  2. Buddy statements are great as long as their not an opinion. Meaning the letter is based on FACTUAL WITNESSED EVENTS.

  4. You won't get backpay from 10 years ago just to let you know. They are just figuring your monthly pay. You will get backpay from when you applied minus six months. Frank
  5. There are those that do apply for illigitimate reason such as not being able to find a job or they are just lazy. The SS admin has to have rules to alleviate these people so that people like us that do qualify get it. In times like these everybody and their brother are applying for SS and it affects the rest of us that qualify. That's the way I see it anyway. Frank
  6. Also, there is NO offset if you receive both SSDI and VA at same time even if you're 100% UI with the VA. You don't need to be concerned with going to the VA and claiming 100%. Frank
  7. I was awarded VA disability pension in 2004. A year later I was awarded 30% S/C for my disability. The issue I have here is in order to get VA disability Pension you have to be Permanent and Total. Why did the VA S/C me at 30% then instead of giving me 100% when they had already granted me my disability pension??? Doesn't make sense to me. Frank
  8. My last exam was kind of like how your was. When I met the examiner he gave me a weird look and walked behind me all the way to the Exam room. I could feel his eyes peircing me watching every move. The whole exam I felt like I was on pins and needles. I got a copy of the exam and he made three critical errors in my treatment history. He even based his opinion on the errors. He said that I had treatment for bipolar prior to service which was incorrect. I never ever had treatment or even counseling for that matter for any mental disorder prior to service. Grave Grave mistake on his part and then he opined that my illness didn't have its onset in service because of that. I actually thought I had someone elses exam. After exhausting letters outlining the errors I finally have another exam later this month. Frank
  9. I have an exam for increase for my S/C mental illness later this month. My appointment notice says it's with a Dr. Bowlus and the exam is at the San Diego Regional Office. Has anyone here had any exams with him and is he a fair examiner? Thanks for any help, Frank
  10. I have a C&P exam on the 30th. I hope mine goes as smoothly as yours. Congrats on the increase. You should appeal the 30% if you feel it should be 40%. thanks, Frank
  11. It's the other way around. The Senior Officer can change the decision after a rater has rated your claim. It happened to me. Frank
  12. I had surgury on my face to get a basal cell carcinoma removed. It would have cost me $3200 but the VA paid in full and it wasn't S/C. I guess the VA does pay for certain things even though they aren't S/C. I was on VocRehab though so maybe that's why it was covered. Not sure but was happy to get it done and over with. Frank

  14. I AGREE! Contract Physicians are contracted to benefit the VA, not the Veteran. If a contract Physician is giving positive evals left and right the VA will stop using them. Frank
  15. Thanks BroncoVet, I have a C&P exam june 30th for increase. Should I submit my TDUI claim now or after my C&P exam. I'm afraid I might delay the C&P exam if I file for TDUI now. I have waited a long time for this exam and finally it's almost here. I don't want to jeapordize delaying it. Also, when I file for TDUI is there a special form I fill out and send in? Should I go ahead and send in my SSDI award with it? Here are the facts of my claim: I was terminated from my job last May while I was in a hypomanic episode and made a bad judgement call. I applied for SSDI and was awarded it in August 09 for the same conditions I'm service connected for. I haven't been able to work since May 09 due to ongoing symptoms of depression, anxiety, insomnia, chronic diarrhea, and fatigue. All of this is in my medical file going back to December 2007. I guess what I will do is go through this exam on June 30 then file for TDUI unless I get different advice. Thanks, Frank
  16. It looks as though you already are rated 100% P&T or is it TDUI? You already have the "golden egg." Congrats on that Frank
  17. I am currently 40% but I have applied for an increase in rating. My exam has been scheduled and I have substantial medical evidence and I'm getting SSDI for the same conditions. How much weight does the VA give SSDI if it's for the same conditions? Also, I pretty much know they will increase my rating but is it common to get UI at the same time they increase the rating?   18. Do you have family history of SN? If not I don't see how they could say it's hereditary. Just get an IMO from a specialist or whoever you see connecting your PN to your truck incident. It looks like it's pretty clear according to your medical notes you presented. You just need that IMO. Frank
  19. I agree with Larry. I would go anyway just to make sure. The worst thing that could happen is the VA saying you missed your C&P and back to square one you go. Frank
  20. It doesn't hurt to just leave the reasonable doubt in your NOD. As long as your SSDI award is for the same disability send it in with your NOD. If it's for something different don't send it in. That will hurt you since they can say something else is causing your unemployability. Frank
  21. Yep, sure was and now swooooooosh, he's gone. Just like that. Thankfully I learned so much from him I can manage my claim now effectively. He got two grants for me. I'm at 40% with a C&P exam later this month for increase. Frank

  23. I called in last week to check up on my claim and was told my DAV rep was no longer employed. I asked why and was told that they couldn't comment on that. I went in and talked to another rep and was told he was fired. He didn't say why. Has anyone had that happen to them? He has been my rep for the past 4 years. Frank
