  1. Berta, I tried to contact them and they only have voicemail set up now. I also e-mailed them but have yet to recieve a response. The have a message that said due to overwhelming numbers of OIF/OEF veterans they are no longer able to take any new clients. Is there anywhere on the web to view this specific passage on page 181?
  2. JON, Did they concede hearing loss and SC at 0%, or did they give you no decision because your hearing numbers did not meet the definitions of hearing loss?
  3. Are you saying even with the VA Doctors findings of: VA Examination: Diagnostic Impression: 1. Fibromyalgia. 2. Irritable Bowel Syndrome. Discussion: Based upon the classic history for both irritable bowel syndrome and fibromyalgia, I do think that the Veteran suffers from both of these disorders primarily, but it would be speculation on my judgement to say that it is truly Gulf War Syndrome when he is so classic for each in and of themselves. They still must be SC'd. Should I not worry about submitting a nexus to combat the "speculation" wording in the discussion.

  5. This information is in my military records. I listed all of these symptoms I began experiencing on my Post Deployment Form when we left Iraq. I also found some pictures from tour showing some of the conditions. My private doctor has been treating me for the Fibro, IBS, and headaches. Below is the nexus letter I am about to submit. I am trying to make sure that it is worded correct in VA wording (contains all the special words). I do not have any specific treatment for exposure to Industrial Pollution, Raw Sewage, Smoke from Burning Trash and Feces, Solvents, Pesticide-Treated Uniforms, DEET, Raw Sewage, Vehicle and JP8 Exhaust Fumes, and Environmental Pesticides.
  6. I am an Iraq War Veteran. I have not been denied or granted yet. My file is on hold because the VA sent all of my records (personal and military) to another veteran by mistake. Therefore, they are being audited. My VSO is worried that because the VA doctor used the word "speculation" that they are going to attempt to say I have the fibro and IBS but they are not related to my service in Iraq. He suggested i get a doctor letter connecting the dots with the phrase "more likely than not" in it. He believes that if they deny i can win on appeal that I can win, but is trying to avoid going down that long process. He thinks the nexus letter will help prevent that. The reason he is worried is the letter from the RO said to "determine if the listed disabilities are connected to GWS due to exposures". I am trying to make sure my nexus letter includes all the key words and phrases the VA looks for before turning it in (I have reviewed veterans files, more likely than not, no other risk factors, etc.). He said he does not know why the doctor didn't use the at least as likely, less likely than not, etc.
  7. I had a C&p Exam and the doctor diagnosed Fibro and IBS but said he could only speculate as to whether it it truly Gulf War Syndrome. So I think they are trying to classify them as diagnosed illnesses. therefore, I am trying to make sure my nexus is good enough to counter them if they try to decide to deny based on this reason. This is my nexus. To Whom It May Concern: I have been Veterans's Primary Care Physician since 2004. I have personally reviewed his Military Service Medical Records as well as the VA Medical Examination performed by Dr. Smith. As evident in the military records, Brad was constantly exposed to Industrial Pollution, Raw Sewage, Smoke from Burning Trash and Feces, Solvents, Pesticide-Treated Uniforms, DEET, Vehicle and JP8 Exhaust Fumes, and Environmental Pesticides while in Iraq. He records also show he was given numerous vaccines to include multiple Anthrax Vaccinations. In 2003 upon returning from Iraq, as evident in his Military Records, he complained of Diarrhea, Chronic Fatigue, Constantly Feeling Tired, Difficulty Remembering, Muscle Aches, Headaches, Swollen Stiff and Painful Joints, Weakness, Dizziness, and Light Headedness. He also listed he had health concerns about the exposures and events during his deployment. He specifically listed his concern over exposure to raw sewage, pesticides, and exhaust fumes. He has been dealing with the following chronic issues since returning from Iraq in 2003: In regards to his diagnosed Fibromyalgia: His Fibromyalgia is characterized as widespread musculoskeletal pain and tender points, with associated fatigue, sleep disturbance, stiffness, headaches, depression, and anxiety. These symptoms are constant and refractory to therapy. I am currently attempting to treat his symptoms with Meloxicam. In regards to his diagnosed Irritable Bowel Syndrome: His Irritable Bowel Syndrome is characterized by constant daily abdominal distress. The symptoms consist of constant alternating episodes of severe diarrhea and constipation with mucous in the stool. I am currently attempting to treat his symptoms with Dicyclomine. It is my medical opinion that these medically unexplained chronic illnesses (Fibromyalgia and Irritable Bowel Syndrome) are more likely than not a direct result of his constant exposure to the contaminants listed above as well as the numerous vaccinations (to include Antrax) he received while performing his military service in Iraq. Veteran has no other known risk factors or causes that may have precipitated his current conditions. He has been dealing with these illnesses for approximately 6 years. There is no medical evidence that relates his unexplained illnesses to a cause other his exposures in the Southwest Asia Theater of Operations during the Iraq War.

They accidentally mailed all on my information (DOB, SSN, Address, Medical Exams, Phone Numbers, etc.) to another veteran. he called me Christmas Eve to let me know he had them. I let they VA know and now they said everything is being audited and were unsure where at they were in the process. I have also reviewed his Military Service Medical Records. While in Iraq he was constantly exposed to Industrial Pollution, Raw Sewage, Smoke from Burning Trash and Feces, Solvents, Pesticide-Treated Uniforms, DEET, Vehicle and JP8 Exhaust Fumes, and Environmental Pesticides. He was also given numerous vaccinations to include Anthrax vaccinations. It is my medical opinion that these medically unexplained illnesses (Fibromyalgia, Irritable Bowel Syndrome, and Migraines) are more likely than not a direct result of his numerous exposures listed above and vaccinations he received while performing his military service in Iraq. Veteran has no other known risk factors that may have precipitated his current conditions. I got the C & P exam from the VA doctor back and he stated Diagnostic Impression 1. Fibromyalgia 2. Irritable Bowel Syndrome Discussion: Based upon the classic history for both IBS and fibromyalgia, I do think the veteran suffers from both of theses disorders primarily, but it would be speculation on my judgement to say that it is truly Gulf War Syndrome when he is so classic for each in and of themselves.
  9. No my private audiologist did not list he looked at my SMR's. He just listed that I was exposed to explosions, gunfire, helicopters, and loud equipment. The VA conceded exposure to loud noise. I was simply confused as to how the VA audiologist denied tinnitus and the reason she gave for denying was my hearing was within VA limits and I answered yes that I had ringing in my ears in my Iraq post deployment. How can you she honestly use "veteran stated he had ringing in ears" to justify her opinion I don't have tinnitus? How important are the nexus letters from private doctors?
  10. I had a Tinnitus C & P Exam. I was a 0331 USMC machinegunner. I recieved the CAR, PUC, and NAM for service in Iraq. The letter sent to the VA Audiologist stated that excessive noise exposure was conceded due to military occupational specialty. I also had my private audiologist letter that stated "My impression is mild slightly asymmetric sensorineural hearing loss bilaterally with bilateral tinnitus. It is my opinion that his condition is at least as likely as not a result of noise exposure while in the military." The VA audiologist stated that "It is in my opinion that the veterans tinnitus is less likely as not caused by military noise exposure. Rationale: Hearing is withing normal limits for both ears. An unknown dated Post-Deployment Health Assessment indicated the veteran answered "yes during" to ringing in the ears while in Iraq. Is this a joke? What should me next step be?
  11. I was a 0331 machinegunner in the USMC. I was awarded the Combat Action Ribbon, Naval Achievement medal for actions in Iraq, and PUC. I have been disgusted by the VA so far. My file has been on hold because they sent my records to another veteran. I thought it was a prank call until the veteran started rattling off my SSN, address, phone number, DOB, etc. I recieved a C & P Exam and the examiner noted in the report: Diagnostic Impression: 1. Fibromyalgia. 2. Irritable Bowel Syndrome. Discussion: Based upon the classic history for both irritable bowel syndrome and fibromyalgia, I do think that the Veteran suffers from both of these disorders primarily, but it would be speculation on my judgement to say that it is truly Gulf War Syndrome when he is so classic for each in and of themselves. I have already provided a nexus letter from my doctor stating that my fibromyalgia and IBS "is due" to the activities and exposures while he was in Iraq.
