  1. Hi,About 20 yrs ago when I was Awarded 100% My children had Champva for a few yrs,NO Monthly premium at time,My friend recently passed away form a Service connected condition-Asking for his Widow-Is there Now a Monthly premium-? Thank you George

Hey All,Had a Comp exam last February by QTC Medical services for Asbestosis claim which was Denied,Requested a Copy of exam Twice from Wisconsin since March with No Copy yet,Contacted Dav and they where able to obtain One for me a few days ago-When I went in for exam Doctor Informed me that the VA had NOT sent him any Medical records at this time and Was On my way in a few minutes,Claim was Denied-Comp Exam stated 1. There was a IN Person exam-False Like when was that exam,2.Am ON Outpatient Oxygen therapy-False 3. Stated I have NOT had any Pulmonary function tests-False-Have had about a dozen from the Va and Private Doctors.4.NO Asbestos exposure-both ships I was on had Asbestos everywhere, 2 of my Best friends have died from Mesothelioma,large amount of my exposure was from them-Both Machinist mates,besides sleeping with asbestos in my face for 2 yrs.The DAV service officer informed me yesterday a Veteran CANNOT be Awarded A Asbestosis claim Without a LUNG Biopsy,Does anybody here know if that is TRUE-? Any Input greatly appreciated,Thank you

Hey all,Thanks so much for the reply's,Have Attached Initial Evaluation by Pulmonary Specialist-Have Underlined Certain parts-Last page Scan53-Extremely likely Asbestos Exposure aboard ship-NO other Risk factors after Extensive review-and that CT Scan Very likely Represents Asbestosis-My breathing test fall into 30 to 50% Rating criteria-The MAIN reason the VA Denied my Clain-NO DIAGNOSIS OF ASBESTOSIS,Am baffled they ruled that as their opinion.THANKS for the help,George
  7. Hey all,Checking from other Veterans who had their Asbestosis claims Approved-What Procedures Did the Va accept as Asbestosis Diagnosis-? I Did Not work directly with Asbestos-Was a Signalman-Sm3-In the last few years 2 of my Best friends-Both Machinist Mates- died from Mesothelioma-Most of my Exposure was from related to them,at lunch time and such,they would at times have Asbestos on their clothing,at times brushing it off,would visit with them in the evenings in Boiler room to listen to music in their work shop,there would be garbage cans full of used Asbestos,When Not overseas,we would Share a House of base to get away from ship,imagine they had Asbestos on their Civilian clothing,as all clothes are kept in same locker,Kept in contact with them both- even after Transferred to another ship,where I slept with Asbestos covered cable/pipe in my face,was on bulkhead support along middle row of bunks,Submitted with my Claim -One of My friends Death Certificate stating Mesothelioma- as cause of death -Along with his Widows Survivor Benefits Award approving benefits- as His Death Service connected from Asbestos Exposure,His widow also Verified a Photo of Us in front of the House we rented off base, shortly before discharge,I requested my Private Primary Care Doctor to check my lungs-Ended up at Pulmonary Specialist-over 20 years in Speciality-From the CT Chest Scan-Ground Glass in Bottom of lungs-Mild Asbestosis,Was his Diagnosis,The Va DENIED my Claim last week-stated I Do NOT have a Diagnosis of Asbestosis,Anybody with Approved Asbestosis Claims-What Procedures Did the Va Accept as Diagnosis Of Asbestosis-? Hey All,Just Checking to see if anybody else has had problems with the NEW Direct deposit system set up January 1st of this year,My First one went thru with just HALF the amount coming thru,Stopped by and talked to Travel clerk after First Error here at Seattle Regional Hospital-She told me they have people who CANNOT Read doing the travel forms and messing them all up,said she would fix the FIRST one-that was On March 30 and the next one in system-BOTH NEVER Fixed and the ONE she filled out For the day I talked to her was processed Incorrectly ALSO,have a Appointment in about 10 days,Any ideas on how to proceed with this-? She told me they go to Finance and has no way to check on the Claims being corrected supposedly-Hope I am not going to get burned with the 30 day rule for submitting travel claims if the correction is past 30 days since appointment,THANKS for any advice

The Supervisor from the Call center called me Thursaday morning-told me Not receiving my COLA Was a computer glitch-it has happened to 1000's of Veterans,is a work item and am in line with over 10,000 other items with No idea how long to get fixed,Later in afternoon received a Email response from Director Mcdonald stating they where checking into it,when I got home yesterday there was a message on my answering machine it has been fixed-checked e benefits this morning and indicating such,Yaaay

Hey all,called the 1-800-827-1000 today for the Third time to inquire about the reason why my COLA of 12/1/2014 has been put on Hold/and or New claim status as indicated in E benefits with No known date of completion of processing-the Councilor said he thinks it is because when I had my Hip replaced in June 2013 and went into SMC/S For 13 months-100 plus having at least another 60% Convalescent rating,which ENDED Last summer and was taken down to 30% Minimum for hip replacement-IS THE REASON WHY,Anybody ever heard of this happening to any other Veteran-? I sent a email last week to Allison Hickey with no response yet -Resent it today with a copy to Director Mcdonald,when I went to Regional office they did not know why is was not processed,wanted me to fill out a claim form,asked today to talk to Supervisor,No call back yet,I have had 15 awards in last 40 years,No problem with my COLA Ever being processed in any of the years I had awards go thru,So it looks like Friday will be 3rd month still being denied,sent a inquiry to my Senators office,imagine that will take several weeks for a response,THANKS For any input,

Hey All,my Cola of December 1st 2014 Never went thru-called the 800 number twice-No idea why-sent emails to Regional office,went to Regional office-They said they did not know why,wanted me to file a New claim for Inquiry,contacted my Senators office yesterday-waiting for response-Has this ever happened to anybody here-?? Hey Berta,the Court of Appeals ruled on this Claim today- it was there when the Vancouver was moved to Category 2 ship list for inland waterways in November-Granted service connection for Diabetes and Coronary artery disease and Remanded the Secondary claims to Bva for further processing-this Claim would will be 7 yrs old in May, his Widow will now have some relief from her financial hardship,SEE POST,THANK YOU All for your input

He had a Claim for Ischemic heart disease and Diabetes at BVA At time of death,NO AWARD,His autopsy stated Asbestos/Mesothelioma as Primary/Ischemic heart disease as secondary cause of death-she will get 4 yrs compensation if claim approved 2008 to 2012,which would save her home from foreclosure,What a legal glitch-could the Attorney for Court of appeals file a Motion to Reconsider-??? thanks

Hey All,Thanks for the Reply,He died from ASBESTOS-MESOTHELIOMA-Primary/ISCHEMIC HEART DISEASE-As Secondary-for which he had a ongoing 4 year appeal,along with Diabetes which his widow assumed-Court of Appeals docket-14-686-Both of these conditions where from service aboard USS VANCOUVER LPD 2,She was Awarded DIC for ASBESTOS EXPOSURE for his rate-Machinist rate-the deck logs all indicate taking on equipment-I Discovered a Photo of helicopters,trucks and Brown water navy craft we took on in Da nang-was when we submitted photo at Regional office for DIRECT SERVICE Connection along with Da Nang Harbor report-the Attorney at Court of appeals-Bergmann and Moore-said they should have issued a SSOC at that time-the BVA ignored the Direct service connection claim ALSO-NO Mention whatsoever-BVA Award Docket-04-21 930-Vung Tau Harbor-the Veteran Never set foot on land-the BVA awarded Direct service connection for taking on Contaminated equipment-Direct Causation-We ALSO took on equipment in that Port ,then this Last Sunday when I checked the Blue Water Navy site for updates-NEW list posted-there was the Vancouver Lpd 2 put in Category 2 Presumptive service connection list for Inner Qui Nhon harbor in Sept 1971-They had to have HAD The Deck logs for Qui Nhon harbor when the Vancouver was put on Category 3 in 2012-as we where enroute from Da nang to Qui Nhon at the time and BOTH Are listed on Deck log,About fell out of my chair on Sunday when when I seen the Category 2 posting,The Attorney said he will ask the Court of Appeals Attorney to settle but do do be be confident he will-Would a REMAND To BVA Help-?? Hey All,I have been Helping the Widow of my Best friend from Navy with his Agent Orange claim since he died in 2012,He filed for Both Presumptive and Direct Service connection-Exposure to Contaminated equipment taken aboard at several ports,The Regional office and Bva would NOT address the Direct service connection,the Bva denied the claim about a year ago-Our ship was in the Category 3 list since January 2012.We went on to Court of Appeals-they are arguing ERROR in neglecting the Direct service connection claim. This last week bluewaternavy.org posted a VA Update list Nov 25,2014-our ship was NOW put In Category 2 ALSO-Entered Inland Qui Nhon Bay/Harbor,The Category 3 list included Da Nang,Vung Tau and,Cam Rahn bay.The attorney at Court of Appeals told me that Our ship was NOT on CATEGORY 2 List at time of BVA ruling,Therefore there is a PROBLEM,the Court of Appeals only deals with VA Errors-Our ship should have been PUT on Category 2 list 3 yrs ago-as the Deck logs for the Category 3 dates cross over with Category 2 dates-enroute from Da Nang to Qui Nhon same date-WOULD THIS BE A ERROR-? The Attorney said he is going to ask the VA To settle but to not get hopes up yet,POSSIBLY A CUE CLAIM IF ALL DENIED-??? Any input appreciated,Thanks

Hey,My Unemployability was granted for Ptsd/Back Issues in 2001,might have a evaluation by someone,imagine it would be a struggle to confirm it was for single issue,my employer in 1994 attempted to medically retire me on Ptsd before I Was granted service connection in 1995,the back disability was granted in 1998,will research more,Thanks
  20. Hey,My Unemployability was granted for 70/40/10-Ptsd/back/scarring-my hip was awarded afterwards,which will now be 30% In August,are you referring to Bradley/Peake case-?? Just became aware of that in January,been researching,Not sure if I qualify,my Unemployability was granted in 2001,Do I QUALIFY-? thanks J

Hey meghp0405,received my Surgery convalescence award letter last week-AM POSTING IT IN ORIGINAL FIRST POST-SCAN 1/2/3-Was Granted SMC/S For 13 months-my right hip went from 20% TO 100%-SCHEDULAR-My 100% Unemployability is temporarily suspended for 13 months-the hip will them go to 30%-I had 70/40/10 left to qualify for 100 plus 60%,There was input on this original post that I did not qualify,Hope the Award letter post helps for other Veterans,Thanks

Hey meghp0405,talked to Supervisor of DAV Service officers for Seattle office yesterday,he confirmed this a Valid claim for SMC/S,He said if a veteran is going for a Pernament SMC/S Award,he has to have a Pernament 100% Rating,said I will get the SMC for 13 months,then back to 100% Unemployability,with the hip being at least 30% Minimum from the current 20%,SO we shall see,he said I should hear April/May sometime,will post award here when it comes thru,Thanks again

Thanks meghp0405,in September I faxed the Dav asking them-if NOT Eligible for SMC-S-100% PLUS 60%,there would be NO point in pursuing this claim-all I would be doing is changing from 100% Unemployability to 100% Temporary convalescence,No point,just a lot of paperwork,they said No,you have a Valid claim,Am going to a DAV local chapter meeting tomorrow to get some input,probably to Federal DAV office bldg. next week,them 2 other Service officers backed them up,What the heck,these guys go to school for this,all this is doing,if wrong ,is bogging down the system with unnecessary paperwork,the extra funds would have been nice to pay for misc expenses-help with transportation,yard work,errand runner,etc, but such is life,will post any new developments in next week,Thanks again
