first time with them as well. I just don't get how they overlook so much evidence, but, this time I condensed it highlighted everything important to my case and file numbered the top of every page. Even though I didn't join until yesterday I have been reading your website for months.... and it is the best website for veterans claims I have ever read. I have even passed your website on to veterans in my pct groups as well. From what I read the elders are awsome as well as everyone who has joined this site.
