  1. Help! I have a current diagnosis from the VA for PTSD for a rape that was committed during my stint in boot camp in 1984. I was declined for service connection almost 6 months ago. It should be noted I have never had a C&P. I have a representative from the DAV that has never requested one. He did however, send it back for readjudication over 6 months ago. Frustrated from the lack of assistance from the DAV I gave a new POA to the VFW last month. The DAV now says they have no answers for me on my claim. The VFW says they have no control until the claim is declined or awarded. What representative/department or who do I need to speak to?
  2. I carried a 40% for many years for my SC back and ankle. I was granted 100% SC for PTSD in August of 2007. But it was not listed as P&T. I currently have an ongoing claim for increased disability for my back and ankle from (2006). The question I have is.. In my medical file dated November 2009, from my psychiatrist is states, “Veteran is unable to work. He is permanently and totally disabled.” How do I go about filing for P&T? Is this enough evidence to prove P&T? Since I have a claim open (represented through the DAV) should I send a copy of the medical record showing the evidence? Or do I just need to file for it myself? Any help would be appreciated.
  3. I am assisting a fellow marine that was sexually assulted by his drill instructor in Bootcamp in the 1980's. He was 17 when it accured and did not report it. It has caused him some serious issues over the years and he has been seeking treatment from the VA for the last few months. He was evaluated and was given a diagnosis of PTSD, Chronic, Severe, and has an axis score of 45, they have proscribed medication for treatment--here is the question how does he get this listed SERVICE CONNECTEDsince he did not report it? He opened a claim for PTSD already and they are asking for supportive evidence??? Any help would be appreicated.
  4. I am rated 100% PTSD 40% for back and ankle all service connected. I am not currently rated as P&T how do I go about getting my 100% P&T. I have an appointment with my dr this Friday any help would be appreicated.
  5. I was recently granted 100% SC before the award, I previously had a rating of 40%SC. since my 100% is based on PTSD how do I go about making it P&T. I still have outstanding appeals pending on the (40%). Any advise would be appreciated.

  7. Now that I am rated 100% SC What are my benefits? 1. How do I go about getting insurance for my wife? 2. Can she now go to school on the VA? 3. Will I have base/Commissionary Priveledges? If so, how do I get my new card? Where can I find the steps? Sorry for so many questions but the VA are not very forthcoming.

  9. Ok to be as brief as possible, I have been SC since 1986 when I fell 50 feet in a training accident. Medical discharge from Army at 40%. Fought long and hard for increases (mainly for pain) throughout the years when in October of 2008 I was diagnosed with PTSD from a VA hospital/Social worker, etc. In the mail today, I received my "Decision" from my C&P exam which was for the PTSD (March 12, 2009). Here is what it states…. SC for Posttraumatic stress disorder is granted with an evaluation of 50 percent effective June 8, 2007. An evaluation of 100 percent is assigned from March 12, 2009. It goes further, with reasons then in the last paragraph it states "We have assigned a 100% evaluation effective the date the evidence shows increase, VA exam dated 3-12-2009. Since there is a likelihood of improvement, the assigned evaluation is not considered permanent and is subject to a future review examination. So question 1: Am I considered 100% SC veteran now and can they take it away? Here is question 2: I currently have appeals in place which are mainly listed as secondary issues due to the SC Back 20% and Ankle 20%? Today I also received a letter asking if I wanted to keep the appeal in place, and if I did I could submit more evidence. I also received two phone calls (they left messages) asking if I still needed the copies of the records I had requested. (since being on this site I learned to request copies) thanks so much. I would appreciate any advise as now it appears I will be getting 100% but not sure I am still in a war???????????
  10. Believe it or not got a call from the DAV Rep and now he tells me that he did file the NOD when he was suppose to (which is a lie). He just opened a new claim. He thinks I am an idiot and that I do not know the difference. I am currently 40% SC rated which is why I got out medically from the military. I fell 50 feet while repelling on a training mission when the rope broke in two pieces. I broke my back and I have no ankle bone in my right ankle. (I know 20% each is a crying shame) I was young and dumb. This happened 23 years ago. I now suffer from PTSD and haven’t worked in over 5 years. I am diagnosed with Major Depressive Disorder from the VA. I have completely linked it to my fall in the military so I don’t believe that a “Stressor” is an issue. I am going to take everyone’s advice and write- write- write. And then if I can, I am going to sue the He** out of the DAV. Thanks For your advise and help!!!
  11. I need some assistance with an appeal claim that was suppose to be filed after a new rating came through on my back and ankle. (November 2007) In February 2008, I spoke with my “new” representative (DAV) and sent a letter to him for him to send in the paperwork for the appeal of the current decision. I had periodatic communication with him and he basically told me it was slowing moving through the process. Well in October 2008 I opened a new claim for PTSD and after recently having my C&P it is at the rating board. To make a long story short I called the Representative to check the status of the appeal he was suppose to file and he got very flustered and said he would check into it after the rating board does their thing. I then called the 800 for VA information and they have informed me that an appeal was never filed. Any advise on what to do??? Currently 40% SC and no idea what I will get for my PTSD.
  12. I really need some assistance. I am a service connect Veteran and I discharged from the Army in 1986 with 10% SC for my back and 10% SC for my ankle. I fell 50 feet off the side of a cliff when the repelling rope broke and I broke my back and crushed my ankle bone. I know I was young and stupid (20 when discharged). I have off and on fought for more disability throughout the last 20 years. As of April 2008, I was upgraded to 40% -20% for my back and 20% for my ankle. I have been unable to sustain gainful employment for almost 10 years and in October I was diagnosed by the VA Psychiatrist with PTSD. I have been seeing a social worker and Psychiatrist through the VA since October. On the first assessment I had I was given a GFC score of 55. I have no idea what I am currently rated at. I had a C&P today with a QTC Dr. He would not let my wife in the room during the evaluation and even though I think the meeting went well, I am concerned that I may not be granted SC for my PTSD. I need to understand that if I am granted at least 30% I will have a total rating of 70% which means I would then apply for unemployability. Is that automatically given or are there more steps to be taken.
