  1. thank you all for the congrats. the big wait was after travel board in mar. 2011. if youre headed to bva, a little more evidence wont hurt, but a remand aint the worst thing that can happen to ya. and john, i think my lawyer was worth the 20%. my injuries were from the early 70's. it really didnt help me to wait 30 years to file, lucky for me the evidence was still out there under a layer of dust in st louis. thank you all, and thank the bva! mark

  3. im 10% sc for tbi with headaches. took it to bva with my own ime, complete with neuro test. my ime says moderate symptoms memory probs.,headaches. they didnt grant the increase, but the remand says rate the tbi under 8045. does it look like a chance at rating increase under the newer tbi regs? i believe the regs were changed in 08-09? for all you guys headed to bva, i m convinced that an ime is worth every cent !
  4. three years after filing and getting a rating of 50% which is pretty good for 35 year old injuries i finally got to bva travel board. the vlj was a real decent guy. he granted my motion to expedite, financial hardship, seemed like a pretty good sign. then three mos. and three weeks later i got the decision 1 grant ,1 den. 7 remands. i am very grateful for this small victory, bilateral elbow arthritis is now SC. i feel pretty fortunate to get this SC on a thirty some year old personal assault claim. as some know, pers. assault can be tricky to connect the dots. the people here have been a real asset. so to you old vets, it can be done.
  5. ptsd 30 plus 3 10's =50% from 1974 personal assault injuries, 2 broke fingers, brk hand=10% head inj. 10% facial scar 10% ptsd 30%. these injuries are from 74, i'm still shocked the records werent lost! i knew a 34 year old injury was a long shot, but it won the first time through. im shocked and grateful. thank you hadit members, vbm, j roche. testvet, halos, pete53
  6. continuity of treatment, symptomologyi went in for cp nov. 21. i was relieved to find out my smr contained information on an assault against me while in korea in 1974. it showed i suffered 3in. lac. to forehead, broken finger, br. bone in hand, injured wrist. there were more injuries but i didnt see it on the cp docs paperwork. the va doc said he was going to service connect me for my hand, but it wouldnt be much. i mentioned to him that va also requested exam on head inj. knee inj. and both elbows, he looked at his papers and sent me back for more xrays. i have seen private docs over the years, but sometimes there were long periods of time in between visits. i have a recent imo to support my case. since this assault was commited by 2 guys armed with bats/clubs and they continued the beating after i was on the ground and stomped me til i was unconscious, someone said i should get a psych. evaluation for ptsd. i waited long to file this claim, will that hurt my case. any advice appreciated.

  8. I'm helping my dad with his claim for benefits. He served from 1949 to 1951. He filed a claimed for injuries he received while on active duty and requested a CP exam. Two months later he was denied without a CP exam and was told the record was void of his issues. I am wondering if his records were destroyed in the fire of '73'? Would the VA say the records are void if they were destroyed in the fire? Should he file an NOD next? I am grateful for any help.
