  1. I did my first appointment, it was over 4 hours long with another appointment scheduled after Christmas. Most of the appointment was asking tons of questions and then a mini-physical. But I noticed the questions were geared to the C&P worksheets that I posted a link to. A word to the wise, take a copy of your medical records with you to your BA C&P exams. The doctor didn't have the C file with her. Lucky for me, I had a copy with me, it came in useful.
  2. I am about to go to my VA Medical exams. I found the following link to be very useful: http://www.vba.va.gov/bln/21/Benefits/exams/index.htm I am curious though, how much does my Army retirement physical taken last month play in the exams? I have multiple conditions which I did list on the physical as well as a ream of paper for medical documents, all of which have been copied and turned into the VA.

  4. All National Guard soldiers perform duty under Title 32 USC Section 502(f) unless placed on orders under a different authority. When Federalized, they are moved to Title 10 USC. Even when performing drill or Inactive Duty for Training (IDT), it is still under Title 32 USC 502(f). National Guard soldiers ARE eligible for disability claims that are a result of or directly connected to thier military service. As far as sleep apnea is concerned, it has to be diagnosed while on active duty as ordered by their PCM. This would be done while on long tour orders. I have never seen this done while not Tricare eligible. You can't just go on AT and go to your civilian doctor and be diagnosed. There has to be a CLEAR military connection.
  5. Hey everyone still on active duty or reserve that passed the MEB/PEB and found as fit for duty.... I have been discriminated against by my command and even disciplined by being barred from promotion because of limited deployability because the Army PEB found me as fit for duty. I did a congressional complaint and low and behold, policies were changed and looks like it may also cause regulation policy changes to include "disabled" as being protected such as race, religion ect, ect. You do have rights made very powerful by the Americans with Disabilities Act (ADA) of 1990 as amended by the Americans with Disabilities Act Amendments Act (ADAAA) of 2008. JAG's and IG's will tell you that you don't have these protected rights. Don't believe them. If your service is discriminating against you for your disability that you have been boarded for and found as fit for duty, see Title 32 CFR Section 56 under the Secratery of Defense. Or go to this link: http://ecfr.gpoaccess.gov/cgi/t/text/text-...r56_main_02.tpl Amazing how this section causes the stars to align. If you are being harassed, use this for your argument with the IG. Also, if you do a congressional complaint, use this section and you will get results. I did. I am retiring, so I had nothing to lose. It will help those behind me. It may even get me promoted back to January 2006. Good luck.
  6. I have been diagnosed with OSA and prescribed a CPAP. I have a myrid of documented issues. One I have a question is a condition called malignant hyperthermia. It is not listed in the VASRD but is listed in DODI 1332.38 or .39. It is listed with a XX99 code that points to the endocrine system. How would something like that be rated? It is a genetic disease but the National Naval Medical Center pathologists could not find the gene defect. Thanks,
  7. Hello, I am getting ready to retire with 20 years of AD. I was diagnosed with PTSD, severe depression, and Soma Pain Disorder. Does anyone know if these conditions will be rated together or seperately?
