  1. Do the VA assign different ratings for seperate heaart surgeries that show a progression of heart disease
  2. It's been at least two weeks since I submitted my increase for claimed condition after surgery,which the VA rep said that the VA was under a new mandate to respond within ten days from the date of the claim.Is this True?
  3. Can I get 100% after my surgery and for how long.The doctor already has said that the surgery is because of my claimed condition and has put that in writing.Do I wait until after the surgery to claim 100%
  4. Haven't had a chance to get am IMO and i never got a C&P exam.So i don't have any evidence other than my medical records,which the BVA remanded it back for that to happen.I'm waiting to hear back because i complained to the board and to the appeals management center about not having an exam.

  6. If the board of appeal denies me what is my next move.I am waiting to hear from the appeals management center on what is my next option.So should i have already gotten an attorney,most of them won't move until i get denied by the board.

I went looking for a cardiologist to do an IMO for me as i have less than three weeks to submit new evidence before dead line before the board makes it's final ruling.While on my journey to find a doctor i thought i found a lawyer that was willing to help me.I sent him all of my medical records and he basically said that my claim would be exceedingly hard to prove.I will post the email that he sent to me.It was not encouraging to say the least.My claim is suppose to be heading back to the RO for an exam that was not given which had been ordered by admin law judge in a remand.The AMC said that the ratings officer was wrong to rate my claim again with out giving the exam.I figured i'd bought enough time to go in search of a good IMO.However i don't have the kind of money that it takes for Dr.Bash and one other Dr. i called out of Texas.Down here in st.pete fl there aren't a lot of social security lawyers that use IME's or they are not willing to give me the names of the ones that they use so i could at least approach them and ask for an IMO.Is it something that i am doing wrong or am i dead because i don't have a couple of grands lying around to get that IMO.

  9. Yes they did.As a matter of fact i was told to call back if my appointment had not been made by next week.They were going to call the hospital themselves.What were you going to post and where
  10. I just got off the phone with the AMC supervisor and they agreed that the RO office was wrong for sending my claim back and deciding on it with out giving me an exam.Now i have time to find an attorney and get an IMO.At least i have a fighting chane and that's all we ever ask for.

  12. my claim is on it's way back to the AMC and from there i guess on it's way back to the BVA.So i am kind of in a tizzy.Do i have a chance to get a lawyer or have i waited to late.I just don't know which way to go

I want to know how long before i hear back from the BVA regarding my complaint that i never received an exam that was oredered in a remand regarding my claim.For some reason the RO decided to forgo that exam and rule on my claim which was denied again the judge ordered the exam in the first place.Now i don't know if the appeals management center will send my file back down or will they simply allow this to happen.If so what is my next step since it seems that now there may be a final ruling.What do i do now.I am trying to get an IMO.DO i have enough time to get one and have that put into my claim file.

How do i go about finding a good doctor to help me.Where do i start.Do i just call up a cardiologist in the phone book and make an appointment.Do anyone have any suggestions.My only doctors have been the va doctors and none of them would even acknowledge that a problem existed.My two ekgs happened while on active duty yet they felt like they didn't have the expertise to give me the opinion i needed

Thank you berta please send me that doctors' name.I meant a BVA judge and no i never got any blood work done while on active duty.It was only after i had an episode that the va did a complete study,I must say while i was in the army i did have two different EKG's that showed some changes but never were followed up on

I never got an outside opinion pertaining to my heart condition.And because i never went to a doctor until 20yrs later because i was told that there was nothing wrong with my heart while i was in the service.I could never establish a connect because of the time in between my actual service and first of two open heart surgeries.Well when we went and reviewed my records there were two instances where the doctors noted some ekg changes.But there was no real follow up after each one.Had i known that they had indeed found something i would have paid more attention to my chest pains after i left service.Believe me my entire family history is scary when it comes to this deadly disease.I suffered from this conditon silently and i never knew the extent of it.Should i go get an outside opinion now.

If the judge that i went before at the traveling board ordered that i have an exam to determine my etiology and it was not done because the RO thought that they didn't need to because of the amount of evidence they already had.Where they wrong not giving me an exam.Two:Should i accept this decision of denial or do i have a legal complaint.I am so fed up with this process which is now going on 8 yrs.Everytime i tried to get a va doctor to include my chest pains that i expirenced back in the service into my current treatment record they were afraid to,saying they just wanted my most recent complaints.Wouldn't you know it.It is that omission that they denied my claim.Please Please help.

  23. Is it against the law for the RO to not honor an order from an admin judge requesting that an exam be given trying to establish etiology of a condition.

I want to know what can i do when the admin judge remanded my case back for the RO to try and establish etiology for my heart disease.Their argument was that because i was given a diagnosis of "chest wall pain" while in the army back in 1978 to 1982 that it did not establish a heart condition.I actually received an EKG and there was no blood work or heart cath.The judge wanted them to give me an exam and then make another medical opinion.Well they said that the exam was not necessary and they render the same medical opinion.Even when the judge asked them to and said that she thought that the many times i went on sick call for chest pains may have something to do with my condition now.Please advise

I have been diagnosed with corornary heart disease.The admin law judge ruled hat the VA didn't do enough to prove that my condition was not related to the syptoms i had while on active duty.I was denied because it was inconclusive as to whether or not i actually had a heart problem. SO it was sent back for remand.Now i am waiting on an exam i guess to determine if my condition is related to my past medical history in the military.I got out of active duty after desert storm.It had been 20yrs before i had the first of two opened heart surgeries,because it was so long after service they denied me.My question is what is this exam going to do.I was told back in 78 and 82 that they didn't find anything wrong with me.However when we went and looked at my smr's there it was the notations that the doctors' made regarding the ekgs' i had taken.I had so many visits to the doctor about my chest pains until my first sergeant threanted me with an article 15
