  1. My Question: Is there a certain form needed in order to make an amendment to a medical record at the VA? This as per CFR 1.579
  2. The best answer I can give you is to immediately contact a Veterans Service Officer or a Veterans Service Organization such as the Disabled American Veterans, American Legion or the Vietnam Veterans Organization. These people can help you at no charge. Good luck to you

Don't feel bad, I presented a laboratory report with proof of elevated level of exposure to dioxin from a well known toxicology lab here in the U.S., along with all the necessary medical documentation from a medical specialist and still I was denied by the VA. I also sent a medical opinion from a VA physician who indicated that my claim was "at least as likely as not, but the VA has the habit of dogging the doctors with addendums to see if they can change their minds on their opinions. Believe me, I have gone through the mills with the VA, but I am not giving up. Good luck to you :) agent orange

  5. Seems to me that you should contact a VSO as soon as possible and see if you can obtain copies of your service medical records and then go over your problems with him and to see about filing the proper claims to the VA. Go for it
  6. Berta: Thanks for your info. My claim went to the BVA and it is pure doctor dogging by the VA. When the BVA received my claim, they saw 2 medical opinions from a Gastroenterologist and stated that the statements were sufficient to render my claims as well-grounded under 38 U.S.C.A. 5107(a) West (1991). But since the regional office ignored this evidence, it must provide some explanation of its reasons and bases for doubting the credibility of such medical evidence favorable to my claims. The BVA then suggested that the regional office refer the contents of my claims file to a recognized specialist in the field of agent orange related diseases for a medical opinion. When I received a copy of the medical opinion submitted by the va physician, I did not agree with it, so I decided to contact the va clinic and ask if they had a recognized specialist in the field of agent orange-related diseases. I received a letter from a va representative at the clinic and he told me that there was no such specialst there. I found out that the so-called specialist was actually a physician-dentist. My story is long, but I am still fighting and will not ever give up until I fade away from this earth. The va has many ways and gimic's that they use in denying the claims on veterans, especially dogging the doctors.
  7. I already received copies of the complete C-File. I have all the favorable medical opinions and the letters dogging the doctors about the opinions. I believe that I will send a little note to the Inspector General with copies of the dogging situation and see what they have to say. Good idea
  8. How can someone complain about how the va dogs doctors who give favorable medical opinions. I have had this experience, at first a Gastroenterologist, a specialist, submitted two medical statements in my favor which the BVA said should have been recognized as well-grounded claims. VA regional contacted the doctor and asked for his credentials and a number of other documents saying why he thought agent orange caused my medical conditions. Then, a va physician gave another medical opinion that it was atleast as likely as not and so on, a favorable opinion in my favor. VA regional asked the va physician to answer an addendeum, which at last the va physician stated that nothing more could be said about my case. TO ME, THIS IS PURE DOGGING OF DOCTORS. How can we remedy this outcome?
  9. If a veteran has proof of a medical misdiagnosis including all the tests used in the diagnosis, how can the veteran amend or make a change to his medical records?
