  1. package at VA; cover letter left "home alone!". duh! there's Monday!
  2. miltary has rigid entrance exams, after that disabilities incurred are "on duty". Chaperone the C&P ?(unless one's embarrassed)
  3. Military injuries and surgery focus. military limb injury w/surgery, now SC w/%, chronic condition. SMR showed MEP doc and ER tech notes "patient" gave teenage history; First claim? C&P exam may ask for "early" history .
  4. Something you said here struck a bell with me. I have a brotherinlaw, he is a productive tax paying family guy who isn't ill with agent orange cancer (or anything other that I know of) just a grumpy hardened guy that seems fine for now. How does one file a claim in advance or prepare for the possibility of cancer onset later in life? Other than having a prepared claim package to go "if" events ever occur, whats to be done? Is there a way to pre-detect agent orange poisons? Just a question I have often thought of. cg
  5. Seems like someone needs to create a transcript, take notes or record and type up information. Vet must have family or freinds connections that can validate something, like where he lived, where his paycheck got sent to and who from? etc. If there is a paycheck there is usually a trail, dont ya think?
  6. ,aybe i missed somethingk what is 3;159 para 4,1 c ?
  7. Yes, I am binding the papers, my stressor letter, support letters, reports, etc. Has been hard to work on stressors that I can prove and have diagnosis for, others I can only talk about, no/not enough proof. My biggest concern is - Question, if "todays" provable items were part of old not "well grounded" denial, how do I restate them to be connected back? Thanks. cg
  8. Johns wife.regards my stressors, I talk vaguely to my husband, detailed to a close sister and more frankly on paper. Just a thought here, check with the doctor, maybe record&transcript a "GI talk" with your husband & close freind. Got a brother in law who'd probably do that, doesn't write anything down that I know of. God bless, cg
  9. After too many years a 4 page stressor letter near done; any last minute advice? Letter organized with miitary history, major stressors; attachments lettters, reports, diagnosis,Cfile.SMR etc. Thanks and pray for me..cg
  10. Thanks for the feedback, as I am working dilgently on my claims, will see how it all unfolds and report back. I am thinking the paperwork reduction act doesnt apply to us veterans though. Gratefuly yours, cg
  11. Thanks Vike, two things I have been thinking. First, it was good of VA to recognize and service connect items I didnt provide support for, however were in my SMR. Secondly, I am thinking my submitted items that I didnt appeal and were on the claim- may represent CUE. Again, I am studying and trying to figure it out. Does a successful CUE simply service connect or retro compensation as well? thanks, even after all these years I feel like a novice sometimes. cg
  12. I have always wondered, first year out of service I submitted claim and no additional evidence; did have a C&P exam and VA clinic visits, but wondered "does the VA look at/or use SMR to validate claim issues?" I did not copy or present SMR pages or anything other evidence, got SC for some issues not related to exam. Denial for others, now diagnosed. I probably need to study on CUE. cg
  13. Called 1800 & checked on status of my claim, was told the 21-4142 is needed to complete the claim. Rep said the form was sent here twice and that was the holdup. My goof. Thank goodness, just found important data to submit and will handcarry now - Prayers please! cg Makes me wonder if we vets need a simple paperwork checklist like this? ....... Claims Form 21-4142 C-File and so on........
  14. 1.ptsd/2.depression -similar but different, current VA diagnosis major depression. Am working on support package for claim in process for one/appeal for other. If current diagnosis claim is awarded, looks promising, Could the VA review/approve #2 or do I "work it? THanks for your advice
  15. Good start! Pass the word! Release No. 6-05-06 June 12, 2006 VA data theft: airmen may check status on AFPC web site RANDOLPH AIR FORCE BASE, Texas - All active duty, Guard and Reserve Airmen can check the Air Force Personnel Center Web site at http://www.afpc.randolph.af.mil to see if their personal data was compromised in the Veterans Administration data theft. AFPC officials stress, however, the data base contains only active, Guard and Reserve members. Retired members and dependents who enter their Social Security number in the search block will receive the notice "You have not been identified as an affected member" simply because the file does not include those categories. Members of the retiree community should read previously released Air Force Retiree News Service articles and also the information on how to protect against identity theft at http://www.firstgov.gov.
  16. Thanks for the heads up and encouragement to continue my current claims. I do strongly believe I have more down than up times than most of the Jones's in this world. Being told to journal the past is difficult, because so many truths bruise me again and again. With your continued feedback I feel more reslient and plant to win.
  17. Thanks, on VA website I saw 30 to 50% or so. Current gaf is 50 and because of worries, work is a few days here or there only. Not sure if SSDI is available to me, spouse works, kids in school..
  18. Looking for a ballpark idea of compensation rating for major depression and/or MST. thanks cg
  19. Thanks for the feedback. I truly believe I am outside the window of CUE for the old denied claims and will stick to my current efforts.I will have to see how it goes. 1. I now have my C file and copy of my original claims, appeals, approvals and denials. I am going to make heads or tails of it one way or another. I am in the fast 60 day window for one claim just now. 2. For now, I am working a couple of claims (one VCAA letter and a appeal for the other). Now I have more specific information to back up both claims, I will be careful to read and re-read the data, try to list it as detailed and clearly as possible. 3.The way I see it I have historical and current confirmation of a couple associated diagnosis's spanning more than 10 years then to now. I did appeal for some things and got connected; however I didn't appeal for the issues the VA brought to light for me. Lack of support in understanding all the process I guess. 4.If I get it right now, with my current appeals and information gathering: I have to feed back old and current diagnosis information to the VA, highlight tab and flag it alot. Am I correct? I will prepare it the best I can before I go through my SO, however, want to make it fly very well even then. THanks Berta/Don; I have been nervewracked but want to keep my path straight. sounding it out here in the forum helps validate my efforts and support successes for all needy veterans! Yours, cg
  20. Years ago, the VA recognized and discussed a few specific conditions that I have claims in for today. I was combing the fine details late this AM and there it was. These conditions I didnt apply for at the time, however the VA brought them to light and decided against them at that time. Question, - when I add this historical research to appeal/additional information for support - how is it viewed? Could the VA interpet its earlier validation of a condition as "more likely than not" for a current claim? Thanks. cg
  21. My lessons learned, I needed to be aggressive from the get go. I needed to learn the VA language and regulations, I needed to ask easy and difficult questions, I learned to appeal quickly, with substance, to back up my request, Drink coffee with VA volunteers and receive an education.cg
  22. Great, Okay got it; saved it to a file, sure defines alot, I thought "possibility" also. Hope to limit my TMJ as I go through the appeal processes. Receiving and sharing lessons learned at Hadit is just awesome! cg Timetowinarace is correct. Rule out means that the condition is a possibility. The VA is not supposed to use rule out because of its missunderstanding. The Warms Clinical guide specifically states not to use rule out as a diagnosis. Read it for yourself so that you will know. http://www.warms.vba.va.gov/admin21/guide/...iciansguide.doc
  23. Somewhere I have read that disability award ratings are connected to a veterans 'ability' to work and or support thier family. Is it possible that this statement rings more true than not? Meaning if a veteran worked occasionally as a temp, its inconsistent and not considered long term employment. However, if a veteran could work permanantly part time or full time at a job with salary/benefits, would the disability award be a tad different, even less? Thanks, just trying to figure out how things work. cg
  24. timetowinarace, thanks so much for the "rule out" information, i understand so much more now. Meanwhile I have submitted a seperate claim for the current VA diagnosis of 'depression" I am still pursuing the PTSD claim, funny thing is supporting documentation for both "depression" and "ptsd" claim are exactly same. I am continuing to pursue and learn more each day thanks to HADIT members like you, Berta, viking and all the others who are faithful to the battle.
