  1. I was denied on my first attempt when I was at 70%. The window for reconsideration has closed and I believe I have to do it all over again. This is why I was considering doing ssdi and ss at the same time. Will this be a conflict as to what I am asking for? Also, do you suggest I hire an attorney to help me?
  2. I am 62 and filed for ssdi but was denied. I am at 90% VA service connected. Can I file at the same time for ssdi and ss? thanks, Bro' Gate
  3. I only scaned an edited version. I had a total of 10 issues with only sucessful resolution in 4 items. I have neuropathy at 20% in lower extremities both left and right with dm2 to include pn of the bilateral upper extremities. My claim for gerd and barrets esophagus was denied pending proof of secondary connection to anxiety/ptsd.

  5. Hello All, I have been service connected for Anxiety since 1973. In 2010, the VA increased my rating to 70% for Anxiety. After filing for TDIU which was just recently denied, the VA changed my diagnosis from Anxiety to PTSD at the same 70% rating after a PTSD C&P. By law, can they do this?   6. Hello Vets, Finally received notification. Increased from 80% to 90% but denied tdiu apparently because of a non-definitive c&p. Should I try to tackle ssdi first? I was denied last year and was waiting on this claim to resolve before going any further. I have attached the ruling. Any advice will be appreciated. Thanks, Bro' Gate notification va.pdf

  9. Checked ebenefits and discovered I have some success. Packet has been mailed but as of yet have not recieved it. I have been increased from 80% to 90%. I am not able to address the issue any further until I receive the documentation. I do know I had multiple claims but did not accomplish tdiu as I had hoped. The battle still continues. I will not give up as I had done in the past.. I want to thank the forum and all participants who have encourage so many of us not to give up the fight. It has been a journey.   10. I believe you hit the nail on the head. I had multiple conditions included for 2 claims. On the lesser ones I did not get a favorable c&p. This may be the reason for further development. Still waiting for the brown envelope. I will post again when I get the details. thanks for your help
  11. thanks for the feed-back. I will try to relax, if thats possible. Been waiting on resolve of my claims over two and ahalf years. Hoping my tdiu is approved. I am at 80% trying to get over the hump. Hope this is a good friday.
  12. Hello All, I check ebenefits yesterday and claim went from pending decision approval to "Decision Notification Sent-Development Letter Sent". It also says appeal is possible. Is this normal wording for all claim resolutions or am I to assume the battle continues? Thanks for any input. My anxiety is kicking in. Bro' Gate
  13. Thanks to all! I will go to my rep tomorrow morning and hope he is there to engage me with my issues. I pray I can get the guidance that will facilitate a result that can connnect with my situation. This is new territory for me, quite painful for me to be so transparent but I am ever so grateful for the love and concern I get from this site. Thanks so very much.
  14. I have not had much success with my DAV rep. Got 80% on my own and with the sound advice I received on this site. It has been a blessing. The mortgage company does not have the compassion even though I presented my case. I don't know how much good it will do me to frustrate myself with the DAV. Could be wrong. I will check on the VAMC Homeless rep to see whether they can help. I am in tears now just reading the replies, maybe it is the depression. If we don't have each other, we have nothing. Thanks and I appreciate you and your service.
  15. Went to the exam and to my surprise it was for ptsd and not increase for anxiety, tdiu. Previously had diagnosis for ptsd but records did not indicate verifiable stressor. Maybe since rules have change, may have introduce reason for VA to look back. I realize the VA only recognize one mental disorder and my anxiety is rated at 70% and 10% dm2 for a total of 80%. My primary issue for the VA was tdiu and secondary gerd for anxiety. Also tried to connect depression secondary. Hope this helps more.
  16. Appeciate the input. I still have this war going on inside of me. It kind of weighs on me really heavy. Besides the ptsd, dm2 and anxiety, I have been in treatment for the last 8 mos for depression. I could write a story but I try to keep my head up and not complain. I called VA and they suggested that I send in a copy of the letter. My problem is that I not so trusting after having dealt with the VA for years. What seeems to be working for your good can easily have the opposite effect. Maybe it is best I exercise a little patience and hope I get a resolve of my claims very soon. I read daily the success stories and find them to be very motivating and hopeful that one day I can testify. Bro' Gate
  17. Hello to All I am currently at 80% for anxiety, dm2, pn. I have been waiting for resolution on my claim for increase since I filed in 4/2010 for tdiu ptsd, dm2, pn, gerd. Subsequently, I have been experiencing serious hardship as I know a lot of vets are. My claim has been in decision phase for nearly 100 days. Today I recieved a letter from my mortgage company that they are proceeding with foreclosure of my home. My question is should I risk the chance of introducing to the VA new evidence in hope that they would expedite my claim? To my understanding, I was told that if I did, then my claim would revert back to the development phase. I am kind of indecisive about how to approach. Should I continue to wait and hope all will be judicated in my favor or risk the chance VA would consider new evidence as a reason to expidite. Not Sure!   18. Take the advise and wait since you are so close. I made the mistake of applying for tdiu when my claim was at rating. So far, it has only cost me an additional year of waiting. VA confirmed that my filed was pulled and sent back to development. Was also told that the returning vets from Iraq basically had priority over my years of waiting. Hope your case results in a better decision. Regardless of the decision that only you can make, of course with the expert advise from contributors, be patient; time is in your favor.   20. I filed for tdiu about a year ago. I have been patiently waiting a response from the VA. My overall rating is 80%. I have 70% rating for Anxiety but with my last c&p I was diagnosed with PTSD and Anxiety in Axis I. I know that VA will only recognize one mental disorder but my question is will the PTSD bump my Anxiety raiting higher to get me closer to a P&T rating? Appreciate your input. Bro' Gate

Additional comments from c&p doctor stated: This 62 year old Vietnam Veteran with traumatic warzone exposures and subsequent psychosocial problems and polysubstance abuse has heen diagnosed with Generalized Anxiety Disorder (70% rated disability) but currently endorses symptoms which also meet the criteria for PTSD. It is difficult to assess the affect of alcohol abuse on his symptoms and functional capacity over the years, but he denies recent use of substances of abuse. Symptoms of anxiety/panic and of PTSD seem chronic and have persisted despite sobriety. He is currently under treatement for his psychiatric symptoms at VA Medical Center. I also had a general exam for Diabetes and Peripheral Neuropathy Bilateral: Problem associated with the diagnosis: Diabetes Mellitus 2 effects on Usual Occupation and Resulting work Problem: Increased Absenteeism. Effects on Occupational Activities: Lack of stamina; decreased strength: upper extremity; decreased strength: lower extremity. Are There Effects of the Problem on Usual Activities? YES diagnosis: peripheral neuropath bilateral Problem associated with the Diagnosis: peripheral neuropathy bilateral Effects on Usual Occupation and Resulting Work Problem: PAIN and INABILITY TO PERFORM DUTIES.. Effects on Occupational activities? YES Description of the Effects of the Problem on Usual Daily Activities: due to the pain returned now remains mostly sedentary. It could be possible that unemployability for PTSD is poor but does not preclude me from work but the general exam is more favorable. That's just my opinion. I will wait to see how VA interprets the results for TDIU. I am hopeful since I am rated 80% and have not worked since 2007. Hope this gives more insight.   23. I filed for TDIU. I am currently at 80% and have not worked since 2007 due to SC issues with DM II, PTSD, GAD and PN. I just completed my c&p for General Medical and PTSD. The diagnosis for PN states: Effect on usual occupation and resulting work problem: Pain and inability to perform duties Effect on occupational activity: Pain Effect of the problem on usual daily activities: Pain Are there effects of the problem on usual daily activities: Yes Description of effects: Due to the pain returned remains mostly sedentary DMII Diagnosis Effect on usual occupation: Increased absenteeism Effect on occupational activity: Lack of stamina; decreased strength: upeerp extremity; decreased strenth; lower extremity Effect on daily activity: yes I got diagnosis with PTSD (moderate to severe) with my pre-existing 70% for GAD. My latest GAF is 52. Veteran employability: poor Is veteran employable: yes Any input on my chances? "Always a Soldier"
  24. It has taken me a while, but I finally had my c&p for PTSD. I got diagnosis with PTSD (moderate to severe) with my pre-existing 70% for GAD. I am trying to get TDIU since I have not been able to work. My question is from a line item of the examiner: veteran employability: poor Is veteran employable: yes Is this a good thing?
