  1. I JUST WISH THAT ALL CLAMS COULD BE AS HAPPY AS THIS ONE!! I KNOW THEY ARE NOT!! AND THAT IS A SHAME. THESE MEN AND WOMEN THAT SERVE ALL OF US NEVER ASKED FOR THE REPROCUSIONS OF MILITARY TIME!!! WE ARE BLESSED BUT FEEL SORROW AT THE SAME TIME FOR ALL OF THOSE STILL PLAYING THE VA GAME. OUR FIRST CLAIM TOOK 1 YEAR ALMOST TO THE DAY AFTER DENIAL LETTER AND A REVERSE OF NOT IN THE LINE OF DUTY WHICH WAS OVERTURNED. OUR SECOND CLAIM 6 YEARS LATER TOOK 5 MONTHS START TO FINISH. WITH MY HUSBANDS AGE WE WERE TOLD THAT HE WILL BE LCKY TO GET 50% BUT, IN THE END I FEEL THIS IS THE RIGHT DECISION. I CAN ONLY IMAGINE WHAT HE IS GOING THROUGH BUT PTSD DOES NOT ONLY AFFECT VETS WE ARE ALL LIVING THIS TOGETHER AS A FAMILY!!! WHAT EVER WAY I CAN HELP I WILL!!!!!! I WILL BE LURKING AROUND ON HERE TO HELP IF I CAN ONCE AGAIN THANK YOU HADIT AND OF IT'S MEMBERS FOR WONDERFUL INFO AND ADVISE!!!!!!
  2. Thanks to everyone!!! AND YES IT IS A BIG SIGH OF RELIEF!!! Now I just need to try and get hubby to understand that this is a good thing. I am still baffled at VA' s decision!!! I thougt for sure we would have to file a NOD for this but I guess good things can happen to good people!!! My husband now calls me the BULLDOG!! HA HA I think its kinda funny!! But dang it I am sick and tired of reading and hearing these horrible stories about how vets are treated!!! I don't think anyone would ever wish to have the problems and hurddles they have now caused by the VA! REALLY< let's get a grip and do the right thing VA!!! One thing that had helped is I have saved every piece of paper ever written by military pre discharge to every paper post military!! I am not saying that everthing is peachy keen now but I will say that this hurddle is over for now!!! We will jump the next one when we get to it. With my husband being so young I am sure there will be another exam around the corner somewhere but for now we will JUST BREATHE FOR A CHANGE (or at least I will try), he is still on pins and needles!!! I will do what ever is necessary to help him and my family to not be ran over by the VA. I want us to be able to enjoy our girls and help them as well!! THANK YOU FOR THiS SITE AND THE WONDERFUL PEOPLE WHO MAKE IT POSSIBLE FOR US TO VENT AND ASK QUESTION THAT WE WOULD NOT BE ABLE TO FIND ANYWHERE ELSE!!! THANKS HADIT!!
  3. Hello everyone!!! I first want to say thank you. This site is a wonderful place of information and support!!! My husband is 36 y/o PTSD veteran, He was granted 100% temp 6 years ago. Since then he has continued treatment, RX, and therapy. Today is a good day!! We filed for P&T in January. Today we got the decision and it is 100% P&T!!!! WOW!!! Competency is not in question!!! I am so excited that I wanted to share this wonderful news. DAV sent an application for CHAMPVA and VA sent a pamphlet for education info!!! Very suprised at the rating after reading the QTC report!!! Dr. reported everything was normal and appropriate!!! No eye contact made by patient GAF of 46. But we have alot of reports from DR's over the last 6 years that VA decided that even though the QTC exam did not support 100 p&T the other evidence (including ssdi disability for ptsd only) that more weight was given for the 100 P&T rating!!! All I can say is A BIG SIGH! WHOO!
  4. Carlie your words are well understood!!! Yes he is 100% ptsd. He had a c&p in Feb. that we were not told about until the end of April!!!!! The rater went ahead and rated again at 100% temp due to the fact that he missed his appointment. We absolutely had NO CLUe about it!!! Contacted VA had another C&P scheduled. On the 24th of may that was done.Yes his last C&P was to determine severity of symptoms of PTSD. I do not think his rating is in jeopardy. He needs help in certain areas of finance and as his wife you are able to do this by being appointed as his fiduciary. Here's a link to the rules for incompetency from 38 CFR. http://edocket.access.gpo.gov/cfr_2009/jul.../38cfr3.353.pdf ladybug, Is his current 100 percent temporary rating due solely to his PTSD ? ladybug - just so you see it in black and white, here is the criteria from the Schedule of Rating Disabilities - for Mental Health at the 100 percent level. The veteran does not have to meet EACH AND ALL of these symptoms, but enough of them to be considered 100 percent. General Rating Formula for Mental Disorders: Total occupational and social impairment, due to such symptoms as: gross impairment in thought processes or communication; persistent delusions or hallucinations; grossly inappro- priate behavior; persistent danger of hurting self or others; intermittent inability to perform activities of daily living (including maintenance of minimal personal hygiene); disorientation to time or place; memory loss for names of close relatives, own occupation, or own name .......... 100 Was this recent C&P examination to see if he continues to meet the 100 percent level and if so - should this disability now be adjudicated as Permanent and Total (P&T) ? I believe the answer's to the questions above would be YES, and feel it would be due to, "But all I did was contact VA 800 number to inquire about a letter from va stating he was P&T" In my opinion this call to VA triggered a C&P to evaluate the current level of disability and to see if this disability is static in nature, little or no room for improvement thus Permanent and Total.   5. I do understand that I can be added as his fiduciary. Will I have to ask VA how his check will be spent ? Will there be a home inspection? I just don't understand how they can tell us how it's spent. There is no retro, as he has been 100% since the get. He is soo stressed out, recurring nightmares (when he does sleep), and so on. I am stressed cause I am trying to take as much off of him as possible. I wish i could find somewhere for spouses to get support for ptsd vets. I am trying my hardest and at times don't know how much more I can hold in!? I can't even begin to know what he is going through. I just want to help him as much as possible but also need to be as educated as I can be. Thank you guys again for having the advise and encouragement for vets and everyone else for that fact!!
  6. Thanks for all of your replies!!! Carlie, we moved to OK 4 years ago and did not realize that files weren't that each has it's own va files and cali files weren't in Ok file. Hope that makes sense. But all I did was contact VA 800 number to inquire about a letter from va stating he was P&T but in accuality he isn't so I requested files be transfered. Va said that we requested an increase, BUT DID NOT!!! wHAT IS THERE TO INCREASE BEING 100% ?? wHAT EVER THE CASE IS AS WITH EVERY VET va DOES WHAT THEY WANT AND WE UNDERSTAND THAT SO JUST WENT WITH THE FLOW!!! He is not INSANE just has severe PTSD issues that affect every area of life. I dont have to physically take care of him just have to make sure bills and all are taken care of. I am ust very scared about the affects this is having on him!!
  7. Hi to all. I first want to say thank you for this site it has been very educational!! I am new here. I will try to make this as short as possible. I am the wife of disabled vet, 100% temp six years ago. Well, to get to the point... had C&P last week, was better than expected. The Dr. asked about finances and that I take care of the bills, he then stated that what he was putting that in the report and it should help his rating. WHAT EVER!! Husband didn't lie he was himself held nothing back. I believe that competency is at risk. My question is how does that all work? If I am appointed fiduciary what will be expected of me? I do not think he should be found incompetent, with that being said I do not allow him to pay bills because the thought pattern is absent!!! But just really confused about all that is going on. He is learning to stay home so ptsd stuff doesn't ruin his week!!! Any and all info and advise will be greatly appreciated!!!!!!
  8. Hi to all ! I am a newbie!! FIRST I WOULD LIKE TO SAY THANK YOU TO OUR MEN AND WOMEN TO HAVE KEPT US SAFE AND GIVEN UP SO MUCH FOR US!!!! Now to get to the situation. I am a wife of a 100% temp disabled vet. He has PTSD. I will try to make this as short as possible. My husband was diagnosed in 2004 with severe PTSD had normal c&p rated 100% temporary due to likelyhood of improvment. HA HA HA! When he was awarded we were told by rep no less than 2 no more than 4 years will he have another exam. He has been on rx for 6 years also has been in therapy for that long as well. we moved from CA to OK in 2006 he continues all above with dr.s. Called both ca va and ok va to notify them of the move. Just recently received a letter from CA stating that he is 100 ad totally disabled called va in ca and was told to disregard that letter someone dropped the ball. So I thought I should have his records moved from CA to Ok so I did. NOW we are going through another c&p which he should have already had but our rep said we should have left it alone cause now we are requesting an increase which was not the case. Our rep said that we will be lucky to get 50%. We dont know what to do!!! All dr reports state 100% total and permanent with no chance of improvment and not a candidate for rehab. He does exhibit all signs and symptoms of extreme PTSd. It affects all aspects of daily living including myself and his children. I guess what I am asking is what do we do NOW?? I know you probably here this alot but I cant find answers and we are really scared at this point. He hasn't worked for 6 years and has been awarded SSDI in 2006 due to ONLY PTSD from military records. any info would be greatly appreciated!! Thank you!!
  9. Hi to all!! I am new here and would first like to say THANK YOU TO ALL OF OUR SERVICE MEN AND WOMEN!!!!!!!!!! I am the wife of a PTSD disabled veteran. Please bare with me as this is a long concern. In 2004 my husband was diagnosed with PTSD his gaf was 40. Went through everything had c&p he was rated 100% temporary due to likelyhood of improvment. HA HA HA!! This was in CA. He continued drugs and therapy till we moved to Ok in 2006. His DAV rep. said no less than 2 and no more than 4 years you will have another c&p. When we got to OK i notified CA and OK of the move. In 2007 he started drugs and therapy again. Recently we received a letter from CA VA stating that he is 100% and t&p. Called to verify and told no he is not disregard that letter someone has dropped the ball. I then requested transfer of files to OK since they obviously didn't have his records. We are now in a situation that our new DAV rep said we requested an UPGRADE of status which is not the case. We now have to go through another c&p (which he should have already done). His rep said they will more than likely downgrade him to 50%. All Dr.s notes state unemployable not a candidate for rehab. I guess what I am trying to ask is what should we do now? I take care of EVERYTHING!! Kids, house, bills, and everything in between. He is suicidal homicidal has never completed either but the risk is always there. our children are now exhibiting signs of PTSD thoughts. " Well I will just kick their a** if they hurt anyone". Please any info would greatly be appreciated. THANK YOU
