  1. BERTA I HAVE A BENEFIT QUESTION

    1. randylan2

      randylan2

if i applied in 2009 for stool incontinence secondary to low back sprain and 2009 c@p exam noted hemorrhoids

but lost .  i found my old medical records in 2010

showing hemorrhoids started on active duty

so I applied and won   20% hemorrhoids and 60% leakage

can i  send nod asking leakage rated at 60% should retro to 2009 claim i lost?  or would the 2009 c@p have nothing to do with the new claim

Can you post this question in the main forum?

Also can you scan and attach the 2009 denial as well?(cover C file # prior to scanning it)

You might have basis for a CUE claim for more retro or a claim under 38 CFR 3.156.......hard to say without more info.....

The main forum will get you more answers
