  1. This denial came from Nashville. They said I was denied for Month of Death Payment because the evidence shows that the veteran was not receiving benefits at the time of death.......... What a bunch of illiterate poor performing baffoons! They said they used the Veteran's claim information to make their decision...they must have read it with their eyes closed, as he was 50% SC for PTSD at the time of his death. I really did not think they would waste everybody's time with a denial of this issue when the truth is in the pudding and the C-file. Anybody else lately gotten a denial for Month of Death compensation? Can you tell I am a bit fired up~

  3. my first thought on this topic - is that the form is no longer in use, why file it? Maybe form 10-2511 is the form you need. (http://www4.va.gov/vaforms/medical/pdf/VHA-10-2511-fill.pdf) I searched for travel reimbursement and this is the only one that applies. Sages, please tell me if this is correct!

With that kind of money, you could go through a reputable investment firm like Edward Jones or another financial advisor, and buy Tax Free Municipal Bonds (that's right - TAX FREE) like I did,that pay about 6.5% a year after fees in bi-yearly payments, and still have the principal left for when the bonds expire to invest all over again. You can take your tax free disability pension money, and invest it in tax free bonds, and come out a winner on both ends! I realize that 6.5% sounds small; the rate is 8% before fees, and look at what a savings account pays these days. My credit union is paying .7% - that is 7 tenths of one percent - on savings accounts. I invested $25,000. Fees were I can't remember - they were between $3,000 and $4,000. I will receive $2000 a year for at least 8 years - $16,000 on my $25,000 'savings account' minus the fee, and I net $12,000. And I still have the $25,000 I started with at the end of the bond life. Since I paid the fee up front, I get the $2000 a year which comes out to $166 a month. Do you see where I am going? You have all that money. You could invest $200,000 of your money in these bonds and net out about $1328 a month in deposits from your bonds TAX FREE. TAX FREE! If your bond goes more than 8 years - like double that, you can double your initial stake in 16 years TAX FREE! Municipal bonds are the most secure investment a person can make. You however have to be willing to forget you own that money except when receiving the bi-annual deposit of interest.... With the kind of money you received, you could get your pension, and if you can live on that, you could bank the bond interest and get richer without thinking! Please don't let some low life take advantage of you - Just a thought - hope this helps somebody, AkWidow

  6. Pay attention - if your evidence was not listed on SOC or SSOC, they did not use it...and you were denied because of this omission. If your ailment was not addressed in the SOC or SSOC, they are ignoring it. Get it all together again, with your NOD and send it in again with proper return receipt or date stamped copies as proof of receipt. I also sent mine in on a CD in pdf format..if they have one page they have it all because I put all the evidence with the NOD into one PDF file. If you don't know how to do a PDF, find out and do it for you! I will gladly give instructions if you have no closer source for information than me. Never give up! AkWidow
  7. Do I understand this thread to say: When CAVC vacates a BVA ruling, that it goes back to the BVA? Is this always what happens? Is this "vacate a BVA ruling at CAVC" the same as having the CAVA remand a case? Does then the remanded case go to BVA? or RO?

  11. when I got my bva award in 2010 jan(started in 2004), I found out that there was an open issue from 1968 that bva ordered ro to investigate, and that two cue claims were brought forward by me and to adjudicate them. waiting just a bit before i start chasing them. My original ro is anchorage, file was sent to St. Paul MN from bva.

  16. So how long does one wait after one asks VA to "Cue themselves" before one starts making more noise? BVA actually noted my CUE Issues in my award for DIC in January 2010. I have already provided all the evidence they need to make a favorable decision (and since they really screwed up on their denials, a favorable decision is the only logical decision to be made). My claim was sent to St. Paul, Minn for completion of the DIC, and as far as I know the file is still there. Anchorage is my home VARO. Just asking on this relevent issue....

  20. Go back over your SOC - Statement of the case, and see if they listed all of the evidence you sent them to support your claim. It they did not list the evidence, they did not read it. I have learned from the Sages here that if they deny your claim and they didn't list all of your evidence submitted by you on the SOC, you have to get them read it. If they didn't list it, appeal with the same evidence with a Request for Reconsideration or a NOD (Notice of Disagreement) you sent them the first time, and send it again certified mail or deliver in person and get a date stamped copy of everything for your files. Always remember - to keep your effective date - you must make sure you have filed a NOD within a calendar year even if you file a Reconsideration request first. If you don't NOD, you're effective date of original claim will be lost. If your evidence was all listed and you lost, get more evidence. Also remember that YOU are the one that cares about YOUR claim the most. YOU make sure the VSO (if you have one) had and submitted the correct infomation; and YOU make sure the VSO does things properly and timely; and YOU make sure YOU are as educated as you can be about claims and VA law. Don't depend on the VSO to be smart enough or diligent enough to care for YOUR claim as YOU should. YOU are the one ultimately responsible. If you don't know how to take care of YOUR claim, ask for help after YOU read everything relevant here at Hadit. Read, read, read and read some more. It is not an overnight battle for success in your claim. Took me six years and three denials to win mine. Never give up!

  22. I don't think so. I know for sure that Adeno Carcinoma is not an AO cancer. That is the one my late DH died from. Find out what exact kind of cancer you are asking about, then look at the presumptive list.
  23. I am so glad your DH is still with you - Now is the time, if you have not already done so, to dig in deep and ask all the questions you never asked before. If you have not got the treatment records from "VA Central", you could try to get those old treatment records from the location he was actually treated at - the hospital. Sometimes this will get you more. Were there providers outside of the VA that can verify the breadth of any of his injuries? Are there any old letters (which he couldn't write...) photographs of his injuries, or any other documented data that would prove the hand or other injuries? Start thinking sideways. I won my case with the help of two letters my late husband wrote home from RVN in 1968, which I did not have in my possession nor even know about for 40 years! (I changed my opinion about old girlfriends...) AkWidow
  24. Hard to believe, isn't it? When I saw my check in the mail I wondered why somebody didn't steal it out of my mail box....and even then I couldn't believe it was real. Save or spend it wisely ~
