  2. In 2012 I was awarded 100% on mental alone and given all the privileges that go along with 100 percent. SO they have me at 100% mental and 60 % everything else. they set aside issues such as my ankles and lower back as well as my claim for employability and as well as other things. Now I have found a new case popping up and it is called freedom of information act and they have called my SSI file is it possible they are aiming to remove my 100 percent after only 4 months?

  4. Hey all, my case went from review of evidence to pending decision approval in two days and this is at the Waco Varo. Should I be worried by this rapid movement it seems after two years I am gonna get a negative even though my C+P is on my side.
  5. Can a event at work (taunting a accepted VA condition) That results in Mental issues that retire a person be of service connection due to constant pain and depression due to pain? Along with mental events brought by constant harrassment?
  6. Hello I put in for TDIU and the case is currently under review. The question I have is my Mental Health Doctor as well as the head of the clinichas placed a GAF score of 50 and have also claimed under axis III it is military related. Will I still need a C + P or will they feel it is not needed as the Head Doc says it is Military related?
  7. Just got my e-benefits up and looking at the status it said it is in the review stage and they are saying they have all the evidence they need. So my question what is next for this claim ? Also if they are saying they have all the info they need, is this a positive sign.? thanks in advance
  8. The stress and anxiety are secondary to my knees so both will be service conected. I am hopeful that due to the documentation, OWCP states I can only work 4 hours a day sitting. Combine it with both the OWCP ref and my DOC saying it is permanet might just give me a leg up on getting IU. Guess I will have to wait and see, but I don't think that because both are sc one secondary and OWCP states gainful employment unlikely and it is permanet and being on SSDI might just be enough to tipthe scales in my favor. ' As for me now I am praying, because the last trigger led me to try to catch the person and rip their heads off. Thank God I leave my pitol at home on certain days.
  9. Yes have been medically and mentally directed not to work at all due to possible work place violence sent off by a "trigger" I am also on ssdi and retirement from my job inder mental issues. I have letters from my pchycologist stating he feels no work is possible for me. Now ot later. the only differance between the VA and him is thst the VA is calling it stress and anxiety while my Doc calls it PTSD.
  10. OK, Just got the DAV unofficiail letter. I am now rated 60%. 20% bilateral knee 20% bilateral hip and 30% stress anxiety. It says the TDIU has been deffered as I am in the development status for that. The question here is will TDIU in this case be permanet or not and will this be TDIU Schedular or IU? If I understand correctly even if schedular benefits are same as 100% correct? Thanks for the info in adbvance guys
  11. You can get in online the form is VA 21-8940. you can type it on your printer and send it off. Remember to send proof of unemployment SSDI stuff. OWCP stuff etc and a statement from you could not hurt. If you have a doctor who says you can't work get a letter from him too. Good luck! I hope the grace of God shines upon you.
  12. Thanks Pete53 will keep you updated on what goes on. I just am not used to the VA on it's own law or npt saying "Hey you need this" and then doing it me asking for it. I will try to keep positive thoughts and thanks for the best eishes God Bless you and yours.

  14. OK here is a beautiful mess created by the VA. As earlier stated in a earlier post I had a decided case and put in a request to find status on the case. The status was the case had been decided upon and was in the notification page. However when th VA in Washington applied a TDIU claim to my file I find the whole file back in development. So apparently because they filed the TDIU they will put me back at the starting line and I am in development stage. Lord I waited 14 months for the case be deceided and now I hope not but all signs to a new 14 month wait. Somebody please tell me I am wrong LOL.

  16. Hey all got a strange story here. Firstly I am 40% service connected bilateral knees 20% and bilateral hips 20%. I put in a claim secondary to my other conditions for depression and stress and was diagnosed with adjustment disorder at C+P. two months ago I inquired over IRIS on the status of my case. They responded they would notify Waco, TX and I shoule hear something soon. 30 days later no word but the guys at the IRIS center sent me a e-mail asking if I ever got a responce. I of cource said no. They replied they would contact Waco to see what is up 30 days later I got this reply from Waco through the folks at the IRIS center. A decision has been made in your case. It is in quality control to make sure no errors are present. decision made on case 18 Aug sent to notification 18 Aug. You should hear on this cases decision very soon. All this was good news as I went to local VA to ck out status and they confirmed everything I was told. Then I read something weird. The guys at IRIS stated "We sent this down there as a TDIU claim please forward all paperwork to Waco. Ok agreed I am on SSDI for my mental condition it is very poor and some of my Doctors are calling it PTSD. I also am retired out of my job and with OWCP right now until I can get these folks to release my case so I can collect my regular retirement. However, I do NOT have one condition over 60 percent and I do not have 70% when you add what I do have. So why would the VA initiate a TDIU claim. When I went to the local VA they said two things possible. I told them I was on SSDI or retired from jom medically (never did that) Or by some random check they discovered I was in a unemployable status. But by the numbers I still dont qualify. The last possibility I was told was that in some cases the VA if it appears to them that this condition is going to interfere with your ability to find and keep employment will go ahead and make a TDIU determination if your new rating brings you into eligability for a TDIU Claim. It is their way of washing there hands of it. According to the loval VA the decision had not yet been posted through their system and due to back up it may be about 4 to 5 weeks to get the decision. However my reps in DAV say I will get letter from them long before that. It will be unnoficial notification of award. Many said they would not be suprised to see me come down at 100% due to award on this case and TDIU I know it is a long one but I have never seen this happen at any point in my life.
  17. Ok here is the angle. Today I recieved 15,069 dollars from the VA. I am currently 40% and claimed ANxiety,stress, some of my civilian Docs even called it PTSD. My C&P Doc stated I had adjustment disorder and put me at 30 percent. WHich is what I was expecting. However if you break down the back pay months (11) that breaks down to 1369.00 per month if you add this to my 599 disability pay I recieve. this gives me like 1968 a month. Not complaining but wow.
  18. Really getting cranky here filed a claim for stress and anxiety (my outside Doc say it is PTSD) as a secondary to already compensated knee issues. As pain and a issue of inability to work or live a normal life. The claim was tagged as adjustment disorder by the VA. Thry also stated it was more lokely than not cpnnected to my knee issues. I am currently at 40%. However the telephone kine states it went to the rating board on March 3. It has now sat there in the rating board for 2 months and 2 weeks. I called the VA again today and was told it is still gonna be awhile before your case will be determined due to workload. 21/2 months is ridiculace for a enity that states 17 to 24 days to co,plete their work on avg. Is anybody else seeing this with the Waco Regional Office?
  19. Hello all, My case finally hit the rating board on 3 March 2011. The claim is for mental issues secondary to chronic pain from my compensated military injury. I had my C and P and she expressed in her report a 30% disability on severe depression and anxiety. She took the words right out of the rating manual. I was talking to a VA rep who stated well in January your file was before the rating board but was pulled down due to a secondary claim on pain. In other words they had to see if the pain is worse and then rate it also. In any case I call the VA rep today and she says "the usual it is before the rating board" However then she stated it is about half way through. Now to my knowledge their tracking isn't that good what the heck does half way through mean.
  20. Hey All, Just a quick note to say I am going nuts! C and P exam said as likely as not the condition was secondary to my knee condition. Apparently they actually call it secondary to the pain. It is a stress/anxiety disorder. The C and P Doctor states in her report the exact wording listed under the 30% disability definition. It went to the rating board once and was pulled back because they were looking to see if the pain was worse over all (or so I am told by the folks at the 1-800 number. It went back to the rating board on 3 March and I am going nuts waiting on this decision. A serious question though Just a few days ago I got a letter asking if I still wanted to pursue a video conferance on my appeak I of course said yes. However I have been told a thousand times the VA handles one case at a time. So my question is If they have now inquired as to my hearing decision. This should mean they have finished with my stress claim. How long does it take from the time the rating board renders a decision to get it through review and typing and recieving the big brown envelope. I know this may be in the wrong post but I never saw a forum to put this in. I apologize if I missed the correct forum. O am holping somebody can estimate how long before I get the news either bad or good. Also I must have been misinformed as I thought the VA did not rate pain.
  21. Hello All, Some time ago I appealed a decision on my knees as I thought they got the rating wrong. After that I submitted a claim secondary to my knee pain of anxiety,stress as well as PTSD. This diagnosis is supported by my Doctor but the VA called it adjustment disorder during the C and P. My VA psyciatrist as well as my team councellor are calling it severe depression. So basically my appeal got placed on a back burner until they handled the new claim. Last Friday I recieved a letter asking me if I still wanted a video interview for my appeal. My Depression etc... has been at the rating board since Mar 3. Is it likely they made a decision on my claim and are now turning to my appeal?
  22. On 4-6-2006 I was injured at work. In September 2009 I left work as I could no longer perform my duties as my knees were shot. I filed the claim with OWCP as a agrevation to a preexisting condition as I was on disability for my knees with the VA. The VA gave me a disability initially at 10% bilaterally. so I was at 20 percent. Later damage to my hips was considered and I was awarded 10 percent bilaterally on those so I was at 40 percent. The problem I have is that OWCP has rated me at Maximum Medically Improved and has applied permanet restrictions saying I can work only 4 hours a day from a seated position and reach my hands above my shoulders, These restrictions are deemed as permanet by OWCP. I was turned down for SSD as they felt I was still employable. However I have filed an appeal on my knees as according to the OWCP work capacity exam I am much more restricted than 40%. However I feel that if I send the VA the OWCP work capacity exam they will deny based on the opinion of my occupation caused my current issues. It looks like I will be medically retired by the Post Office and feel that my condition was way under rated by the VA. Is there a way to get this report to the VA without them assuming that the conditions now are work caused. Also will they cut my VA benefits in view pf these findings?

  24. Hello, I have a appeal of my award on my knees currently they are rated at 10% each, However I have asked for a appeal as the condition of my knees took me out of work (I am a mailman). The question is I filed with OWCP for an aggrevation of existing condition. Well to make a long story short I was sent to a work capacity exam. The results of the test shows according to their tests I can walk for 1/2 hour a day. I use a walker, It also states that I can only work 4 hours a day but must work from a seated position the whole time and can only reach above my shouldders. Kneeling, bending, crawling, climbing stairs are all considered to be things I cannot perform. This work capacity study also states that I have reached maximum medical improvement and the restrictions he listed were permanet. It also states that a effort to cure my issue on my right knee failed (had a lateral release surgery). The question I am asking is should I send this document to the VA office as more proof that my knee condition has gotten alot worse and makes holding a full time job impossible. I appreciated any help you can be in advance as I am really stuck with what to do with this report. I know it is going to retire me out of the Post Office but would this document be seen as acceptable proof.
  25. Hey all, First of all thank you for your service to our great nation. I have two questions that are very basic but I need to get them answered so I don,t trip myself up here. 1) I have a claim in for stress,anxiety etc... My C+P in her report she took the 30% defination right from the book and said it is more likely than not this is associated with another compensatable injury. My claim is currently in the rating board ( Accorfing to their letters they are backed up) so I am playing the waiting game. Then Friday I got a letter from my regional office titled A summary of benefits and it reviewed the 40% I am compensated at now. Is this a signal that they are going to make a decision that is not in my favor or just a coincidence? 2) I am rated at 10% bilateral knee for retropallete syndrome. I have appealed this (this is stuck behind the stress claim right now) because I had to stop my job and go on to OWCP. They as their procedure goes sent me to a referee Doctor to make a final determination as to my case. He states that due to the conditions of my knees there is no way I can continue in my job. I had surgery (on my OWCP insurance that was attempting to fix the knee problem. The surgery failed. So now this Doctor states that due to my knees verified by a Work Capacity examination I am under permanet restrictions now that allow me to work 4 hours a day sitting only and I can reach above my shoulders. Can this be used a viable medical evidence on my appeal on my ratings for my knees? I appreciate any help y'all can be in helping get my head straight here.
