  1. These people conveniently forget that the government sent us to do their dirty work, broke us, and now want to means-test us? It shouldn't even be necessarily about the "income", but also about the fact you broke our @$$e$ and you know want to make us pay for your irresponsible spending in all the other areas of "governing". Damned Bastards for even entertaining the idea. Yet it happens every year.

  3. It's best in a case like this to wait for the letter to see what it says. The law reads (at least in my extremely limited understanding of it) that when the VA is not able to come to a determination, or when doubt exists, doubt is to be in the veteran's favor. Of course, there are always exceptions to that rule. The letter from the VA will let you and your rep know what the next steps should be, but it does pique my curiosity as I don't imagine these types of outcomes happen very often; but what the heck do I know? I definitely plan on another appeal though. Plan for the worst, hope for the best. Semper Fi, Sgt. Wilky
  4. Definitely read the link @shrekthetank1 posted. You need to make sure you understand the difference between having earned income and not having earned income. I *believe* (you need to verify the accuracy of the information) that for most recipients, VA disability is not considered "earned" income. I'm able to contribute to an IRA because my wife earns an income, but I don't have an earned income. It seems to me that this was a topic three or four years ago in which some really good information was posted, but I'm not finding it. Semper Fi, Sgt. Wilky
  5. There are some examples in this post that I posted a while back. Given to me by one of my VSOs. Read through both, take a copy of both, to your doctor(s), so they know what is needed by you, and expected by the VA. Semper Fi, Sgt. Wilky

  7. Which is exactly what I was told, then my friend (who is a Vietnam Vet) said he got it, even though he's 90%, but TDIU, just like me. I went ahead and mailed the form, but I expect it'll get denied, and legally, it should get denied.
  8. @brokensoldier244th I went to the website and it wasn't as specific as I was told before. I have the letter stating I'm at the 100% rate and it is total and permanent, so I just now sent the application and letter out! Semper Fi, Sgt. Wilky
  9. Hello All, Looking for Colorado vets who might be 100% TDIU, but actually rated with a lower rating. I'm asking because I'm 90%, but being paid at the 100%, because I'm TDIU. I was initially told that I didn't qualify for a property tax exemption, because you have to be rated at 100%. I have a friend who is in the exact same boat I am, 90%, but being paid at the 100% rate. He filed for the property tax exemption and was granted. I told him that was probably a mistake on their part, but he said it wasn't... I'm trying to find the rules again. I contact my VSO and asked them, but waiting to hear back from them. Do any of the Colorado vets know about this? Did the rules change? Semper Fi, Sgt. Wilky
  10. It used to be C&P exams were available on the "Blue Button" in my health vet...is that no longer the case?? Back in 2015 I saw all my C&P exams. It's completely unacceptable that just because C&P exams are considered "legal precedings and legal documents" (that's what the jerk in Cheyenne would always tell me) that we don't have access to the same discovery documents that would otherwise apply in any other court of law. My local VSO sent these to me to as a sample for my doctors when it comes to writing letters for a nexus (link) letter from an event in service to a current a diagnosis.   12. Yes, all it does it prolong everything. I'm sorry the VA is doing this to you. I don't know what to do, but I would appeal to the BVA and again, state in short, but detailed comments that the VA has doctor shopped this and your IMO from your PCP has been ignored. That right there is a violation of the "benefit of the doubt" rule and several others. It doesn't help YOU, but in my case, I spent 12 years fighting through the system, and in 2015 when I FINALLY got to see the VA judge, he actually apologized to me for the wringer I and my family had been put through. The almost six-figure back pay kinda made it worth it though. Don't give up, keep fighting the fight Brother. Semper Fi. Sgt. Wilky
  13. To me, these are the easiest to include on the (almost) inevitable NOD. State in detail your observations and frustrations. If you have private medical insurance (which I know a lot of vets don't) or can get a private medical opinion with a doctor that specializes in the field of your claimed injury or issue, ALWAYS submit their records in your NOD. Almost every single C&P exam I've had, it was a NP who was paid (I promise to Almighty God) by the VBA to insult and deny my claim. I've had almost every single claim overturned on the basis that my *insert doctor or specialist's names here* render a simple or at times extensive report and opinion. NP's are the lowest on the totem pole of doctors allowed to render an opinion, and I'm glad (in part) the VA uses them because it's easy to trump an NP with a medical doctor or specialist. Are they truly doctor shopping, or is there a truly obvious reason why they're doing this to you? Semper Fi, Sgt. Wilky
  14. If your doc is treating you that way, I'd file a complaint and ask for another doctor. Make sure you're documenting every interaction with her. This is why I hate VA and every other government-run health care. I'm not trying to be political, but the free-market doesn't put up with doctors and service like this for too long. Semper Fi, Sgt.   16. O yeah! Normal for the C&P examinations to do this. I swear, every C&P exam I've been to (at least 19) with the exception of 2, have been exactly the same. Cut and paste as normal findings or a complete (and intentional) misrepresentation of what I said and/or outright lies and accusations by the PA of what symptoms and issues I had. It sucks, but you but you have to get private doctors on your side. In my case, my PCP, neurologist, and rheumatologist all got on my side and helped me with (first) the right and correct diagnosis. Second, I built relationships with them before I brought my needing their assistance with my VA claim. Third, I made their life easier by following their treatment plans and bringing them the forms/letters/information they needed to help me after they agreed to help me. My rheumatologist was extremely helpful as she used to work for the VHA side in Maryland before she came to Colorado. Nothing pisses a doctor more than when you walk into their office with the expectation that they're your lawyer and not your physician. Many are afraid to work on your behalf against the VA or SSA because they think they're going to get hauled into a court or something. It has taken me 23 years (and the fight continues) but I've learned with my family situations and my own, that you have to be your own advocate. Yes, there are those out there who can and are willing to help, but if the vet isn't willing to put in the effort to dig down and do some research and assist in their own claim, it won't help and they are adversely delaying their claim. You also must possess the patience of a saint. Protest the C&P exam. I did that by writing a short and concise letter along with the necessary private doctor's materials in my NOD. In one case, I sent a letter to the C&P exam office who was in charge of the doctors for the C&P (I can't remember what four-letter alphabet soup agency it was). The lady at the ombudsman's office in Cheyenne helped me with that information. Blah, blah, blah, I'm in a yappy mood this morning. Sorry for the long post. Semper Fi, Sgt. Wilky
  17. If I were you, I'd find someone to help me with my claim(s). It seems to me, that there is a lot more information that VA needs to know about you concerning your claims. I don't know you, but with your service records and service medical records, you probably have a lot more coming your way than you might think. Again, I don't know, but I might be tempted to hire an attorney to help you with your claims. You may be able to skip the TDIU portion and get 100%. You can work with both 100% and 100% TDIU, just different (and very vague) rules apply. Don't give this process up.   18. Holy Smokes, Have you gotten with a VSO or someone that can help you with your claims? You need to file as soon as possible for everyone one of those as @broncovet mentioned. You're right in that last $1600 is a big help. Don't give up this fight, you might even be entitled to SMC (of which I know nothing about). Semper Fi, Sgt. Wilky
  19. in the simplest terms, your 90% rating would go to 91% with one 10% increase or another claimed condition rated at 10%. So in order to get to 100% you would need a 50% increase, or a another condition rated at least 50% from the 90% where you already are. Sgt. Wilky Why are you so dead set on reaching that 100%? Are you able to work?
  20. @30percentermovingup , you would need any combination of things. You would certainly need an increase in any/all of the ratings you have. You would almost also need another rating rated at least 50%. Sgt. Wilky
  21. By the calculations I have, adding 50% for the Pes planus, plus 20%, and 5 10% ratings (it does NOT account for bilateral factors), I get 76.3804%, which would obviously be 80%... The bilateral factors may put you at 85%, but I doubt it. I can't go look at the charts on the VA's website right now... Sgt. Wilky
  22. You're going to need an increase of 50% or more in order to get to 100%. The math is subtractive. 90% to 100% would require an increase in a lot of things you have, or another condition rated at least 50%. You may not even truly be at "90%". You might be at 84.6%. Based off what you posted, the calculations only come out to 52.7608%. I'm assuming you're rated for something(s) other than what you screenshot.   23. I would not wait to file for the second condition, you file either an "intent to file" or file your claim as soon as you can to preserve your Effective Date. If you wait to file until after you get the first claim adjudicated, you could be waiting years. Don't wait, file now. I don't have the experience to say otherwise, and others may chime in with much more institutional knowledge than I have, but that is what I would do. Semper Fi, Sgt. Wilky
