  1. It is legit it is down for maintenace until 7:30pm.
  2. I recieved a letter about this and registered but there was not much info there I will log on to see whats up and report.

Things are slow but they are moving I got my C&P for Psuedo and the examiner stated "This Veteran has documentation of problems in the service with pseudofolliculitis barbae and had a shaving profile the majority of his military career. It is at least as likely as not that the pseudofolliculitis barbae began with the chronic pseudofolliculitis barbae treated in military service". I think I am in good shape with this one.
  4. §3.326 Examinations. For purposes of this section, the term examination includes periods of hospital observation when required by VA. (a) Where there is a claim for disability compensation or pension but medical evidence accompanying the claim is not adequate for rating purposes, a Department of Veterans Affairs examination will be authorized. This paragraph applies to original and reopened claims as well as claims for increase submitted by a veteran, surviving spouse, parent, or child. Individuals for whom an examination has been scheduled are required to report for the examination. (:) Provided that it is otherwise adequate for rating purposes, any hospital report, or any examination report, from any government or private institution may be accepted for rating a claim without further examination. However, monetary benefits to a former prisoner of war will not be denied unless the claimant has been offered a complete physical examination conducted at a Department of Veterans Affairs hospital or outpatient clinic.   5. I think it is good for the vet. I am no expert but it sounds like the examiner did not do his job and they have called him/her out. They now need to provide background for the decision they made.
  6. I am a little confused 06/02/10 has not arrived yet. If your claim was closed (meaning no appeal within 1 year of denial) and you submitted eveidence to reopen it. The effective date of the claim is the date it was reopened.
  7. I order when my meds arrive and in about 90 days the next supply appear in the mail box .

Doc stated as a result of surgerys to remove cancer vet has constant pain in leg is unable to do things he once could he has anxiety that the cancer will reoccur avoids sunlight fears bug bites and injury do to inability to fight off infection his lack of activity has brought on excessive weight gain. There is a lot more along those lines but that is the jist of it.
  9. Mac, I am have some of the same issues I leave the house only for work up half of the night no motivation. I have a bum leg not able to do half the things I used to I am in pain and constantly worried about a relapse. Good luck I hope it all works out.
  10. Update on this one saw my PCP his assesment was Neuropathy of the upper thigh and of the lower leg as a result of surgery to remove melanoma and to remove positive lymph nodes. He also perscribed a medicine for the pain and schedule the nerve conduction test. As a bonus he DX' ed the edema in the leg and perscribed medicine for it also. Submitted this info to the RO.

  12. No sir, if you were drilling or performing AT and the illness occured then you would be able to. You are even covered during your commute to and from if actively drilling.
  13. Bergie, I have to agree with the others something sounds fishy I have 4 DD-214s 1 active and 3 from reserves they list all my awards. I also have a reserve retirement order when i retired in 2007 that is what you get from the reserves.
  14. I had MH exam Monday it seemed positive it was to support my depression/anxiety claim secondary to my cancer. I saw physcologist she was nice she did not tell me a Dx however she said part of my issues are pain as a result of the surgeries on my leg, she enrolled me in the pain management program and scheduled me to meet physchitrist to discuss possible meds. I was to enroll in group program as well but because I work out of town she is going to meet with me every 4 to 6 weeks. My question is although; I do not have notes yet will pick them up in a week when I am at VAMC I would like the rater to have them. Will they automatically see them in the computer or do I need to contact the RO and let them know these notes exist? I have had fairly good luck with decisions when I have had a C&P I have got a decision at the end of the month each time and both were favorable and I had an exam today. So based on my history I think there my be something on the horizon. If i need to contact the RO what would be the best route. By the way I have gotten little help from the DAV been going it alone since the denial batting a thousand since then.

  18. Both of us are learning a little venting on my part (tension breaker had to be done) but I have a better understanding of how you guys are thinking I hope our discussion helps someone.

James, I was diagnosed with edema of the leg with hyperpimentation distal to the wide local resection fitted for compression stocking edema is a result of 15 lymph nodes being removed from groin by my docs and VA examiner. I not trying to confront you just trying to show how some are not doing right by us. it is a residual of my SC'ed melanoma.

James, Chemo is Chemo thats the problem i am having if it does not say exactly what the reg says it is denied systemic thearpy is a fancy word for chemo, stasis pigmentation and hyperpigmentation is the same thing but if it does not say stasis pigmentation it is denied or ignored. In the case of my scar the examiner stated a deep hyperpigmented scar painful to the touch measuring 9 x 12 x 1.5 cm but because the examiner did not calculate the area for the rater they rated it under 7804 instead of 7801. I think some rater perfer the easy way out.

James, Edema is a illness and is ratable see below i met all the qualifications 1 year of chemo as i stated surgery to remove cancer that spread beyond the local site they missed the scars the cancer and edema as you can see below but you not knowing about edema I have a lettle less confidence in those raters handling my claim 7121 Post-phlebitic syndrome of any etiology: With the following findings attributed to venous disease: Massive board-like edema with constant pain at rest 100 Persistent edema or subcutaneous induration, stasis pigmentation or eczema, and persistent ulceration 60 Persistent edema and stasis pigmentation or eczema, with or without intermittent ulceration 40 Persistent edema, incompletely relieved by elevation of extremity, with or without beginning stasis pigmentation or eczema 20 Intermittent edema of extremity or aching and fatigue in leg after prolonged standing or walking, with symptoms relieved by elevation of extremity or compression hosiery 10 Asymptomatic palpable or visible varicose veins 0
  22. James, I was not treated a VAMC I was diagnosed with milagnant melanoma stage 3. I filed Dec 5, 2007 which is my effective date 7 months after I completed chemo my scans still showed signs of active disease as late as April 2008 when I finally got a C&P exam. Because I had not had any treatment in the past year I was lowballed at 0% and after reconsideration lowballed a 10% despite the fact that I have a 108 sq. cm scar to remove the melanoma that went all the way to the bone and hurts like you know what. Edema of the leg that was ignored although in my denial letter they asked if I would like to file a claim for it and when I asked for it in reconsideration they ignored it although it was diagnosed by my docs diagnosed by the C&P examiner but ignored by the rater. James from reading your post I think you do what is right but like so many here at hadit it appears the raters we are dealing with are not as serious about there job as you are.
