  1. :D Ok lets not get funny here, I had my Hypertension exam for an increase for HBP so I'm waiting for the results but in the mean time I just received a appointment for ED. ok nowI did not ask for this but is this an automatic claim? is this something that now hichikes on the Hypertension claim? another question here what is intailed in the ED exam? because I can not find anything in the VA book that gives this a secondary claim or what kind of exam takes place unless they show movies? B) (I'm just kidding here). but really anyone been through this or can give me a general ideal what to expect. Thanks :D

  2. What are you 20% connected for? Legs? or what? and if you were denied a third time thats quite an effort. What were the denial reasons? And if its in you Service Treatment Records (STRs) thats something; how did the information get there? Your entry physical? or self'report? By the way - what was your MOS? Just adding up the possibilities here.

    I get 10% for my knee and another 10% for hearing loss, My MOS was a Tank Commander in the Marine Corps. Entrys were made in my Physicals I had in the last 20 years while on active duty.

At the rating board for the third time, must be doing something wrong, gave them everything they required even statements from dead people (just kidding). for some unknown reason the VA is stuck on that I did not seek medical treatment while on active duty, so with that saying I think the VA looks at the condition never happened, so what can you recomened at this point?

  4. :) Well bad news for me for my C&P exam, the regional office said that since I work for the VA I can not be seen at the VA hospital where I work for any service connected related issues. The regional office stated that "It is a conflict of intrest" so my current C&P exam is no longer valed and I will be given a new appointment at the nearest VA Hospital. Also I can not been seen as an outpatient for any service connected injuries, letter stated the same thing again so I can be seen as an outpatient but it can not be service connected, (Non Service Connected). what is the VA coming too? :)

  6. Hello, thanks for the reply back everyone that did hope you all have a safe holiday. as for this topic I requested a service conected increase for HBP from 0 percent to a higher increase. The outpatiet VA doctor increase my medications do to having a hard time controling HBP. Well I just finished a C&P exam for an increase and I really felt that the VA Doctors that work in C&P work against you and not for you, and the VA doctors that work in outpatient work for you but to make this topic short I really felt that the C&P exam was a waste of time, mostly do to the fact that the Doctor kept wanting to know why did I wait until I retired from the marines to file a service conected claim for HBP and why the marines did not treat me while on active duty? I really don't know why, also he kept on about he had never heard of a veteran getting a 0 percent for HBP. But after grilling me instead of looking at the whole picture in the end he did tell me that I do deserve an increase for HBP. I don't think I was in his office for more that 20 minutes, and the exam was over. So I wait to see if I was granted an increase or not it has been 4 weeks since the exam. Funny thing it took me 4 years just to get 0 percent for HBP. :huh:

  7. Hello, well today My appeal was denied again. VA stated that it is related to military service but I did not seek medical attention while on active duty for there fore my service conected claim is denied. The VA also cited that having Varicose Veins does NOT consitute a disibility. The funny thing is that I have been treated for this condition since 2003 after I had retired from the marines. During my exam for Comp & pension and the VA doctor both agreed this is a valued claim but again the rating board still looks at Why I did not seek medical attention while on active duty. So now the only thing that was offered to me was to request a Video hearing on my claim that was denied. So what I'm asking is what would be the best recourse for me or should I just stop because I'm just spining my wheels? This is a funny world we live in because I met a veteran that gets 20% for having an ingrown toe nail due to active duty wow.

  8. Just because VA RX's hearing aids won't make your claim get granted even at zero percent.

    The C&P examiner and/or IME, (for hearing loss it must be an Audiologist) will have to state

    your hearing loss is as likely as not due to XXX on active duty.

    Yes the audiologist from the VA and the outside (non VA) Audiologist both have stated I have hearing loss and received hearing aids, and both recommened that my hearing loss was due to military service, as for the C&P exam my hearing loss was 1 decibel from being a service connected per my letter. The letter from C&P also states they acknowledge both audiologist's findings for hearing loss but the VA's exam is some what different. The VA told me they are making it harder to file a hearing loss claim weather or not you were on active duty or not.

    so am I just spining my wheels here?

  9. I have a question and I need to know how to proceed to file for service conected for hearing loss now I have Hearing Aids issued by the VA. My Question is I was turned down by the VA for service connected hearing loss even having spent 22 years in the marines as a Tank Crewman. My C&P exam stated that I was 1 decibel Off during my exam in order to be service conected for bi-laderal hearing loss. C&P has noted that and is stated in my letter that they (C&P) does state I do have hearing loss due to military service. So I had my outpatient VA Doctor give me a consult for another hearing exam which I did see a ear, nose and throat Doctor at the VA and from reading the C&P notes he issued me hearing aids bi-laderal. So now I'm wearing hearing aids issued to me by the VA now my big question is how do I proceed to file a claim due to having hearing aids from the VA? kind of strange because the VA turns you down for hearing loss but yet the VA issued me hearing aids for hearing loss Go Figure!!!!!!

    Any Help on what to write and send up with the claim? thank you.

  10. ok since the VA has prescribed me medication for HBP for ED for the past 4 years how does one file for a secondary claim? I never knew you could do this and I'm suprise that they did not see this when they gave me 0 percent for HBP? due to the fact that they can see all the medications for HBP to include for ED :angry:

    If you are SC for HBP even at zero percent, and you are on meds for this and your medication has a side effect of other problems, such as ED, you can ask for compensation for ED secondary to HBP. So dont forget about those secondary conditions, sometimes they amount to more than the original condition.

    I think if you look up the regs, it is symptoms, not treatment of a disability while in military service. One of the reasons for this is that there is little/no treatment for some diseases/disabilitites. For example, how do you "treat" having only one kidney? How would you "treat" having only one arm?

    It really sounds like they are trying to pull one off on you. You have to have symptoms to recieve compensation. The treatment, and/or its effectiveness thereof, is dependent on doctors orders. If your condition is asymptomatic, often you dont get compensation. Dont think for a minute that the Va always follows its regs, most of the time they do what they want to deny you, and you have to call them on reg violations.

    For example, the higher courts, CAVC and above, pretty much stay with the legal issues. They pretty much wont change a judgement call by a rating representative, unless there is a legal basis to do so. So, those cases in the CAVC, the federal court, or the supreme court are pretty much all about the RO violating regulations.

    I personally, have a hearing loss. The VA does not treat it. There pretty much is no treatment for my type of hearing loss. Oh, yes, they do provide hearing aids, but that does nothing to treat my hearing loss, it merely makes it a little easier for me to adjust. I still have hearing loss with or without hearing aids. In my case, my compensation is based on my un aided hearing loss, not how well I hear with hearing aids. IDK if HBP is rated with or without meds but do remember this:

    An example of this, suppose you complain to your doctor that you have symptoms of sleep apnea. He may decide to treat you for it, or he may just decide to wait and see if it gets better without treatment, or he could even fail to make a diagnosis of sleep apnea, for example, he may have not been trained in sleep apnea. This is his call, not yours. You could well have sleep apnea, and he decided not to treat it. Does that mean you will be denied SC for sleep apnea because the doctor wouldnt do anything about it? The docs plan of treatment, or lack of one, is not your fault, and it could well get worse after the military.

The VA issued me a prescription for compression hosiery 20/30 for my vericose veins so now I need to send up additional evidence to support my claim, hopefully I will not get turned down again because I did not seek military treatment while on active duty for this condition. The VA outpatient doctor wrote a good patient note's to help with this claim. I gave the people up at the rating board more than they need but I feel they are beating this around the tree. this is where I beleive I fall under "Intermittent edema of extremity or aching and fatigue in leg after prolonged standing or walking, with symptoms relieved by elevation of extremity or compression hosiery 10 percent.

    any ideals or sugestions before I submit additional information? Thanks

Well let me tell you what I was told at the C&P exam......they said (VA) that since I have HBP while on active duty "I Did Not Seek Treatment For HBP, so Therefore My Service Connected Claim Is Therefore denied" that was my first denial back in 2004 right after I retired from the military. on March of 2006 I received a recall letter from the Defence Dept. and I was to report back to active duty from retirement. well after the physical at MEPS I was denied active service due to having Varicose veins and HBP. This letter was signed from the chief surgen after I requested a wavier which was also denied so I will never see active duty again. These were given to the VA as evidence to suport my claim but again the VA stated I Did Not Seek medical attention while on active duty so therefore AGAIN my claim was denied a second time. So I handed all of my SMR to the outpatient VA doctor that I see as an outpatient and he wrote his findings and I resent back to the DRO and 8 months later I received 0 percent.

    What is it with the VA that if you have a valed service connected claim and they see that you did not seek medical attention for it It never happened?

  13. Thank you the response back, here was my question to the VA which no one would or give me an answer to my question, in another words I was given the "Be A team Player Look".

    For my Hypertension the VA gave me 0 percent instead of denying the claim this time, so my question is “if your on VA meds, how do they evaluate (measure) hypertension If you’re on VA meds to control HBP, how can the VA measure your disability?

    Hello I have a rating for my HBP claim which the VA gave me 0 percent for service connected. it was a long fight to get this far say about 3 years. it has been more than a year now so what is the best approch to file for an increase for this condiction? I have been on medication for this condition since 2004 and received my rating in 2007. I noticed that the VA rating for 7101 Hypertensive Vascular Disease does not have a 0 percent listed this is what I was placed under for service connected. Thank for any help

  15. Hello, I have a question on a service connected claim. I get 10 percent for my left knee due to an injury while on active duty. 1 year after I was awarded SC I submitted for an increase due to having pain issue's in my knee. I was turned down at that time but the C&P doctor did say on my denial letter that I will have continue knee problems. so three years later and more pain I'm looking into doing a increase on my SC. I have asked for a consult for an Orthro Pedic because when I see the VA doctor here as an outpatient he always brings up why the military did not issue me a knee brace. The C&P doctor also said the same thing but you know the story with the VA. well anyway My question is should I wait until after I have my consult before I put in for a increase?

    Oh by the way as I was reading my patient notes after my C&P I did notice that when you come in to check in to have a C&P exam the VA writes down how you were dressed, how you came to the VA, by car, bus, car pool, how you were walking, did you show any pain, if you were laughing, having a good time how you were sitting it was like they observe you prior to you having your C&P exam and all this gets entered into your patient notes and for some reason play a major role in the rating board.

Thank you very much I will take the advice, I'm going to work on my hearing claim that was denied last week they must have over looked my evidence I sent with my claim letter or my evdence never made it to the rating board due to the fact that I had called to find out why my evdence was not submitted. My veterans Rep I'm working with has proof we submitted it for the claim but well you know the story.

    Again thank you and anyone else out there that can point me in the right direction.

Thank you for the reply I have seen the Vascular Specialist (Surgern) private and with a consult from my VA Doctor, did not help in my claim because it seems that the VA only takes the results from who they contract with for C&P exams. it's funny because when the VA sends you to their people you are normal, but when you see your own doctor or specialist then you are not. it's funny how that works. well anyway My VA doctor that I see as an outpatient did pricribed me Compression Tet hose been wearing them for about 3 years but the VA is still stuck on why I did not seek medical attention while on active duty, it's like they are stuck on just one side of the issue. I had all the vscular test done by the surgern through the VA that is why I'm wearing the prescription Tet hose from the va and I met in the rating for 10%. I even submitted my recall to active duty physicals as well which I was turned down for varicose veins with no waiver possible for this. But this does not seem to have any effect with the VA for some reason or another. My NOD has been up at the VA for 2 years now and I still keep submitting paperwork and all they can tell me is that it is sitting on someones desk waiting to be looked at and they only have 1 person that reviews all incoming NOD's.

Hello and thank you for the replies, The VA gave no reason just that they felt that this condition was A PRE EXSITING CONDITION which was highlited in black letters, they beleive that since I did NOT seek medical attention while on active duty then my condition does not warrant a service connected claim. and yes it does say that in my denial letter. The funny thing is that this condition is noted on my health record from the marines. So where does the VA get from saying that this is a prexsiting condition I have no ideal.

    I also have a claim for hearing loss since I was a tanker for over 22 years in the marines. I already get 10% for ringing in my eas which is getting worse and my last hearing test from the VA say I have heaing loss due to military service but I was 1 decibel off from getting service conected for it in both ears. The VA did issued me hearing aids and would you belive that the VA told me in the letter that just because I have hearing aids from the VA does NOT consitute a hearing loss because the VA has corrected my hearing loss due to the hearing aids for there for I have no claim to file. go figure!!!! I did file a NOD on this one was informed that I would not hear anything for about couple of years.

  19. Hello I have 22 years in the military and retired in 2003. I was recalled back to active duty on 2006 and was turned down for service due to having varicose veins. This condition has been noted on my military health records during my time in service. Per the MEPS doctor this condition is a NON waverable, so to make it short no more active duty for me. I then proceded to file a service conected claim for this condition. I sent the VA everything they had requested to include my MEPS physicals stating the reason for not being able to go back on active duty and a copy of my recall letter from DOD. I'm working with a VRO as well to help me in filing this claim. in short I have been turned down for service conected for this condition and now resubmitted a NOD to the VA AGAIN. the last letter I received from the VA stated that this condition was a pre existing prior to military service Yea right like I had this condition when I joined the military on my 17th birthday. I did not have varicose veins at age 17. the letter also states that I have to prove that the military agavated this condition and also my military service health record does show I have varicose veins after my 10th year in service but I did not seek medical attention. So at this point it is still up at the VA waiting on the descision with a notice of NOD and in the meantime I have been submitting medical records from the VA hospital and private doctor and a vascular surgen as well in suport of my claim. The local VA doctor here has precribed me compression tet hose to wear, so my question is am I just spinning my wheels in fighting this claim? thank you for any response or recommendations that you may have.
