  1. grent, I agree with carlie. I also have a claim at the BVA since April 2010, but I got a DOCKET number in a short time after they received the claim. If you have a Veterans Service Officer (VSO) or State Rep, call them. If not, you can call the Ombudsman in Washington at 202-632-4623 from 9:00 to 4:30 Mon thru Fri. Their web site is: www.vba.va.gov/index.asp

    On that page, left side, click on "customer service" for more info on bva claims. I hope this will help you. Thanks for your service. Lugnut AKA Buddy

    would like to know can a case be called back by the varo and then paid while waiting to go to the BVA????

    i filed my form within the 60 period and it was accepted> then i got worried i think i just joined hadit at that time and jim strickland got me a lawyer.

    but i don't bother calling they the lawyers dont like you bothering them besides their never in their offices always gone .

    i dont know what to do

    im getting worried its a ton of retro payment

    well i guess ill do like you say and sit tight

  3. I WOULD LIKE TO KNOW IF A FILE THATS WAITING FOR A BVA HEARING

    CAN THE LOCAL VA THE LOCAL VARO CHANGE THEIR MIND AND PAY THE CLAIM FOR THE RETRO

    OR

    ONCE YOUR HEADED TO THE BVA YOUR NOT COMING BACK TO THE VARO UNTIL AFTER THE BVA??

    THOUGHT I HEARD OR SAW A POST HERE THAT A LOCAL VARO RE CALLED THE FILE FROM THE BVA

    AND PAID THE CLAIM

    ANY TRUTH TO THAT??

  5. IN OTHER WORDS WHAT IM TRYING TO SAY IS THE LOCAL VARO RE CALLS THE BVA CASE BEFORE THEIR IS A BVA HEARING AND SUPPOSIDLY RE DACTS RE CALLS THE CASE AND JUST PAYS THE CLAIM THATS MY QUESTION TO THE FORUM.

    SORRY FOR THE LONG QUESTION I HAVE BEEN SICK FOR LONG TIME AND TAKE A BUNCH OF DIFFERENT MEDS I LIKE THIS WEB SITE BECAUSE IT GIVES ME HOPE!!!

    CAN AN "EFFECTIVE DATE" CLAIM PENDING BEFORE THE BVA BE RE - DACTED BY THE BVA AND SENT BACK TO THE LOCAL VARO AND THEN BE PAID THE RETRO??

    HAS ANY VETERAN EVER HEARD OF THIS ACTION OR HAD THIS HAPPEN TO THEM?

    IT'S CALLED RE DACTING A PENDING BVA CLAIM? JUST CURIOUS IF THIS IS TRUE OR JUST HERE SAY?

  7. I have a question for the forum

    i went to one of these VA satelite health stations and during my interview i asked about homebound and a and a

    they told me a and a and home bound are both based on income . I would not get either because im a 100% P and T

    Not very nice people at all!!

    They told me also VA does not pay for out patient exams at private hospitals. Like a cardio exam or rectal exams colon examination

    i said well what about fee basis? they said no!

    any thoughts here.

  8. if a veteran is 100% P and T scheduler

    and then on top of that is rated for loss of use of one hand one eye, has ed and spinal both lumbar and cervical injuries

    does the VA then have to consider SMC O/P or must the veteran request SMC O/P

    would that veteran be eligible for O and P

    if a veteran is 100% p and t scheduler and he is gettting 2, 600 per month and is then awarded A and A how much more would his monthly benefit increase

    if a veteran is 100% p and t scheduler and he is getting 2, 600 per month and is then awarded home bound rate how much more would his monthly benefit increase

  11. I don't agree I think the VA has a much larger error rate more like 80%

    I would like to ask a question here. How many new claims did the VA taken in for service connection in all fifty states from the years 2000 to 2010. And -- of that class how many claims were denied and how many were approved?

    I would like to see this information plotted out on graph paper to verify the data and to show Congress. This question has always been on my mind. I don't think you will ever see it.

    The VA reminds me of that insurance company Great Benefit in the John Gresham movie the Rainmaker. The VA works well for the VA.

    The only person I think that could possibly fix the VA mess, that i have read about in this century and have read reviews on is Professor Linda Bilmes from Harvard.

    Such a shame she did not get nominated for VA secretary. But i know why. Thats quite evident. The VA wants a person that will keep the paperwork mess, debacule moving along.

    Just some thoughts.

    My letter from the VBA DID NOT indicate anything at all regarding RETRO PAYMENT for the new TBI (post Oct 2008) regs.

    The letter stated to me, that the criteria in evaluating DC 8045 - Brain Trauma had changed and since I was currently SC'd for a disability

    due to TBI, it maybe beneficial for me to be rated under the new criteria.

    The VBA invited me to contact them about this and that a higher level of compensation could not be granted prior to a re-evaluation

    under the new criteria for TBI.

    I'm editing this post as I just pulled my March 19,2009 letter from my files.

    It states:

    "You may have been rated before the new criteria became effective.

    If you still have residual symptoms, you may be re-examined based on the new criteria.

    This examination may result in a compensation increase even though your condition has not changed.

    You can request this examination through your local regional office on the enclosed VA Form 21-4138,

    Statement in Support of Claim. If you qualify for increased compensation, the increase may be

    paid up to one year retroactively, but not before October 23, 2008, when the new criteria went into effect."

    The one year (12 months) that they are referring to is, with consideration of any medical evidence of record

    that would support a higher evaluation for TBI (under the new criteria) that was produced anytime after

    the new criteria took effect on Oct 23, 2008 - but within 12 months prior to your request for the

    re-examination

    dr bash wrote me an imo for my traumatic brain injury he said they should award me an mdc for my brain injury i re-sent in another 21-4132 have you received a retro payment yet from the va in regard to this matter
