I have a question on revokation of Power of Attorney or POA. When a veteran is firing his lawyer in the letter to the lawyer does the veteran or should the veteran list the reasons why he is letting his lawyer go, If you could answer my question that would be great. Thanks again for every ones help. Also i plan to send the letter green card return receipt to the law firm.. I believe one letter goes to the lawyer and one goes to the local VARO holding the veterans POA. If I remember right. Thks. grt

if i fired my lawyer i think the DAV would have to pick me up again because i am a life time member i paid the 125 dollar entry fee. i dont think they would like it though seeing me after i dropped my lawyer then went back to them but i think i will just stay with my lawyer for now like i said when the VA was confronted with my lost records 2- 3 weeks later i mean real fast no c and P no medical questionares they revoked my tdiu very quietly and gave 100% p and t and at that time the DAV said i may be eligible for SMC in fact the DAV officer said "in fact I know your eligible now for SMC based on the lost records. Ill just see what happens here. One thing i liked about the DAV is that they told me i could work now and make as much as i wanted and they further told me because i am old now they (VA) really dont want to bother with me scheduling any more medical exams aat least the DAV gave me a sense of hope the DAV told me essentially with all the lost records that were sent to the VA I threw pie in the VA s eyes the DAV said because i was moved so fast off tdiu to 100% schedular the archives wrote a nasty letter to the VA and said these records were lost and the fact that a cover sheet came from the archives to the VA that pretty much nailed it my 100% schedular the DAV also told me not to worry about getting my schedular down graded the DAV SO shook his head and said to me " not going to happen." not with the lost records that were found . what i like about this site is every one here understands your problems and what s going on in your life and its great to be here this is a good place to come for support and research i hope some day they may have like a had it cook out or something i could write a lot of questions

glad i asked the question yes i do have a hacking cough i wake up late at night i thought it was the heat in my house so linisiporal does that okay i will have the doctor remove that. The VA did not prescribe that a private doctor did but my other question here is i have already been rated for back injury they put me on morphine sulfates but that wore out so now im on oxy co done i dont like that can i be rated for my chronic back pain and can my cervical and lumbar be advanced to 100% can a veteran get a 100% for chronic back pain?? thks grt

If a person is taking Oxy codone or Morphine Sulphates for his pain from a service connected and rated back injury and is also taking propanol, linsiniprol and antenlol for high blood pressure can the veteran file for chronic pain syndrome, related to the back injury (assuming the back injury has already been rated) plus high blood pressure related to the chronic back pain and ed because of the chronic pain syndrome and or high blood pressure the vet cannot achieve sex OR DO ALL THESE GO TOGETHER? FURTHER ------- Also can high blood pressure be rated 100%? Can chronic pain syndrome be rated 100% Can ED be rated 100% Thank for your help and response thx grt

it has been so long i am thinking of going back to the DAV because this lawyer is just not moving here. I have not received one piece of mail from this lawyer at all. The lawyer i have does not do anything . dont know what to do.

after i got a lawyer the dav dropped me after a quick phone call i had with them may write to my congress person see if that does any good but i doubt it will may try writ of mandamus route see if that bring any results

THE DAV DROPPED ME AFTER I GOT A LAWYER. AFTER THE VA GOT MY LOST RECORDS ( I SENT MY LOST RECORDS INTO THEM) THE VA REVOKED MY TDIU AND AWARDED ME 100 % P AND T. IT JUST SHOWED THE NEW RATINGS HOW MUCH PERCENTAGE THEY GAVE ME AND SAYS I AM PERMANENTLY AND TOTATLY DISABLED. 100% . THEN ANOTHER LETTER CAME SAID SOMETHING ABOUT TRAU BRAIN INJURY AND BEING ENTITLED TO RETRO PAY FOR THAT ISSUE I SENT THAT TO MY LAWYER TO. I CALLED THE DAV UP THEY TOLD ME MY TDIU WAS REVOKED AND P AND T 100% SCHEDULER WAS AWARDED. THEN THE DAV VERIFIED I CAN MAKE AS MUCH MONEY AS I WANT AND I WOULD STILL GET MY 100% BECAUSE MY TDIU WAS REVOKED. I ASKED THE DAV WHY THE VA QUIETLY DID THAT REVOKED MY TDIU AND AWARDED ME 100% P AND T WITH OUT COMP AND PENSION EXAM. Okay will try that see what happens. I have another question for Pete. When I was on TDIU and my lost records were finally found ( i went without VA benefits for over 20 years ) I filed the lost records with the VA immeadiately SPOKE TO JIM STRICKLAND, claimed 38 cfr 3.156 and got a lawyer through Jim Strickland. What happens next just blew me away. Big brown ENV shows up, oh about 3 weeks later. (HUM I'M THINKING SHAM WOW THATS TO FAST??) Now you can't do anything without a comp and pension exam or file a new claim. I just sent in the lost records from NPRC with a letter stating these are my lost records and during the twenty year period my records were lost i continued to file claims and you took no action AND I WENT WITHOUT MY VA BENEFITS. THE VA SENDS ME A BRAND NEW RATING LISTING ALL KINDS OF NEW SCS WHICH OF COURSE THEY TOOK FROM THE LOST medical RECORDS. How come no C and P exam??? THEY ALSO VERY QUIETLY REMOVED, WELL REVOKED MY TDIU AND GAVE ME P AND T SCHEDULER RATING OF 100% and the way the rating math looks now well back then, according to the DAV ( they sent me a letter to ) it looks like now I may be entitled to SMC. But since i have a lawyer the DAV took off, that was about oh five years ago something like that. That just blew me away. Every one I talked to was surprised the VA did that administrative action normally a person would be scheduled for C and P. Then yet another letter comes in the mail now they tell me since I am rated TB that I may be even further retro payed for the traumatic brain injury. I figured my own math out, so thats 2 SHAM WOWS IN THE SPACE OF A MONTH?? The VA has their own math why can't I have mine?? Kind of funny now both sides of my head are filling in completely with gray hairs my beard has turned completely white now . I feel like I'm on that that prison island in that World War II movie Passage to Marsille with Humphrey Bogart. Every couple of years I get a letter saying we are working on your claim and its always from a different VARO every time. I later found out my records were broken down and farmed out to different VAROS. I called the VA hot line the VA phone person tells me my records were broken down because VA is currently down - sizing staff? DOWN - SIZING ???? I keep thinking of that commercial SHAM WOW. Okay something new here. Is this something new here taking veterans off a TDIU then awarding P and T without any further administrative action. Has this Happened to any other VETS in the Forum you know of?? With lost records?? Why did the VA do this? Just beyond me.. LAST MONTH OUT OF NO WHERE A VARO I DONT EVEN DEAL WITH SENDS ME A LETTER AND STATES I NEED TO FILE YET ANOTHER FORM NINE DIDNT MAKE SENSE TO ME OKAY HUM?? FOUND SOME OF MY FILE WAS FARMED OUT TO ANOTHER VARO DUE TO OVERLOAD. ANYWAY I FILED THAT FORM NINE WITHIN THE 60 DAY LIMIT RETURN RECEIPT GREEN CARD I DID NOT BOTHER TO CALL MY LAWYER . its been 2 years going on three now form 9 was filed many years ago letters come saying they r working on my appeals l i feel the va is getting worse and they order c and p for any thing you file for. i feel the c and p exams are just a sham the va uses their doctors to simply deny and force the veteran to either quit or go to the bva miss the 60 day form 9 appeal and your done unless you can prove 38 cfr 3.156 i beleive this will go on and on this has gone on for centuries since day one politicians talk nothing gets done nothing really ever gets done and the va likes that because they can deny claims and life goes on do i think ill get a fair hearing at the bva if i live that long ? "most likely not" no pun intended

Hi i sent the appropriate form to the local va hospital certified mail stapled to that form was my doctors rx for a wheel chair. that was a while back I have not heard from them so i will call the hospital. If I am correct, on the second filing for a clothing allowance it becomes permanent but dont quote me on that. also i think i read here if you file after august 1 then you dont get it (clothing allowance) until the following August as the clothing allowance is only paid i believe on 1 August every year i dont know if im correct about that either. i let you know how i make out once i get in touch with the local va hospital i got service connecttion for couple of spine issues so i dont think the VA will hassle me on the clothing allowance thx gt
