  1. My husband worked as a civilian employee at El Toro for about 10 years right before they closed (Department of Defense). My husband also has passed away and was receving VA compensation (100%) disabled service connection for Cancer of the Larynx. I am now receiving DIC benefits. Are civilians filing claims for El Toro? Thank You
  2. Thanks for the reply but nope, we never put in a claim before January 2008. I had just been wondering if there was something out there for Original Diagnosis of Sept. 2001. Happy Memorial Day to all our Veterans!
  3. Berta, This question doesn't come under Nehmer (I don't think).....Is there any benefit out there that can give retro benefits to surviving spounse for Original diagnosis of Cancer of Larynx? What I mean is that my husband was first diagnosed with Cancer of Larynx with cancer surger In September 2001. We did not file a claim until January 2008. We did not know of AO, claims, etc..,until January 2008. I was just wondering. Don't think so but never hurts to ask. My husband only collected benefits for five months then passed away last year. Thank you for your post.

  5. With so many different laws and rules I thought I would check to see whether my daughter would possibly be eligible for Educational Benefits. She is 30 years old now. At the time of my husband's effective claim date (January 28, 2008) Sarah was 28 years old (birthday 01/1980). My husband passed away last year (April 14, 2009). I am now receiving DIC benefits. She is a single mother of 1 1/2 year old, unemployed, living with me. She is currently attending college part time (for the first time). Having of couse financial difficulties Does anyone know if she could possibly be eligible for my husband's benefits? There are all kinds of exceptions (I've read and don't understand) about ages, 26, and 31. Thought I would ask here to see if she might be eligible under some law that I don't know about. Thank You for any assistance you might give.
  6. Thanks Philip for clearing that up. I might not do anything about this just yet. I'm kinda caught in between my thoughts at the moment. I'm having a hard time because he took advantage of the VA and now he is taking advantage of his parents house and monies. But that is another matter. I will do what my husband would have done and that is sit back and let the system catch up with him.

  8. Pigdriver, Yes, this would be considered a “Straw Purchase” because Veteran never lived in the home. His son never “assumed” the loan and is still living in the home and has not paid the mortgage for about 6 months now. He is moving out in January and has purchased another home but in someone else’s name (because under his name too many people are after him) for other huge debts. I think I will leave this alone hoping that the VA and or the FBI will eventually catch up with him.
  9. Ok everyone, I've read all your replies. And your right I didn't explain enough. I'm not trying to get a real Veteran in trouble that's for sure. So I will try and explain this the best I can. It's a distant relative. He is and always has been a coniver. I will use John as his name. John lived in one state (8 years ago), John's father (let's say Dave) is the veteran and lived in another state. John bought the house and used Dave's name on all the paperwork and Dave signed everything acquiring the VA loan. Dave (the veteran) has NEVER lived in this house. Dave is now deceased last year. John is now defaulting on the mortgage and waiting to get kicked out. John is in the process of buying another home under a friend's name. I personally have seen John in action. He has minipulated the VA system this one time. I have seen him personally get away with all kinds of these kinds of situations. Buying cars in other names, other homes in different name and he has done this in three different states. The main reason he was able to acquire his father's VA mortgage is because they have the same name. This was fairly easy to accomplish. Your all probably right and I SHOULD MIND my own business. It's just that everyone fights for Veteran's and I don't like that some people take advantage. I know John and he takes whatever he can get and usually gets away with it. Thanks again for your replies.
  10. I know someone who is using his father's name (who is a veteran) for a Veteran's Home Mortgage...Isn't this illegal? I would like to turn him in. Annonymously of course...What do you think??? Plus the veteran died last year!!
  11. To akawidow....I filed my DIC claim in May and received good news that it was approved the end of June!!!! Ya hoo...I posted my victory here on Hadit back when I received. My Dic claim was in Southern California (San Diego Office). I believe my claim went through because of the statements made clearly by doctor on my husband's death certificate. I'm sure this was the case. If you need any help please let me know! cj

  14. Everyone.....I told you Wednesday that American Legion called and told me my DIC claim filed May 11, 2009 was approved! Low and behold I received TWO envelopes from VA YESTERDAY! All my husband acrued CUE benefit, burial, month of death and DIC are awarded. Can't believe in RECORD TIME! I should be getting checks next week. Filed On May 11th and its only June 28th. I guess the hard work I did making sure my husband's death certificate read correctly really helped in making their decision on service connected death. Thanks again Hadit for all your suggestions!
  15. Hello Everyone, Just had to tell you that I received a phone call this morning from my rep at American Legion. She told me that my DIC claim (effective April 14, 2009) was AWARDED!!!! I should be getting my formal letter 10 to 15 days! She said that DIC, DEA, Acrued Benefits, burial, etc., have been awarded. They are now figuring out the figures. I filed for DIC (with all of your help) on May 11th. Thank you again for all your suggestions and input. I must have done something right!
  16. I inquired about my DIC claim today. They told me "still Pending - development at rating board - went to the board June 9, 2009... My question: If my claim is at the "Rating Board" can they still ask me for more information before deciding claim? Thank You.... B)

  19. Bryce, I believe that your phone call is NOT a date for your claim. You must fill out a claim form and sign it. My husband had his larynx cancer surgery in September 2001. We DIDN'T Know about Agent Orange Presumption list until BY ACCIDENT in January of 2008!!! Two days after I found out I went and filed a claim on January 28, 2008. They WOULD not go back to when my husband had his larynx surgery to 2001. Phone call is not sufficient for a file date. I'm sure people here on HADIT can confirm this. We missed out on almost seven years of compensation. We filed in January of 2008 and received our first check in November 2008. My husband collected for five months then passed away a month ago. In fact the VSO I talked with on the phone sent me the claim form and I got to read over, fill out what I could then went in and he helped me with the rest. I already had about 200 pages of medical records, etc., to go along with our claim. I didn't know about HADIT until AFTER we received our first compensation check. I went about the claim pretty much by myself.
  20. Bryce....you will not be able to tell how much of your voice you will be loosing until well after all your radiation treatments. My husband had surgery and radiation back in September 2001. He lived with the after effects of radiation 8 years after surgery. It sounds like your case is not as severe as my husband's. This is a good thing for you. He had four trachs in 8 years and two years ago it was permenent. Didn't loose voice until 6 years after surgery. There is no way to tell how much of your voice you will possibly loose. Your claim though is not retroactive from your first diagnosis. It is not effective until you put in claim and ask for separate rating for cancer of the larynx. That's why I was asking why are you waiting until June 2nd to get this going? Your VASO will help file the rating. Hope you have all your records for the cancer of the larynx and your radiation treatments. I wouldn't worry about getting any of your rating reduced. Get your claim going first....I wish you luck and if I can help any more please let me know. Cindy
  21. Bryce...did you have surgery for the larynx? Did you have radiation? Do you have a tracheotomy? Have you lost any of your voive? These symptoms, etc., make a difference in the percentage give for the cancer...even if the cancer was taken out and hasn't come back. Let me know...Cindy`
  22. Bryce...did you serve in Vietnam? My husband just passed away 3 weeks ago of other cancers but he did have cancer of the larynx 8 years ago but we didn't know about Agent Orange Compensation until Jan of 2008. It took 11 months to get 1st check!! Why are you waiting until June? You should file right away....I have more help for you if your a Vietnam Vet....Let me know..
