  1. When I was approved for social security disability I received a dairy date of three years. My condition remains the same (major depression, PTSD, anxiety related disorder, hypertention, sleep apnea and psychotic disorder). I continue to see my doctors faithfully (primary care doctor, psychiatrist and psychologist) but I still worry about my continuing disability review. Can anyone who has went threw a continuing disability review provide some insight into what it entailed? I am 39 yrs. old and I worry about my disability benefits being cut off due to my age.
  2. Yes I am still seeing a psychiatrist and a psychologist. I am on ten different types of antidepressants for my PTSD, major depression, paranoia and anxiety. I am 38 years old and I think that my age will play a role in social security deciding whether I should keep getting disability benefits.

  4. Congratulations Bonzai!!! I was denied by an ALJ and I appealed to the Appeals Council but was denied there also. I finally got approved after refiling over again still waiting for my backpay which could have been for four years but instead I was backpayed for two years from the second initial filing. My attorney could have won on the Appeals Council brief but I don't think he addressed everything properly in his brief. So I got another attorney and won the second time around on a bench decision but in turn I lost two years of backpay by refiling over again. Congratulations Again!!!

  7. I received a decision from the bench yesterday in my claim for social security disability benefits. I have been fighting with social security now since 2007. The judge in the first decision rendered a judgement that I thought was unfair but the judge I had yesterday was fair, consistent and polite. Does anyone know when will I receive my backpay and benefits?
  8. I take fourteen different types of medication for depression and other illnesses. These medications cause me to be dizzy and drowsy most of the day and is a common type of side effect. Will the side effects of these medicines affect my social security disability claim in any way?
  9. My second ALJ hearing date is scheduled in July. I was denied at the first ALJ hearing and appealed to the Appeals Council and was denied there also. My attorney did an on-the-record brief for an on-the-record decision but I haven't heard back from the ODAR. My file has been transferred to a different ODAR office and they will make the decision on my ALJ hearing. I am considered a younger individual and I have two doctors stating that I cannot maintain a full eight hour five days a week job without any interruptions. What are my chances of being approved this time around and should I have my mother testify at the hearing since I live with her and she is aware of all of my medical conditions and how I act on a daily basis.
  10. My attorney is in hearings out of town and he won't be back until Friday. I quess I'll have to wait until then since I've waited this long. Yes I did use the pin that SSA gave me.
  11. My SSD disability case is currently awaiting a hearing before an ALJ. I've been checking the status of my case online and it has been stating "awaiting processing no further information can be given about this case". My attorney submitted an on-the-record brief about one month ago for an on-the-record decision. I've also been communicating with the ODAR to check on the status of my case about every three weeks and the social security representative would state that your case is being reviewed and no further information can be given. Today I called the ODAR and the social security representative stated something different she told me to contact my attorney for information. Is this a sure sign that my case has been approved on-the-record and I am just waiting for a written notice of approval? Any information from anyone on this topic will be greatly appreciated
  12. Does age have a lot to do with getting social security disability?
  13. Yes I am referring to SSDI. Both of my doctors have submitted RFC's in my favor but I was still disapproved at the initial and reconsideration level. Now I am at the hearing level hopefully I'll get approved at this level and yes I do have an attorney who is working with me on my case.
  14. I live in the state of Georgia. Why is there such a difference in the number of cases that are approved versus the number of cases that are disapproved?
  15. I was recently denied by the SSA Appeals Council so I decided to file over again because my attorney did not want to take this case to federal court due to the time and money involved. I've since hired a new attorney and he returns all my calls unlike my previous attorney. I feel a whole lot better about my case this time around. My SSD quarters run out in December 2011 so I had two options either drop my case or refile over again so I chose the last option.
  16. My SSDI case is at the SSA Appeals Council in Falls Church, VA. I contacted my Senator back in December and now my case is finally being examined by the Appeals Council. Although I do not know the outcome yet but it did help to speed things along by contacting my Senator. I am still hoping for a positive outcome when the Appeals Council makes its decision. I'll keep everyone posted on the outcome.
  17. The ALJ denied my case because he said that there is work in the national economy that I can do such as a greeter at Walmart. He also said that the medical evidence does not support a finding of being disabled although my doctor has diagnosed me with PTSD, major depressive disorder, paranoia and psychotic disorder.
  18. Yes my lawyer did send me to one of his doctors and he said that I cannot work but I was still denied at the ALJ hearing. My lawyer said that I can write my Congressmanl if I wanted to it is my decision.
  19. My appeal is currently at the SSA Appeals Council level. I was denied SSA disability benefits by the ALJ. Has anyone ever had to write their Congressman concerning a social security disability issue and did it help?
  20. Thanks Bonzai! I called SSA and they stated that if I was awarded at the initial stage that I would lose my original effective date, but if I won at the Appeals Council stage my original effective date would still be active and I would receive all the backpay to which I am entitled. If the appeal is won at the Appeals Council they would just erase the claim at the initial stage, but just like everything else that social security says take this with a grain of salt. GOOD LUCK on your appeal!!!
  21. I was denied at the ALJ hearing by a judge. I appealed the decision to the appeals council. My attorney appears to be incompetent because he didn't ask many questions at the ALJ hearing. My appeal is still pending with the appeals council. While my appeal is pending I reapplied for SSA disability. I read that you can file a new application while the appeal is pending at the appeals council and it wouldn't have any affect on the appeal at the appeals council. Did I make the right decision by reapplying?
