  2. I will wait and see how this flys. If not, which I think it just might, than I will go for a second opinion. Since this is my first appeal, from what I gather, I can appeal it again with additional information. My service officer told me he is almost a slam dunk. Usually VA doctors do not make statements that strong. I guess I just have to wait it out again. Believe me, I wish I could work even part-time, I could use the money. If this comes through I will be OK, not rich, but OK. Best to you all and thanks for help. tom
  3. My claim was for TDIU, I believe this refers to unimployable do to my disabilities. Yes, I am sure that it was TDIU. However, they returned a "verdict" of 90 %. (I was 80 %). Now, my doctor gave me this additional information and it was sent in, or appealed, saying I disagree with the decision and here is some "additional" information (the doctors comments). When they receive this will I have to go through another medical evaluation? And last, how long does it take for an appeal to process, another 8 months? I want to thank you for answering my question.   4. Good afternoon fellow Vets. I have recently been changed to 90 % disabled. Actually, useing there math I am 93 %, but it rounds out to 90 %. My primary care doctor at the VA has just placed the following statement in my VA records: "I have known Mr @@@@@@@ for approximately two years in the context of a doctor- patient relationship and am quite familiar with his physical disabilities and medical illnesses as well as his mental health problems. Given the totality of his clinical picture, I have no hesitation in stating unequivocally that I feel he is unemployable." I signed a release at the VA so that my service officer VVA could get this information and send it in giving this as additional information. This was just sent in to the rating board to appeal the 90 percent ruleing. Now I thought that this was significant and would hold a good deal of weight with the rating board. After reading some of the posts I see that this is not a sure thing? When you send information to appeal a decision does the procedure take 8 months, just like the original request for an increase in percentage. I have heard it both ways, appeals are quick and the opposite? Thanks for any help you can give me on this. Tom meggi@rochester.rr.com
  5. Good afternoon all, I have again a question that maybe someone has an answer to. I am an 80 % disabled vet. I am a widower and live alone. Not that I plan on needing it, but, if I should need nursing home or extended care or what ever, will the VA provide it, or provide it at a cost? I live in Rochester, NY and the nearest VA hospital is in BUffalo, NY. We have a very good VA clinic in Roshester though. I understand that they can place you in a local nursing home. How is this determined, I would not really want to go to Buffalo, everyone I know lives in ROchester. If placed in a local nursing home, will it be a nice one or, I hate to use the word, a cheap dump? Do I have any say in the matter or does my health care proxy have any say? I hope I will never need this "service" or anyone else, but it is good to know all the facts, especially when I do not have insurance that covers extended care facilities.   7. I am an 80% disabled. One of the disabilities is my left knee. I have been told by my orthopedic doctor that he would like to do a knee replacement. This might seem funny to ask, but I do not want to have this operation, at least not at this time. Maybe in a few years, but I just do not want to go through it at this time. Can they say to me that since I do not want the operation, they will lower my disability? I do understand that after a complete knee replacement they would say I am all better and take that disability away for the knee. This is not the reason I want to forstall the sergery. Also, I once heard that once you are on collecting VA disability for, lets say 30 years, it becomes permenent. Is this true? If true is it for the disability you are currently getting.   8. Good day fellow Vets. I am an 80% disabled veteran. One of my injuries is a knee that was shattered and never the same. The ortho doctor wants to do a knee replacement. I just would like to know, when they do this knee replacement will they lower my disability? I also heard that after surgery, your disability is temporally increased for a year. Is this also true?
