From the GI BILL Website covering DEA: Eligibility You must be the son, daughter, or spouse of: * A veteran who died or is permanently and totally disabled as the result of a service-connected disability. The disability must arise out of active service in the Armed Forces. * A veteran who died from any cause while such permanent and total service-connected disability was in existence. * A servicemember missing in action or captured in line of duty by a hostile force. * A servicemember forcibly detained or interned in line of duty by a foreign government or power. * A servicemember who is hospitalized or receiving outpatient treatment for a service connected permanent and total disability and is likely to be discharged for that disability. This change is effective December 23, 2006. Hope this helps...

  5. When I got low-balled at 50%, I retained a NOVA lawyer. He helped me file my NOD and when I was awarded 100% without a hearing, he said no charge for his help. He is also my Social Security lawyer, and we are being fought every inch of the way. At the Social Security Appeals Council now, and should hear back in the next couple of months, as it has been there for a year now. My NOVA lawyer says that he will even take my case to US District Court, if need be. This is just to let you know that some lawyers can be committed to your case.

  9. I would consult a lawyer immediately, because the clock is ticking. Consultations are free. You only have a limited amount of time to respond to their letter or they will decrease you automatically - with the assumption that you agree to their BS. Just my opinion...
  10. Congratulations! Yes, you will be awarded 100% until your next exam provided something doesn't happen first. If you start back to school, that may send up a red flag and they will call you in for another C&P - in their thinking that if someone can go to school, they can get a job, and aren't really 100%. There is a long post about going to school and being 100% I recently read somewhere on HadIt. I think the gist of it was if you try and don't do too well, they can be used to prove your problems. But if you do well and graduate, expect your rating to go down when you get a job. Get your treatment on track first - or nothing will work out well.
  11. Well, you're already worried. The best advice I can give you is to go to your C&P without any preconceptions. The C&P will take place, unless you don't show up. You have no control over the doctor. I have always gone to my C&Ps, being honest and truthful about my conditions, no embellishments. Your medical evidence should already be in your file, but that is no guarantee that the doctor will look at it. Make sure your get a copy of the results, and if you don't agree with them, then you have other steps you can take; like filing a NOD, hiring a lawyer (that's what I had to do), etc... Best wishes...

  14. When someone calls asking for additional information - Make sure that the person calling is who they say they are. I know in my case, I had to fill out a form to send to the VA, because they wouldn't do it over the phone. I am really curious as to why they wanted your bank account #. I am not trying to be alarmist, but you can never be too careful with all of the scam artists out there.
  15. I recently filed for and received 0% SC for hypertension. It was well documented in my Service Medical Records (SMRs), but they never gave me any medication for it then. Since then, I have had to be on HTN medications since 1995. I never found the SMRs about the HTN testing they had done on me in 1985-87, until I received a copy of my c-file. I filed for SC knowing I would be awarded 0%, but I don't know what the future has in store, so I wanted it documented, in case cardio problems come down the road and then I can SC them as secondary; or in worse case, died of a service-connected condition and my wife can receive Dependents Indemnity Compensation (DIC).
  16. Mama Bear, Many people get assistance from Service Officers from various organizations or even Counties. I live in a County that has a Veterans Service Officer, who is very knowledgeable and has given me assistance in the past. Call up your County and see if there is one available. Then call the VFW, DAV, AL and see if they have an VSO that can help you. You are not alone. The paperwork that VA sends out can be quite intimidating at times. Hope this helps...

  21. The examination that the SSA sent you to was a Consultative Examination (CE) and a report was written by the examiner. There was also probably a Residual Functioning Capacity (RFC) written based off the consultative examiner's report. If someone at Social Security said that there is no report, then that someone was just trying to get you off the phone. You should be able to get a copy by going to your Social Security office, and asking for a copy of the CE and RFC (if one was done). If you had a lawyer for your SSA case, they should be able to get it for you too.

Veterans' Benefits Act of 2010 Section 401 - Increases from $20,000 to $30,000, effective as of October 1, 2011, the maximum authorized amount of VA supplemental insurance for totally disabled veterans. It is known as S-DVI. S-DVI and Supplemental S-DVI premiums vary depending on your age, type of plan (term or permanent), and the amount of coverage you select. Hope this answers your question...
