    Help For Widow?

    After his death she was in fairly good health, her late husband was too, he was stricken with the cancer 18 years after his retirement, so presume service connection will most likely be denied. (obvisouly) we can't precict the future as to how or what will happen to any of us...as for has our health. I'm simply trying to help this sweet little old lady out with questions she had ask me. she knows that in her heart and mind she may never get help from the VA....BUT I GUESS SHE THOUGHT SHE WOULD GIVE IT A TRY. I will try to help her via S.S. and see if theres a program from the part clause of part D OR ANY OTHER PART if theres any help for her medications? It takes half of her S.S CHECK TO BUY THE MEDS SHE IS TAKING NOW, MEDICARE ONLY HELPS WITH SOME LOW % , BUT SINSE SHE IS NOT ON HOSPICE THEY JUST HELP HER ABOUT 20% OR SO WITH HER MEDS.. Not much left after that, to say the least she is struggiling to pay rent and untilitys grocery's ect,,ect,,. THIS NEW PREPOSED HEALTHCARE PLAN FROM THE PRESIDENT IS NOT GOING TO HELP HER MUCH...AND THOUSANDS PEOPLE LIKE HER. Thank you for your vaulable time.

    Thank you Bertha, I mention carlie because she ask me to start a new thread on this topic. I mention this widdow was on medicade... sorryI was miss informe she is on medicare, which explains them not helping out with her meds, beings her income is not provertyl level or is to high for there stantdards. she draws his S.S, about 1230 monthly. this widow ask me if there was any help she could get from the VA because she needs help with her meds. not being servie connected or having any kind of payment from the military other than retirement is why she ask SHE just wanted to know if there was anything the VA could help her with?..I didn't know? ..this is why I came to hadit for help. hadi help me with my claim and I appreciate each and everyone of you guys. I will tell this widow that unless she can get a claim approved for his service connection death it will be just a waite of everyones time to try to help her with help from the VA. AFTER HIS DEATH OF A FEW MONTHS, SHE WAS TOLD WAY BACK THEN BY A VSO THERES WAS NOTHING THE VA COULD DO TO HELP HER. Her hubby had no insurance or benefits being just a retired vet other than retirement pay and to much time has come to pass, its been over20 year. On behalf of her late vetran husband I thought I'd try to ask on here if there was a remote possibilityfor her some help. if she could get help for the medications she is taking thats all she wants no back pay or anything like that. she is a honest person and gettting pretty old she is 88...but still in her right mind its just that she just has a lot of phyiscal pain. I'll refer her back to SS Dept. Thank you for your time.     Thanks Carlie, Asking on behalf of a friendly long time neihbor of mine. Is there anything this widow can do to get VA to help with her meds? medicade dose not cover. History Her late hubby was retired at the time of his death,(CANCER) 1989, he was a 30 year man retired us army E -6, cook, served in war war II, He retired back in 1964, sinse then they were living off his retirment pay, he died in 1989, leaving his widow behind, she ask about help from the VA back then (nothing was filed) and was told nothing could be done because he never had a insurance plan from the military/ OR reciving benefits at the time of his death other than retirement pay....which stop at the time of his death. what this widow wants to know sinse she has been living off his SS,She has been stricken with Ostroprois bad its a decendeing bone diesease thats 10 times worse than ruhtomorid arthritis <ms,... its crippleing to say the least, she was doing ok just on his SS but now her pain meds are taking half of her SS check. can she file a claim with the VA after all these years?? asking for help for her pain meds? or is she just left behind and out in the cold ''sorta=speak? any information on this would be greatly appreciated.

    I forgot to mention the vet died of oat cell cancer...he was in world world war II was hon dis in may of 64 died Jan 89 not any medical records to go check? just death certif ect,,ect,, any help this widow can get would be greatly appreciated , if its just help with her meds, she is disable with ostroporis bad she is very bad takes most of her SS TO BUY HER MEDS, ALTHO MEDICADE HELPS BUT NOT WITH HER MORPHINE PAIN MEDS WHICH IS HALF OF HER S.S. CHECK. Any one kow if she can get VA to help her? Thank you.

    is there any dic a widow can recive when the vet died 20 years ago and was getting retirement? they were getting his retirement pay and after his death she got cut off and started on SS. altho the widow is on SS but not enough to make ends meet, However sinse her hubby did not sign up for the insurance while he was living is there any chance for this widow ro get any help from the va? now/ 20 years later.
  6. Yes I agree with bertha, get an IMO from a Quilfied private Audiologist, ask them to find the ''Marland Discrimination Word Test'' thats the test the C&P requires. Have the Dr to to give his professional opinnon of how profound your hearing loss trully is, they may get you hearing aids (if you don't have them?) but in all reality if you have noise induced hearing lost from the military(you say that the VA service connected that) and you don't hunt/Or around any type loud nosie...sinse you been out of the military . IF YOU HAVE TINITUS? Ask the Private audiologist to write you a letter stateing his/her findings of your hearing loss in both ears! then compare the VA rateings with your IMO. IF THE RATING IS HIGHER THEN THE VETRAN GETS THE BENEFIT OF THE DOUBT. If you have tititus? ask for that also its only 5% for each ear (I think? not sure maybe 10%) but it gets your rating up there. you should get an increase in your compensation. what is your rating now? If you don't have a NOD going then refile for an increase in your rating. or take your private test from the Audiologist to your VARO. if they don't help you then ask for a hearing with a DRO and a rateing speclist to be at your hearing. besides if they said it could not be used for ratings then somethings wrong here? It's not right for them to repeat the words over and over during a hearing test.
  7. purple thanks,Yes I realize this too. I was just curious how long the VA will allow you to get TDIU? P/T..? I was asking this because I have no Idea?...if they take you off of it when you reach retirement age.? and just let you have what thay want you to have...or reduse your rating? combined rating and only let you have that. I been told that they never take it (TDIU) away from you even when you reach retirement. So I'm only guessing but a veteran that gets TDIU gets it the rest of his/her life...?

I UNDERSTAND THAT WHEN TDIU P/T IS AWARDED , NO FUTURE EXAMS SCHDULED/VETERANS DISIBILITYS ARE PERNMENT IN NATURE Due to Direct/or presumptive Service Conected Disiblity's.....TDIU P/T >...> IT'S FOR THE LIFE OF THE VETERAN TIL THE DAY HE DIES? Correct? Do I need to contact my RO and let them know I'm fileing for SSDI? OR SSD? I suppose I'm worried the VA will cut me off TDIU P/T when I turn 62/63? Do I need to do anything other than go file for SSDI/SSD? or SS? Thank you guys in Advance I appreciate it.
  9. oH oK Thanks, I'll go file for SS ASAP. Were both worried about this/so now I don't have to worry any more. Thanks guys. I Never knew you could still get TDIU after you turn 63/65. I am currently 100% on TDIU with P/T, No future exames schduled and my SC disiblity is perament in Nature. I Realize the VA Can do what they want and if you ain't been on TDIU for the last 20 years then your subject to C& P exams also? right? but even if I don't have any C&P exams I still keep getting the TDIU After I turn 63/65? I still get the montier letters from the VA every year, the one them asking you if your working or not or working for the VA or been in jail more than 60 days ect,,ect,, when I do get them letters I always fill it out and send it back to them with a return receipt requsted, because to this day I stll don't trust the VA...I learn that the hard way and it took my claim serveral years to win simply because they had said at my RO that they never recieved certain paper work. I had requested a hearing at my RO and with all my evidence I won after serveral years of fighting with them....THAT HEARING WAS THE BEST THING I EVER DID. Just wish I had known about all this before hand, I tell every vetran I see to keep fighting because you will win sooner or later, don't ever give up and always when you send the VA something GO TO THE POST OFFICE AND GET A REQUESTED RETURN RECIEPT THAT THEY GOT IT. I Just don't trust the VA sorry just my opinon. Anyway I was thinking that I was getting that (TDIU) because I can't work , (unemployability) and when you get the to be age 63/65 I figured the VA would stop it and have you get on SS?? Which is a lot smaller $$ so actually they just keep paying you at the 100% TDIU rate as long as you live? and draw SS AT THE AGE OF 63/65 TOGATHER? IS this what you guys are saying? If I understand correct I will go file for SS ASAP. When your disaiblitys don't get any better which the difference in TDIU the rating is for a life time? Correct? and if your rated 100 % without TDIU P/T.... then the VA can hit you up with the C & P exams...VA thinks you can have improvement? don't make a lick of sense to me 100% should be 100% your disable and can't work either way. I know about the 20 year rule with TDIU...NO C&P EXAMES, Correct? I Thank all of you guys, I appreciate all this information.
  10. oic, my didibilitys will not get better I been on tdiu for about 7 years now and never been called for an c&p exam...had bunch of those before I got my tdiu believe me. NO my wife never worked she did for a while but has heart trouble including triple bypass,and can't work ,arthitis in her knees real bad but not bad enough , she applied for SS but was turn down 3 times they said she could be a wal-mart door greeter and thats just not her thing...SHE IS JUST WAITING TO TURN EITHER 63 /65 WICH EVER SHE CAN RECIVE THE MOST SS $, BUT FOR NOW WE DO OK WITH MY TDIU. in my award letter it says that ''Basic eligilbilitiy to Dependents Education Assistance is Granted as the evidence shows that you currently have a service - connected disablity, permanent in nature. I was just wondering if the tdiu runs out at age 63/65?.... then they cut off your tdiu? and maybe give you compensation for your % of disabilitys? for the remainder of your life? and then have you to file for SS.?? MY SS won't be much , I have not worked in over 17 years....needless to say tdiu is our only income. thats why I'm worried. Please don't get me wrong here..I am proud I won my case for tdiu, lot of years I fought for that and it has help this family more than I can ever say, I certainly don't mean to be bitchen about it, I'm just concerned about the future for us. (who aint) I help my fellow vetrans who file claims and help them with what all I know and give them t-birds site hadit.com to get more help than I can give them.   11. Hello good folks I posted eariler but it never showed up? hope this one does? How long does a 100%rating of tdiu pt last? age 63 or 65? or til you die? and if your combined rating is 60% do you still recieve the tdiu after you turn say 63?65? based on your over all combined rating? I was raised from 50%to 90% to get tdiu with a 10% rating of tittus. they say my over all rating is 60 %? but was awarded the 100%rate with p/t curently on tdiu. I am worried about this because I'm getting ready to turn 63 and if its redused I'll be a in big trouble making house payments ect,,ect, or making ends meet, wife is disable also but can't get SS.
  12. Question? I hope this is not to confusing ?? I'll try my best to explain. After your awarded tdiu useing the extra schduler b ok.... at age?? how long does tdiu last? at age 63 or 65? when you reach that age does the VA take away the tdiu? and just keep your compensation going at the 100% or do they go back to your combined rating? I am being montier by the VA each year now for every year I been on tdiu...the letter they send you once a year to see if your working or been in jail that sorta thing. I was 50% then was raised to 60% then to 90% over a period of a few years finaly was awarded tdiu. my letter says ''We granted entilement to the 100%rate with PT effective bla bla bla... wonderful wonderful wonderful, wife can go to school and have champva insurance , I been getting tdiu ever sense I was age 52 thank the good lord, and some very good vetrans friends. was a long fight with the VA BUT I NEVER GAVE UP. the award letter says ''Reason for change granted Disability and an increased based on indivdual unemployability. I'm not sure what I'm rated at? in my award letter it says it went from my old percent from 50% to 90% percent as of the present. then the award letter goes on to say my combined rating is 60% because they don't use induividule ratings of each coditition to determine your combined rating... I am useing the schedular B of the 38 code of fed regualtions to apply for tdiu if your not 0ver 60% anyway so my question is I was wondering how long does tdiu last?..I'm getting ready to turn 63 and I need to know what my compensation will be reduse to?... if it is redused?.... if its redused I can't make my house payments and may need to move? to make ends meet...we are doing fine at the moment but sinse I have not worked in over 15 years my SS won't be much if at any at all? if I get to keep the tdiu or the 100%rating we will be fine. does anyone know about this? thank you in advance I appreciate any help, wife and I are scared she is disable also but does not get SS. MY TDIU IS OUR ONLY INCOME WHAT SO EVER. Thank you all Rocky top
