  1. I keep seeing my diagnosis made by many, many VA doctors and surgeons altered by the VA claims and appeals process. Example, I had/have a large cyst on my pancreas and ended up with necrotizing pancreatitis. Plus six months in the VA hospital fighting for my life and then homebound and in a wheel chair for another year. Also may other medical diagnosis including Budd-Chiari disease. And much, much more. Some of the people working at the VA have changed the words to chronic pancreatitis, not even close to necrotizing. The surgeons diagnosed me 100x with it, no wiggle room for a different diagnosis. But, often I find them altering my records. I have caught the emergency room flat out lying tooo at another VA I go to, and I had along meeting with my doctors about some of the many abuses I get. I can't even start to list al of the lies and problems. My BVA case is on the second remand back to the R.O. because they never followed the BVA judges orders. I am so jaded I don't see any good coming only the same problems and more. There are no consequences for the bad people in the VA. IMHO
  2. to those that have words of encouragement, and suggestions, it's been at the BVA for a few years and in the 2nd remand.... since my first claim in the 1990's I have been through so much, so many doctors, so many poa's, doctors, consults, hospitalizations... there maybe something that I have not yet submitted because I either overlooked it, or have not me the right person. I have gotten excellent wonderful free and paid advice, and follow the advice when I can, except when the cost is impossible/impractical. I still have time to add evidence, while at the BVA. The latest remand can take many more months, but no one really knows. The BVA judge I saw I like, and although I have no clue which judge will eventually wrap up my case, the BVA were and are good to me so far. I have 2 professional helping me at the poa level, and excellent help here in these forums. I am very far along and this whole process has been killing me. I hate to be a dram queen but I suffer from fatal diseases, but so far have beaten the odds. I am too sick to continue and can't deal with anyone. I come across as not cooperating, but I am so sick every moment of every day I am living hell. Suffering in hell. The meds help me live but only kill some of the severe pain and suffering. I have insurance to help my wife in case the keep dragging my case on and i die of go back to a state of not being able to care for myself again, like before. I reached the end of my rope along time ago. I cannot think straight any longer. I am just waiting for the disease(s) to finish me off. I am so wiped out, I drag myself out of bed just to perform the daily bull, crap. The VA will either screw me, again, or grant me what they tried screwing me out of. The surgeons told me to watch fro jaundice and strokes as the diseases continue to finish me off. My pancreas is dying and the cyst leak causing the acid to burn me everyday. They grow and close off my food and cause great welling of my belly. The veins and arteries to my liver and heart often slow the blood and make it feel like i am wearing an anchor being pulled down with every breath and step. I told the VA I want them to speed this up but I think that they keep changing the names of my diseases to lessor versions of the disease on purpose to make it sound like I am not as sick as the doctors and surgeons wrote in my prognosis charts. As, I asked for my claims to move faster because having fatal diseases I can die at any time. The VA is suppose to take this in consideration for people that are very sick. The VA did not help at all when I listed the fatal diseases. The claims move as slow as they every did. I truly believe the BVA judge is good to me, and that I have the evidence and nexus. I just am too sick to be put through this abuse, the VA put's vets through. Necrotizing pancreatitis, Budd-Chiaria syndrome, Splenic Vein thrombosis, neurological diseases, high anxiety, and more. If I am around for a while, my best days will be the winter, I need cool clean air and rain. and quiet peaceful days and nights. Thank you...
  3. again, the BVA judge understands my claim, and had to remand it back to the R.O. because they refused to answer all of my claims.... the BVA judge spelled out of the issues he is asking 'the Regional Office that denied me', to address these many issues... long list... in the remand, the first time he sent the remand they didn't answer any of the questions he listed. The 2nd time, he sent back a more detailed remand with al the issues spelled out asking for details on decisions... The last remand took 1.5 years.

  5. I appreciate offers... I cannot be 100% sure that it was enough proof, but I have given the judge proof of exposure and illness while on active duty. It is in my records of illness caused by exposure. But, the R.O. office ignored it. Also the R.O. was arguing whether or not the doctors I saw on active duty listed all of the chemicals or just some of the chemicals. regardless, the doctors were told what chemicals I was working with when I was injured. Had I not been injured while on active duty they would surely weasel out. The BVA judge asked me about al of these issues and in the remands stated that the regional office ignored the requests in the first remand, regarding the chemicals. The judge stated the chemicals by their names known as when using them on the job. He did this in person in front of me at my BVA hearing. At the DRO hearing the DRO Officer actually said, 'the study that came with your IMO was done on animals, but not humans so they can't use the IMO'. That is insane, as if they will soak a human being in chemicals for a study. That is small part of the abusive B.S. I got at a DRO hearing. I am as confident as I can be that the judge is looking out for me. It is the VA claims at the regional office which are flat out lying and ignoring facts. yes, facts, I am not using the term lightly. I had the DRO officer lie in front of me a few years back in a DRO hearing. Nothing can be done, short of someone kicking his ass. I really hope the judge either forces them to see facts or bypasses the R.O. with the proper decision(s). I can only think of affidavits from other people who worked with the chemicals could say whether or not they had contact, and how much contact, and how often. Also, whether they were sick and injured on active duty or the injuries were documented long after. Unfortunately many health issues can occur many years later that are caused by chemicals. I read that one of my diseases is caused by the chemical ethylene. I have Budd-Chiari Syndrome. it is in my VA medical records. I have 3 very rare diseases from all of this (Necrotizing Pancreatitis, and Portal and Splenic Vein Disease, and Budd-Chiari), and have lived much longer than the surgeons told me, as they are all usually deadly in around 5 years. One is 3 years, other 5, and all together.... ???? Since I didn't smoke or drink, they cannot beat me over the head with those excuses. I noticed they will actually come at you hard and beat you up over issues if they can link them to behaviors. They interrogate, harang, harass and dig trying to trip you up and say you did stuff which they will try to link to disease and injuring. I have had them harass me endlessly in person demanding to know what I worked with and if I did any o drugs, smoking drinking. I was interrogated every morning in my hospital bed for 6 months as they drilled me about jobs I had, what the mark are on my body, and everything else. I have been interrogated at the VA meetings, by doctors, at C&P's, and they are always trying to make me say things to their benefit. It is horrific the abuse they pull. There are boxes and boxes of records of every word and action that happened while I live in a hospital bed for 6 months, plus the months that VA nurses treated me in my bed at home. They wrote down every word I spoke. Every time they poked me. The Regional Office holding my claims have al medical records to when I was a child, all the way until now. Yet, they say they don't have documents. BTW, look up what happened to the people who invented lead gasoline (to stop engines from knocking in the early days) and how congress refused to make it illegal even after lots of people got sick and died. It took many years later before leaded gasoline was removed from the market. Lots of people gave their lives and suffered greatly from exposure.
  6. they are moving, but moving back to the R.O. again... realize that the main issue was originally filed in 1996/1997. Denied.... then refiled with tons of new evidence in 2009. The evidence includes old and new, because they never reviewed the old evidence, that's why the judge is telling them they did not follow his orders, in this new remand. Definition of moving, is different when you have a fatal disease. Like I do. This is what the surgeons told me. Not making this up. One doctor told me I am the only person with this disease that hasn't died from it, yet.
  7. My VA rep and POA said the judge remanded it because the VA didn't explain their rational for denying me. I was also told that I may or may not have to go through (or repeat) more C&P exams. This remand is for the VA R.O. to clarify, and to use professionals for the specific health issues, and not general med doctors, and to explain and read al of the medical records, as the judge thinks the R.O. (VA Regional Office never read all of the pertinent medical records.) Apparently the BVA judge is sympathetic to my claims. So says my rep (Power of Attorney VA Representative). I can still submit additional evidence. My POA also said is suppose to be expedited, but does not know if it will be months or years for the remand to be done and back at the BVA.
  8. Here we go again, looks like another remand. The BVA judge says the VA R.O. did not follow directions. Maybe the BVA judge puts everything in perspective so they can fulfill the requests? Like bullet points on each subject and what the outlive of each is. It looks like the R.O. never looks at the evidence and the judge keeps telling them to read it and use it for their decisions. I really don't understand. I try to understand. I wish the judge would just make final rulings, and stop this charade with an incompetent VA R.O. Anyways, I received the letter on a Saturday, VA BVA dated this long large letter 08-09-17. I sent copied to my POA. Also a copy to John Dorle, to keep him up to date. Let's see if I can stay alive long enough to see this through to the end. I am housebound. I told the doctors that at the BVA. Even if I had the itch to go outside, I just need to come back in and lay down sick. The summer with the heat has been cruel. It is horrific to me. I need cold air to blow off fevers. The pancreas is again more hellish pain and swelling. The VA up in Portland is not following the surgical team plans and how to treat me. The blisters I have and had appear to be diabetic blisters, but the VA lied when I went to the VA doctors and emergency room. I have no confidence, as the necrotizing pancreatitis is very rare and these people are like shaman witchdoctors at the VA here. They have no clue and lie, and if you try to talk they treat you like you are clueless and they know all. It's all Hell. I appreciate the Hadit Forums and the good people and wisdom, and so many of us are put through hell because of the total incompetence of this so called fixed V.A. btw, one of the VA CPA exam doctors asked me, out of the blue, if I was going to kill myself.   11. I understand you have concern, and want the best for us all. I am at the end of my Journey, I hope the BVA has my stuff, already saw them one, then had a remand, then back to BVA...I am awaiting the word.... the final word... (I have already been through all the crap they do to u,s for decades of abuse)...
  12. I am still awaiting for the BVA to make decisions,, my claims have already been returned from remand to the BVA. Awaiting...... my BVA hearing was March 2016.

  13. I just saw this post, or maybe the first time around I didn't understand... in any case, there is no doubt, no misunderstanding, it's all in my medical records... from active duty. The BVA judge acknowledged all that the R.O. ignored.... see the photos of my medical records... yes, that is only part of the records, there are more now... (see photo attached). What isn't going to cut what?
  14. I am still waiting for the BVA to continue, they told me that I had until March 2017 to include more evidence, then a 2nd time I had until June 2017 to add more evidence. The remands were returned back to the BVA from that R.O. Unless they remand it a 2nd time, hopefully the BVA judge will make a ruling. I can chat about how the C&P's were a farce, and rant about more, but no point. I did include more evidence, which I stated the VA was given from another doctor I saw for dental surgery, due to intestinal disease (1990's). The judge had asked if I ever put claims in for dental (I didn't because I was told I didn't qualify.). I had an emergency condition where the VA refused and told me to get out of that clinic, because I wasn't covered. So in the 1990's I had to go to a dental school to have my jaws operated on because of trauma and dental problems from melting teeth from the intestinal disease that took the enamel from my jaws and teeth. The BVA judge wanted to know if I had filed a claim about the dental, regarding Intestinal disease, The dental surgeons had written in my treatment 'due to intestinal disease. VA Claims refused to accept my intestinal disease claims in 1995, (denied for all but headaches from jet fuel) even though I was hospitalized on active duty for gastritis and chemicals. Fuels. Also, again the Judge acknowledged the VA refused to acknowledge all of the chemicals and left those out of my claim. I was so very happy with my BVA judge at the BVA hearing in 2016. But, he remanded it back to the original R.O. He also motioned he would move my claim dates because of my medical problems and hospitalizations. I wish the same judge would give me a decision, but after all of this time, who knows. As usual, I am just laying around sick, I hate the heat, miserable, very sick with necrotizing pancreatitis, and summer heat sucks bad! I want winter back! I need cool fresh air!
  15. I read the excellent and help and advice given, but am basically just waiting fore the BVA judge. I did include more evidence before the deadline, it was support through a form from a dental surgeon that agreed the teeth were destroyed by intestinal disease. I did not file a claim because they denied my claim for the intestinal disease in 1997. But I included the form from my records, although I had given the VA copies of those dental surgery records in 1997. The regional office kept saying there was no evidence of intestinal disease even though I was treated for chemical injuries and gastritis on active duty. So, even though it was in my VA medical records I added it to my claim when the remand was sent back to the BVA judge and they said include any additional evidence before that date. So my POA took my long letter I wrote and included the additional evidence, to the BVA judge, that did my BVA hearing and remand.. This was March 2017. Of course I have more evidence, that no one reads. They expect me to read boxes of medical documents and outline info for questions they only ask to try to trip me up. The VA regional office actually asked why it took me so long to file. I said I never delayed, I begged for help the whole time, and was denied care. My primary care doctor at the VA was well aware of what I needed, but he was of no help. I asked and begged and most office and clinics told me to get out and I didn't QUALIFY FOR MEDICAL HELP. It pisses me OFF when the claims office asks why I delayed my claims, when they refused me every step of the way. And every time I went to file a claim there was a 6 month wait to talk to someone, or that POA disappeared and would have to a start over with a new one that had no clue. I read these forums and really take the excellent advice and try to ask my POA, but I am at a stage in the process that I can still submit evidence. But,, I can never find the proper doctor to write a new IMO for my type of injuries. Short of a New IMO to add, I am still happy with the BVA judge hearing I had. of course I can't read minds. My wife asked if the same judge makes the decision that help the BVA hearing. I don't know, I don't remember if anyone ever said the same judge makes the decision. That would be nice, but realistically, I don't see how, people move and change when years tick by. Again, Thank all of you guys, and when I hear something, I will let you guys know!
  16. I am reading and see, but truthfully,,, I am so sick of this VA mess... I fee so horrible everyday, all day...I appreciate al of the help, I am just malaise in fog of pancreatic disease and morphine for pain. it al needs to end, the pain and disease were suppose to not last this long, the surgeons said that the next step is cancer, from necrotizing. And the hell of the claim process which is horrific on anyone. Again, thank you all. I wait for the end. eVERYDAY IS HELL OINA LOCKED CAGE. i MAKE THE BEST OF IT. i STIL TRY TO WALK, I TRY TO EAT. I thank al of you for your help. The end of the process should come while I am still alive. I don't know, everyday is hell. Thank wonderful people. You helped me try to get through this crooked rotten claims process with crooks running it. Guilty until proven innocent. Yes, I am so jaded that it probably looks horrible to anyone reading this. How much can a person take before they go insane. Waiting for the disability claim or the fatal disease to finish me first. Thank you, wonderful caring people. At least I made it this far, without giving up!

BVA judge has had my documents back from the remand, for 3 months (March 2017), I also included a letter plus a copy of a document from medical treatment I received many years ago, showing the treatment and gastritis that I was treated for, on active duty USAF. was also part of the cause of tooth disease which caused a surgery done at a hospital a few years later to remove all teeth in one surgery because of the damage from intestinal disease. Of course those medical documents were all sent to the VA back then (20 years ago, during my first claim which was denied) and listed but the VA never looked and reviewed these documents. so I included another copy to the BVA judge.
  18. Ok, so, where it al stands, saw my POA. Wrote a letter, added more proof, evidence from the medical files. This evidence was never included, but was sent to the VA in the 1990's. This letter and additional medical evidence was sent back to the BVA judge before the 30 day deadline will be up.. The judge will now determine my fate. The C&P's were of no help. I also have more serious health problem, I had femoral artery balloon up in my leg and groin area a couple weeks ago. I am trying to get help for that, after a bogus and unhelpful emergency room visit, plus 2 more doctors. Plus photos of one more time when the other artery on the opposite leg bleed out into my groin. I have the partially blocked splenic vein. The emergency room totally lied on my visit forms. My primary doctor finally said he will take a second look at my leg, I had clots form when I was in the hospital bed for 6 months. He refused to send me to the proper clinic every other time I begged for help when I told him about the clots, and large lumps in my leg. The whole nightmare is unbelievable. I am convinced the VA , at least up here in Portland is rotten. The regional office (San Diego) only copied their last denial and sent that back to the BVA judge. I suppose sometime this year the BVA judge will rule. I am so disgusted, so sick, so pissed... My POA said the judge will decide. Period. I don't think anything I can say here will help anyone, I can only say thank you. Thank all for the help.
  19. Thank you, I am seeing this, but need to come back in a little while. I need to continue on my list for my next meeting with my POA. In next few days I will be back. This is so hard going through all this.. I am too sick... I have a very hard time thinking... thank you again for looking up more helpful information!
  20. I am meeting with my rep, POA, next week, We are going to assemble and write a letter to the BVA. I am going to take all my records... many boxes of the records. if I have to I will submit all the records the VA is suppose to have. They have all of them already. They have my records and al other medical records going back to my childhood. if I send them my records I would have to hand deliver the boxes, as they fill the trunk of a large car and the backseat. My surgeons talked to me every morning 5-8 a.m. to discuss my prognosis and treatments for several months as an inpatient. (6 months 2008) They were the top surgeons, and also worked at UC SAD Diego medical center. They shared with the VA San Diego. They would ask me every morning about what I worked with that got me sick. I explained my job, and the chemicals. They constantly told me the only way to get the diseases I have were from alcohol or toxic chemicals. It is hell going through thousands of pages, but I will find anything pertinent that was written down in my notes. The doctors and nurses made notes about everything I said and did. I hope that doctors conversations with me are in there. The notes are broken up into each area. Labs, treatments, tests, etc. They are in zerox copy paper boxes. I also have everything else going back to basic training, SMR's, etc... Then at one time Kaiser hospital did some work in the late 1980's to the mid 1990's, then the VA. They kept telling me it was in my head, then they finally saw a 5 inch cyst on my pancreas. the surgeons told me, the only way a person can get these conditions are from drinking or chemicals. They kept digging and digging everyday, interrogations every morning, imagine fighting for life, laying there in a bed, unable to move without someone moving and bathing me, unable to eat for 6 months, and have interrogations every morning. Then to have these horrible people in VA claims trying to get me to die or give up.
  21. BVA sent remand back to regional VA, they failed to follow the judges directions. They only copied what was in the first denial, and did not meet the conditions of the BVA judge. They totally ignored al of the injury and chemicals that got me sick. They did not use any of the missing evidence the judge stated in the remand. I am asking my POA to help me craft a letter to the local VA and BVA, specifically citing areas of failure in the SSOC. I know my case is complicated and very lengthy. I worked with chemicals and got sick on active duty. I had skin disease and was also hospitalized for gastritis, while on active duty. I got sick from jet Fuel, Leaded Gasoline, Diesel Fuel and Trichloroethylene. The denial only listed Jet Fuel, and they never addressed the other chemicals , never, ever, in any response to my claim. Not di they acknowledge my hospitalizations on active duty. All were omitted and never responded to which were also listed by the judge in the remand. I am also the one who spent six months in a VA hospital with a dying pancreas. After I moved from San Diego to Oregon, after being treated for 20 years at the VA in San Diego, the care has been lacking and not nearly as good. I am having more complications, so I don't know how much longer before the next medical emergency. I just had one where an artery swelled up that was blocked and I bled internally. I have budd-chiarri disease, Splenic vein thrombosis, and necrotizing pancreatitis, arteries are partially blocked to the heart. The femoral artery from the leg through the goin swelled up badly and bled inside of me. The doctors screwed that up and try to say I has skin infection. but nothing could be found from a scraping and microscopic inspection plus waiting 6 hours in the emergency room, they told me to come back if it happens again. It happed again, this time I took photos and of course my doctor was gone (vacation?) and the fill in doctor was worthless. It showed a very blood red and blistered area where the artery passes from the leg to the body. By the time I drive and sit the swelling goes back down. and leaves blood inside where the vein leaks. The doctors are clueless up here! The VA is a nightmare here. I would also like to get another IMO. My last one form a Toxicologist doctor was hard to find and extremely expensive.
  22. well, mine is complicated, but my BVA hearing was March 2016, and all issues were remanded.. I had some C&P exams in 2016. I don't know if it will take another month another year, or more... no clue. I guess it has no time frame at all, even after a bva hearing... my original claims were in 1997. My next set of claims 2009. BVA hearing was March 2016.
  23. well, my reps, a VSO and J.D. 'both' said hold on for now, let the process of the BVA go through.. But the contractor never sent me the' FedEx' package they said they were sending, and just nothing since that last communication about exams. Just dead silence, and I have no clue what's going on.. IMHO is that the surgeons who operating on me were from both the VA and U.C. San Diego, who were/are the top surgeons in the field of pancreas disease. Plus my Budd-Chiari disease is only 1:5,000,000 people, add the necrotizing pancreatitis and there are only a handful of people in the world with it and surgeons who work on it.. So Rare it is, they probably cannot find anyone else with that specialty. So, they have the medical documents form my 6 months as an inpatient from the best professionals available. They had deep chats with updates with me and my doctors every morning and after ever test and procedure, they asked me point blank dozens of times what I worked with when I got sick. They know my field of work on active duty was chemicals. They asked and I told them what I had contact with. It's written in stone. So, if they are just in a quandary trying to find experts, they already had them working on me that whole time and they wrote the reports. If they sent me to regular doctors then decided that was a mistake, like the BVA judge said, they sent me to the wrong doctors the first time my clams were denied and they left out all my records in the decisions. I am just waiting for them to send me to new exams again I guess. I don't really know because no one is talking.
