  2. I received my retro pay from DFAS on Jan 21 & my VA retro just came from the VA today! VA only took 2 DAYSfrom receiving my DFAS retro! Between both of them, I received $61K! Thanks everyone for your help!

  4. Just received an increased percentage rate from 40% to 70% w/ spouse 1 child, due to a CUE claim. I am owed VA retroactive pay from Sep 2011-present. My questions are: What is the average time to receive retroactive pay from the VA AFTER DFAS has paid you their portion? I received $15K today from them. I already received the VA letter stating how much I was entitled to & how much I actually received for those years mentioned above. Any idea? Just want to know if I'll be waiting years for the back pay now. Thanks!

My questions are: What is the average time to receive this back pay & approx how much should I be expecting or how do I figure it out? I received a deposit for $88 from DFAS the other day, & the deposit comment says: RETSPCL. I have no idea what that means & why I'm getting a deposit. I read somewhere that military pay has to do an audit before the VA releases back pay. Could that deposit be something the military owed me from whatever audit they're supposed to be doing? I just received my very first 70% monthly retirement & VA checks this month & those were correct. I just want to know if I'll be waiting years for the back pay now. Thanks, gurus!
  7. Discussion Thread What does "We are in the process of brokering your appeal to the Appeals Management Center to be reviewed" mean? Is this just a "blow off" statement? Nothing in eBenefits, as far as the status has changed from Sep 2012. It still says at the local office. I sent a certified letter stating I wanted to file a CUE, due to the fact that the VA completely forgot to rate my Total Hysterectomy & bilat ovary removal. They rated my scar, but not the surgery! They claim they never received the letter, but someone signed for it! Does anyone know the proper way to file a CUE & to make sure it's actually on record? And can someone answer the questions below I sent to the VA, since they can't seem to? Is there a 3rd party I should be getting involved, like a DAV representative or someone? Any help is appreciated! Below is what I asked the VA & their response is right below that. It doesn't answer my questions.   8. Does anyone know what "Appeal is Possible" means, besides the fact that they're saying an appeal is possible? Lol. This is from eBenefits. I keep seeing this message, but the dates keep getting pushed back, so my letters have not arrived, so I keep waiting. "Decision Notification Sent" has said that for a a couple of months. I'm just curious if this means my NOD is going to a BVA now? When I click on View Board of Veteran's Appeals status, it just shows what it always had, that it was "current" and still at the local VA office. The 2 dates on 9/12/12 are for an NOD & Dependency claim. The other date 9/1/11 was when I retired & they deferred a B/P claim on my initial claim letter. Isn't an appeal always possible before it goes to the BVA? Mine is/was just in the NOD phase currently. Thanks for any help!   11. Yes, it was specifically mentioned in my initial BDD claim, along with the ovaries being removed. There is NO reason it should've been left out, except error on their side. I could see if it was only documented on one piece of paper in my medical records where they could miss it, but it's documented many, many times. There's even a whole inpatient chart on it, as well as pre & post op notes & path report in my outpatient records. So, I sent all that back in... I appreciate all your advice. Now my question would be, was that the only route to take, since it was an obvious error on their part. Especially since they didn't even mention the surgery at all.
  12. But nothing was denied. It just wasn't mentioned. Going to get an independent medical opinion about the fact that I had a hysterectomy doesn't make sense to me. They have all the evidence they need. They couldn't get more evidence than they already have. Thanks tho.
  13. Hi, They didn't mention my hysterectomy/BSO AT ALL, except the scar, so there is nothing to quote. They completely left it out of the decision! This is what I sent them in the NOD, along with my pathology reports & operative reports! It was ridiculous that that was left out completely. 1. TAH-BSO: I had a total hysterectomy AND BSO in Oct 2008; my records clearly stated that. I was a little confused why I was rated 0% for my hysterectomy scar, but nothing was mentioned AT ALL about the actual surgery. I have included copies of my records showing the actual evidence, including the pathology report.
  14. Thanks for the info. They had all the evidence they needed, so I resent it with the rating schedule attached to each claim. They just screwed up, i.e., rating me for a hysterectomy scar, but not for the actual hysterectomy & ovaries removal. That's 50% right there. Plus I have 3 dependents & they rated me as single, so all this is EASILY verified, but I guess with the backlog it will take a while. What is an IMO, where do I find one, & is it even beneficial in this case?
  15. Thank you for the info! I selected a DRO review. We'll see what is next. One thing on the claim they didn't even mention was a definite mistake, so I already know I will eventually get my 50% added to my 40%.
  16. Thank you for this. I actually read almost all of it, except the statistics from each VA office. It was VERY informative. It does put a whole new light on everything, since the letter the VA sends after an NOD DOES NOT allow a real informed decision. I will share this with my husband since he just retired also & will prob be going through the same things I'm going thru. I can definitely see why there are differing opinions on this, but with this article, its easier to make a more informed decision. Thanks again! EXCELLENT
  17. Thank you! Good info here. My only other questions are: Do I write them a letter telling them which one I want or is there a form I need to fill out. It doesn't mention what to do, except let them know which one. They attached a VA Form 21-4138 (Statement in Support of Claim) to the letter. Is this what they're expecting me to write on saying which process I want? They didn't mention the form at all. It is just attached.
  18. I just received my very first monthly VA check today. Does anyone know when they're supposed to pay the backpay? Also, since I have a NOD in progress, would they wait until that is figured out or if it goes to the board to decide before paying me my backpay or would they pay me what they owe me at the current moment? I'm just trying to figure out when I should be asking, "Hey, where's the rest of my money"? Thanks

Hello Gurus, I received a letter from the VA stating they received my NOD & they wanted to know if I wanted to have a Decision Review Officer assigned to my NOD or use the Traditional Appeal Process. Does anyone know if one is better than the other or does it even matter that much? Will one process take longer than the other? Any suggestions? Or pros/cons for each one? I have 60 days to let them know if I want a DRO assigned. If I don't let them know anything, they would automatically use the Traditional Process. THANKS!!!
