  1. They stated I did not meet the schedular requirements, even though I gave a statement that was the medically retired twice because SC issues.
  2. Receive the VAs response to my claim. It was denied for TDIU, but granted Temporary 100 from surgery. Just a question though. If my claim for Temp 100 was submitted in December and they awarded it in February, I'm I to be awarded for December and January as well? They paid me the difference from February to May, but not December and January.

  4. Understand. I request and increase for depression, and yes I have been seeing a VA doctor since July of 09. I figured as much on the MDD.
  5. In June of 2009, I was medically retired as a Federal Corrections Officer, and 2002 I was medically retired from the military. Both retirement were due to service connections. I filed for IU in June of '09, since then I have underwent TKR on the same knee. Along with the IU paperwork, I took it upon myself to inform VA in a letter that I was medically retired twice due to SC. I had to undergo a full exam of all SC conditions. My new GAF score is 52 from 60. My current rated disabilities or as follows; Major depressive disorder 10%, knee condition 30%, limited motion of spine 0%, facial scars 10%, clavicle impairment 10%, asthma 30%, hypertensive vascular disease 10%, limited motion of ankle 10%, limited flexion of knee 20%, limited flexion of knee 100%(this is probably because of my recent surgery)Total rating 90%. The opinion from VA ORTHO; "The veteran definitely is not a candidate for doing things like being a construction worker. He does have limitations as far as distance walking as well as standing. as far as sedate employment, there is absolutely no reason why he would not do well in a sedate employment environment". The opinion of VA Neuropsych; "It is recommend that the veteran be rated as competent for VA purposes. It appears that he is capable of managing his benefit payments in his own best interests". What are my chances of getting either IU or 100% schedular, or do I need to pursue other avenues.
  6. In June 2008, doctors at the VA Hospital in Houston placed me on a CPAP machine for mild obstructive airway. Since then I have been trying to receive SC for Sleep Apnea without success. When I look up the symptons, such as hypertension, sleepiness during the day, morning headaches, forgetfulness, and mood changes, are all that associate with me. I am thinking that while I was in the military, sleep apnea was there, but I did not know what it was. I have been denied on at least 3 occasions for SC. Any guidance is appreciated.

  10. As of 5 June 09, I was medically retired from the Bureau of Prisons. This is actually the second time being medically retired. First, after 16 years of Army service and now only after 6 years of Bureau service. Can anyone give me the skinny on the IU or TDIU? None of my ratings are over 30%, but my major complaint was due to my knees. In August, I went through the painful event of knee replacement. About four weeks ago, I applied for my C-file, and I also in the process to file for the scar left by the surgery. 30% Left Knee 30% Exercise induced Asthma 20% Patellofermoral pain syndrome right knee 10% depressive disorder 10% degenerative joint disease, left knee 10% Impingement syndrone left shoulder 10% right ankle 10% Hypertension with erectile dysfunction 10% pseudofilliculitis barbae 0% Thoraic spine strain A
  11. You can't get both, but you have choose. The VA is tax free and the military is not.
  12. I started out with problems on my left Knee. Diagnosis was Degenertive joint Disease, and eventually the right Knee was failing due to overcompensation. I went through the a series of shots and scopes, and also had to wear a load bearing brace.Recently, I had to undergo knee replacement. Ensure that u see an orthopedic doctor, echo what your private physician is stating. If you are able, also see a VA doctor, so all doucumentation is there.
  13. I am proof of this. I had this surgery done in August of 08, although it took almost 6 months to receive compensation, it worth the wait for backpay. Yes I am receiving a Temp 100%.
  14. Roger that, this is true. I received a yearly clothing allowance for a load bearing brace.
  15. File for bilateral, anytime one lower extremities being to fail the other is not far behind. I was diagnosed with DJD (Degenerative Joint Disease Left Knee), basically no cartlidge. Eventually my right knee began giving me problems, because of overcompensation. I have went through 2 scopes and 2 sets of injections. Finally at 39 years of age my left knee was replaced.
