  1. I was denied SC for hypertension in 2011. The PACT Act adding it to Agent Orange list will make it SC. I reapplied the first of October and was impressed with the fast response from OTC (VA Contractors) and had my C&P exam on 10-17-2022. I went thru the Nehmers review when IHD was added and was thinking my effective date would be backdated. But as good as the PACT Act is, our great politicians threw in so many restrictions. The bottom-line is effective date will be 10-1-2026, no back payments. Try not to be discouraged. If you are a Vietnam Vet apply or reapply now and then forget about it and enjoy life. As always with the VA, "The checks in the mail".

Here's what the Pact act says about Agent Orange related Hypertension and retro payments: 2) HYPERTENSION.— (A) IN GENERAL.—The amendment made by subsection (c) shall take effect on the date of the enactment of this Act and shall apply as follows: (i) On the date of the enactment of this Act for claimants for dependency and indemnity compensation under chapter 13 of title 38, United States Code, and for veterans whom the Secretary of Veterans Affairs determines are— (I) terminally ill; (II) homeless; (III) under extreme financial hardship; (IV) more than 85 years old; or (V) capable of demonstrating other sufficient cause. (ii) On October 1, 2026, for everyone not described in subparagraph (A). (B) RETROACTIVE APPLICATION.—Notwithstanding any Federal court decisions or settlements in effect on the day before the date of the enactment of this Act, the Secretary of Veterans Affairs shall award retroactive claims for a condition under section 1116(a)(2)(M) of title 38, United States Code, as added by subsection (c) of this section, only to claimants for dependency and indemnity compensation under chapter 13 of such title described in subparagraph (A)(i) of this paragraph.
  3. Thanks Dustoff. Every bit of info helps when dealing with the VA. My situation is that I have been on meds going back about 15 years. My Doc is digging out my old paper records from archives trying to get the date I started. I was denied for hypertension in 2011, so this will be a long battle. Now it is agent orange related. Thanks again and by the way, I was dusted off in March 16, 1970 from a rice patty near Soa Mau. Dan
  4. Hypertension or isolated systolic hypertension must be confirmed by readings taken two or more times on at least three different days. Does this mean at least 6 different readings? ie. 2 separate readings each day.

    Here's the reply I just got from IRIS. Hopefully it will shed a little light on what's going on. Looks like RO are re-opening denied claims and all are being looked at under Nehmer. After review of your files, we see that your claim is “Ready for Decision” as of May 12, 2010. After the decision is reached, it is reviewed, updated in our system, the updates are reviewed and authorized. Once it is authorized, a letter is sent to you explaining our decision. Since your claim has to do with newly pronounced presumptions for diseases related to exposure to Agent Orange, we await guidance from Congress to continue processing these claims to completion. <BR style="mso-special-character: line-break">If your claim was started by your regional office and not by you, whether or not you received a letter notifying you of the Nehmer rule, your claim would be processing under this rule.<BR style="mso-special-character: line-break"><BR style="mso-special-character: line-break"><BR style="mso-special-character: line-break">

    John, Something is going on. I read another post recently that mentioned the May 24 date. I reapplied the day after the anouncement last October. I was denied service connection in 1995. The last response I got from the RO was my application was received on May 24 2010 was will be processed as soon as the rule procedure was completed. There must be something about the May 24th date. dan
