  1. It is my understanding the following appeals are still being worked and C&Ps are being scheluled. Increase on the right shoulder, evalution of the right hand,& depression. They already ruled the right hand non functioning and granted SMC So I dont understand why a C&P would be done on it, also I dont think he can get over 90% as that is the highest rating on the right upper extremity and that is my question should I stop the appeal on the right shoulder and hand
  2. The decision states your overall or combined rating is 90%. We do not add individual percentages of each condition to determine yourcombined rating
  3. forgot to mention he was a narcotic agent and beaten in 1995 and was never able to work again

The BVA granted service connection going back to April 2005 The breakdown is what I posted 90% for impaired mobility of the right arm, hand gripe weakness associated with partial ankyosis, right shoulder,with postoperative arthritis. He was also granted SMC on accoumt of the loss of use of one hand. He had the following 20% for the right shoulder and 10% for the scar The docket number is 04-03-0997
  5. My husband just received 90% for impaired mobility of the right arm, hand gripe weakness associated with partial ankyosis, right shoulder,with postoperative arthritis. He was also granted SMC on accoumt of the loss of use of one hand. The BVA remanded the increased compensation for the ankyosis of the right shoulder which was rated at 20% and Scar 10%. I called the 1-800 number and was told the rater wants a C&P for the Right hand and right shoulder along with the depression. Should I drop my husbands appeals for the shoulder and hand since he has 90% and continue with the mood disorder appeal. I can't afford any chances of losing the 90% and I am not seeing where he would gain any extra by continuing the hand and shoulder appeal

  7. The denial was based on the arm and hand weakness not being service connected however it appears that the C&P service connected the issues

I am just asking on the arm and shoulder condition the way I am understanding it the doctor is saying it is service connected as the brain injury occured after the military The shoulder is service connected for 20% limited motion and 10% scar The C&p was for perpetial nerve damage on the right upper extrimity By the way the claim was denied for not being service connected so I appealed and the VA Doctor wrote what I said in the original post Would this fall under special medical condition rate of pay On my Origanl claim the VA kept blaming everything on the head injury now their Doctor gave the opinion it is a result of the service connected injury
  9. Guys I need your opinion on my husbands appeal claim. His C&P was Aug 9,2006 The Dr Stated the following right upper extremitity exam reveals he is not able to make any movement at right shoulder,right elbow or right wrist. He is not able to make any movement of right tumb or right hand fingers;not able to make a right hand grip. Diagnoses: by VA Doctor 1. Right upper extermity pain and weakness is likely due to status post injury/surgery of right shoulder joint. 2. opinion regarding right hand grip: In my opinion, patient does not have any grip on the right hand and this condition is likely due to status post right shoulder condition and unlikely due to tramatic brain injury. Please give me some idea what to expect on this appeal everything we have is riding on this Thanks Donna
  10. In 1975 our state did not require it, all he was entitled too was a small pension. We had a law firm he got everything he could get which was nothing
  11. Yes I have the C&Ps I wrote in my first post what the Doctor said in the c&P report My husbands right arm shoulder wrist and hand are useless and frozen The C&P doctor confirmed this

The brain injury occured as a narcotic agent not service connected The shoulder is service connected I was told to wait until I receive my husbands rating increase before filling aid and attendance and unemployable but the n I read somewhere to get it filed So I did I hope I did the right thing From what I have read he should get at least 90 % for his shoulder elbow wrist and hand
