  1. Is it a standard format that the rewards letter state no further exams neccessary for a I/U PT claim. Does any other members have any insight. thanks

To answer your question if you submit claim for I U and you haveone rated disability at 60 or higher you can submit for iu also if rated 60 70 80 90 and claim for iu is granted it all pays the same. If claim is a granted one and a permament and total rating is granted then there is some benefits that go along with the P andTotal. Example some states no property tax or tax on your vehicle also education benefits for immediate family and free dental coverage under the project hero program with detal dental. Somewhere on the threads there is abreakdown on total requirements such as 60% on one common disability or a combination of several concerning a common aliment. I believe if you look at myposts i included at one time. Best of luck this is the place to find your answers i learn from reading all the post.
  3. B) Good news to hear a brother Veteran get what is deserved also GOOD news to hear a fellow Seabee get their well deserved benefits. Sorry to hear they forced you out at 18 years it was a close one for me but i got my 20 ALSO I WAS IN THE UNIT.Congrats Seabee for life
  4. I was notified by my advacate (American Legion) that my Claim was approved 100% PT Chap35 benes no futher exams. I discovered this forum when i submitted my claim back in Oct 08 also I was told a retro check is cut back to the application date. I read the complete forum back and forth andthe stories and advice submitted helped 100%. I am taking this time to tell how it materalized just in case it would help a single veteran with a pending claim or one inthe future. I am in receipt of CRDP and rated 70 % all for orthopedics defects the highest 30% for back and knee condition, Important point, Sub paragraph 4.16 if disabilities effect one common etiology or a single body system e.g orthopedics: compensation may be assigned where the schedular rating is less than total when the disabled person is in the judgement of the rating agency,unable to secure or follow a substantially gainful occupation as a result of service connected disabilities. I contacted a lawyer in October and he said i wouldbe disapproved because VA does not normally approve on this issue he was wrong. I had applied for IU and SSDi had same time and have a lawyer for SSDI and that has been appealed to the hearing stage. The lawyer had forms i took to both treating Physicans, Functional appitude forms stating how long i can sit , lift walk reach etc also both treating Docs gave there opinions(imo) both stated no working one being family doctors the other Neurosurgeons that did my operation. Family doc wrote Permanent and total. With Emg testing and a current MRI showing my back getting worse also CP exam docs opinion which can be read on CP tab along with years of seeing Doctors and Specalist. My two cents on how my claim was approve I believe is simple 1. IMO 2. Documentation, I hope this narrarative helps a single Veteran with there claims because no matter what with all the other B## S*** happening in this country every one of us has stood the test of time in serving the USA. B)
  5. <_< Does anyone have any ideas why VA wants to schedule another C and P exam after initial one on the 10 of june. After being told it was initially rated in July. Knees were diagnosed differently than a reconsideration claim in 2007 where I was awarded a 10% increase also same knee was increased 10% in 2006 But, DDD and nerve problem is consideably worse. Can i turn down Exam and what would happen if i indeed turned down the exam Iam tired of the B### S### any ideas and has anyone encoutered the same.
  6. Was told by the 1-800 folks that my claim cleared the RO as of yesterday, and was sent onto the second tier and that their was no outcome listed. CAlled my American Legion rep and was told that their is no outcome listed as of yet. Does anyone know if this sounds right at first I asked the VA rep if my advocate would know the results of the RO decision she said they would then she said it was not listed. At what stage would the VCE know the outcome and or the 1-800 folks. Basically i remember reading somewhere where the steps were listed but,can not find it to save my ###Again thanks for the tremendous help this forum provides.
  7. Please read 38 cfr 4.16 it says that if all your disabilities affect a single body system (such as orthopedic) and add up to the 60% that you qualify for IU.

  9. In 2006 I had a C@P exam done for a increase on a compensation claim. The Nurse practional noted a laxity on a ACL operation I had in 2000. The rating result was they increased my service connected % from 20 to 30. In June 09 I had another C@P exam for IU and the neurologist stated he did not notice a laxity in same ACL. I know these conditions do not magically heal themselves but wondering If VA will not take into account the latest EXam results. If anyone on this very helpful forum has experienced same sure would like to hear about it. Thanks too all that protect our freedom.
  10. First this is a excellent tool to help us old veterans manuver thru the VA minefield thanks too all. OK my question is my Doctor statements B) "Based on review of the service medical records, and current examination findings I feel it is most likely that the veteran is unable to currently engage meaningful employability secondary to service connected conditions". Has anyone seen a statement like this. Also on the bottom there is another :) "Unless otherwise stated in Addedum to Joint,Feet and Spine worksheets:this C@P report, no painful motion was objectively noted and on repetitive testing range of motion values were unchanged from baseline testing without pain, fatique, weakness or coordination" . Are these statement good for my claim anyone with experience with this B S'' '' '' " I would apprecaite your insight. Thaks too all.
  11. :) After completing C@p exam was told my claim was sent to rating board now they tell me they requested my active duty service medical record from St Louis anyone else have had this experience. Thanks for any replies this is getting absurd. This forum is the best to abtain information thanks too all that subscribe. B)
  12. Is it wise to ask for a copy of the C@P results while your claim is still being decided. I am thinking it could slow down the rating decision is this a sound thought process. Have a outstanding 4th of July.
  13. This is my 1st post I have C and P exam scheduded in Gainesville fl with a Dr Maraist (nuerosurgeon) anyone reading have any experiences with this Doc. Thanks with any replies. :o
