  1. I had to type it up so I used information I gathered here and faxed it to my VA rep. He did nothing more than tell me to type it up and he would submit it.
  2. No they said the migraines started in service and said nothing more than the diagnoses for the neck issue mine is c5 and c6. I emailed a lawyer Friday I hope to hear back soon maybe they will take my case. My fear is getting jerked around for years. I have a job which I can barely do now and I wont be able to do in a few year (according to all the Dr's including the VA) so I need Voc Rehab. i requested a personal meeting with the RO and the DAV said it takes about 3 months to get that in my area. So I am hoping if I go in with a little fire power maybe the will bump me up 10% on the migraines (I should be 50) with the 10 on my feet I can get started with school full time. I have been going for the last year on my own out of my own pocket because I am running out of time. Once I get Voc Rehab i have nothing but time. I wont give up and I wont go away.

  5. Thank you so much for the advice they did service connect my migraines so that is atleast a very small start. I also emailed a lawyer to see if they are interested in representing me. I will let you know what happens. :D
  6. I am considering that does a lawyer make a lot of difference when dealing with the VA.
  7. I have a lot of questions? After waiting a year I recently recieved my rating back from the VA. There are all kinds of problems (I all ready requested a new rater and a face to face re-evaluation) but I need to know what do to get ready. This will be lengthy so I apologize. I was medically discahrged from the Marines in 1999. I went in with moderate A symptomatic pes planus. I was discharged for left foot planter faciitis and tight achillies. It is also notated for my right as well. This is the Aggravation of Pes Planus so I filed for it. The VA rater denied me and actually quoted my in service Dr. on June of 1998 as saying "flat feet not problematic" I have a copy of the medical record and what the Dr actually said was Flat feet not problematic previously." They did not set me up for a compensation and pension exam. I got Lyme disease while I was in and it was notated in my service records. I submitted 2 private IMO's including one from a specialist who said I have migraines, fatigue, memory issues, neck pain and polyarthtralgia from Lyme disease. The VA set me up for a 2 C+P exam's one with a Dr for Lyme disease and the other to test my memory. The Lyme disease Dr gave the opinion that my Migrianes started while in service and were not connected with Lyme disease but where service connected. He also gave the opinion that my neck pain was being caused by degeneterive disk disease and not lyme disease (the first time it was reported was at my follow up for Lyme.) The VA Dr gave the opinion that the polyarthralgia and fatgue could not be caused by Lyme but offered no alternative for cause. The VA made no mention of the Memory C+P exam though the examiner did tell me I was suffering from memory loss. The VA dr who tested for Lyme also tested my blood but that line was left blank on the results as well. I ws given another C+P examination to see if my arthritis in my hips and my knees was being caused by my planter Facsciitis back in OCT but it was not mentioned by the rater either. A letter I submiited from my family Physician said I suffer from 3-4 completley prostrating mirgraines per month. The Rater rated me at 0% because there was no evidence that my migraines are prostrating it is noted that letter was used in the evidence in the rating letter as well. Did I just get a bad rater or what? Any Ideas suggestions I am using the DAV and they do not seem to be to interested other then telling me to file an appeal. I could really use some advice. I do have DR. who is willing to help me.
  8. Thank You. I just had one appointment for for my hip and knee secondary to my feet. No word on any others its been 9 months and they have really done anything. I called the VA and they see no appoinments waiting to be scheduled any ideas on how to spped it up or how long it should take.
  9. First thank you for answering. yes they are both in my claims folder and I will still hand carry a copy. I made a mistake they 2nd one also saild he reviewed my service medical records I giess i just forgot to type it in here. The first on just put military records hopefully that is ok. :D
  10. Hi my name is Chris I was discharged from the Marines for Planter Fasciitis of the left foot in 1999. I also have it in my right which is docmented in a couple of places in my SMR's. I also contracted Lyme disease also documented a couple of weeks before discharge. In my last visit to the Dr. in 1999 my Smr's show he said the Lyme disease was resolved and I was complaining of neck pain (sign of stage 2 Lyme disease). I also visited sick call in 1997 for shortness of breath, and dysphagea described as (lump in throat). It was also noted in my C+P exam though not filed on when I came out. The VA denied me in 2000 for Lyme disease said it was resolved though they ran no blood test and said there was no way to know since it resolved. On May 4th 99 after being in the field and getting ticks on me I went to sick call for nausea, vomiting headache right eye temporal throbbing, feeling wake and difficulty sleeping due to congestion. On May 14th I had a tick head removed from my ankle. On May 26th I was seen for N/V/D swollen lymph nodes and 2 erythemia migraines and actually diagnosed with Lyme disease. (Sorry if this is all over the place) Anyway I am a 10% disabled vet for left foot planter fasciitis. I recently filed a new claim and I have a C+P exam Oct 1st. Since then I have had a host of issues including migraines, sleeping problems, Gerd, stricture, allergies, asthma, arthritis. I have 2 different nexus statements one from my family physician that reads: 1st Dr Chris is a 34 year old patient at my medical practice who is plagues with bilateral Achilles tendon pain (just the left is in my SMR's). Bilateral planter Fasciitis (both in Smr's) Seasonal Allergies (notated by dentist in SMR"S) with asthma exacerbations and acid reflux that all began during his military service and are directly related to that service. As well he contracted Lyme disease during his military service in May of 1999 that caused fatigue and arthritis pains that still give him difficulty and is directly related to his time in the military. If you have questions please contact my office. All of the above information was obtained from Chris's military records direct interview of Mr Chris. The other reads: I interviewed and examined Chrstopher today in my capacity as a board certified family physician with a special interest (and training) in chronic lyme disease. It is my opinion based on the History and Physical and review of his service medical records that he contracted lyme disease during his military service. I believe that the infection is active his present debilitating symptoms, including: neck pain, migraine headaches, severe fatigue, migratory polyarthralgias and mild cognitive impairment are due to tick borne disease. I will order lab tests in attempt to support these asse4rtations but we need to bear in mind that Lyme testing is notoriously insensitive and clinical judgement is the accepted ultimate means to diagnoses. They are both made out to whom it may concern and signed by the Dr's. Do I have a chance with these any suggestions I asked them both to use VA language but they didn't. If the VA examiner doesn't agree am I screwed so many questions I am still really new to this any ideas or suggestions would be great. Thanks Chris
