  1. I just received a rating for 0% for cirrhosis. based on I'm at 10% for HCV. I have copies of lesions on my liver. Varices GERD and Hypertension. Now if I send them the new evidence will they adjust the rating. or will I have to appeal the whole thing again? I can't under stand there reasoning other than they might not of had that information at the time of the rating. I will of course send a NOD. as well as the evidence. Is the VA broke?
  2. I'm On SSA for depression related to HCV. As of now rated at 10% service connection. I used my VA Psychiatrist to get my SSA had no problem getting it. But when he wrote the same to the VA they say I'm improving. I have Cirrhosis ESLD and I am improving? My cirrhosis and depression were held in remand. They denied the depression as I am getting better according to them. The cirrhosis it's supposed to be at POST now. They have also denied PN GERD. My VA Dr says my only cure is a transplant yet they are still dragging it out. I filed in 04 got denied my HCV. But got the nexus to prove it after 4 years. In 2008 The VAMC dxed my gerd PN and dpression. And the stage 4 cirrhosis by biopsy. They seem to be holding the cirrhosis hostage as it ties all may ailments into one package. If cirrhosis with gerd and leisions is not disableing what is? I suppose they hope I will expire soon.
  3. Ya gotta just love those. I have been through this before. I called em once a month it drives em nuts. I have had a remand in there since 04 it's just now in post. It appears that they now have all my ducks lined up and are getting the legalese written down before they send my rating. Or deny it. Then back to the VARO for round 4. As my condition worsens. The closer you get to 100% the worse it is. But that's just an opinion.
  4. Thank you thats exactly what I wanted to hear.I will be at the VARO in SLC on Monday with all the paper.Including the 2005 SSOC that should have been granted. When I won the Hep case.
  5. Back in 98 I filed and won SSA for depression from hep c. With the help of a lawyer and a VA Dr I won the SSA case. I have since filed for Hep C depression and cirrhosis with the VA and was low balled at 10% for HepC. With the depression and cirrhosis remanded. They are at the AMC waiting for a rating. My question is they VARO has know since 2005 about the depression issue as stated in my denial in 2005 on a SSOC denied because my hep C was not granted at that time. I have been unable to work since 98 from depression related to hep c. Now I have cirrhosis, Peripheral neuropathy and GERD all diagnosed by the VAMC. Can I file for TDIU while waiting for the rating on depression and Cirrhosis? All of my Dr's were from the VAMC even the one that won my SSA case. I have read through the TDIU post but cant find any thing like this. Thank's for any info guys I'm at a loss here
  6. I am connected for hepatitis C at 10% from ignorance of a C&P. I claimed Cirrhosis and depression as secondary to hepc that is that is still in remand. Now I sent a claim for periphreal neuropathy to the VARO for Periphreal neuropathy diagnosed by the VAMC themselves. Now instead of rating the PN at the VARO they have sent it to the board of appeals. Why should I have to appeal a case that they discoverd themselves? What do you do with a VARO that wont do their job? Thanks Rob Davis
  7. Hers one for ya, I filed a claim for DDD as it states I had chronic back pain in my smr's. It also stated a vague kidney disease. They performed no tests except for an X-ray that showed a renal cyst which I still have. But are denying DDD of which I have no less than 4 mri's that prove this issue. But they were done after discharge The ssoc I have states that I fell off a ladder in 2005 it was of substantial significance according to the C&P examiner. The only problem is I never fell off any ladder in 2005. It was 1996 and I had a contusion. With the mri stating ddd that already existed. How do you win with logic like that? I suppose the answer is the same perfect your claim with their own handbook. And check with IRIS every 90 days for the record.
  8. I want to thank everyone. I have got them to see the light. I have a C&P for cirrhosis on Tue the 7th I have pictures of the ultrasound on my liver and the VA Dr's statement saying that the cirrhosis is from HCV it should be a slam dunk. I am rated at 10% for the hep it's natural progression of the disease from reading the rating codes that and acid reflux should be 100%. Without the depression added. We will see.
  9. I think I'm just jumping the gun a little it's all there now just the way they like it. I used their own Dr's for the nexus letters so they both say it's hep c related the only thing is they didn't have the copies from 08 they stopped at 2005 as far as my liver went to rate my first claim. It has progressed way beyond what they first saw. I have to remember my patience.
  10. I have searched every post I can find for an answer. Can't find a one like this. I was a Corpsman from 73-75 never in SEA but got stuck by enough needles to get the disease. I filed a claim for Hepatitis C with Cirrhosis and Depression as secondary to Hepatitis C. I was denied of course but persistence paid off and I was awarded 10% for HCV on 6/9/2009 the Cirrhosis and Depression have been deferred for additional information or evidence. Now comes the part where I am lost I have been on SSA disability for 10 yrs for depression. Had all my qtr's in. I have sent the AMC the Dr's nexus from the VAMC in SLC for cirrhosis showing it's from HCV. and the award from SSA. The VAMC mental health Dr got me connected for SSA by his report. I sent the AMC that as well. Now should I file for TDIU or wait until they decide the deferred issues? It should of been 100% from the time they granted the SC for HCV. My claim was one of those that fell into a shredding machine by accident.
  11. This is my first post. After seven years I managed to get my sc for hepatitis c on Apr 24 09. I was a corpsman from 73-75 in the Navy. I wrote a note to IRIS asking what the rating was and in the reply I received It states that the Appeals management center has my my C file for a rating. I claimed depression and Cirrhosis a secondary to hcv. In 2006 the VARO denial in SLC agreed it was attributed to hepatitis and cirrhosis the same thing. But they were not allowed to let it in because the hcv was denied. I suppose my question is how long is the AMC going to wait before they let me know? I'm sure several of you fine people have been here before but I cant find a post for this. Thanks Rob
