  3. The exact wording is as follows, because of my age (40), previous work experience (Infantry solider for 20yrs), and my education I can do limited work based on my education. I know it sounds crazy but, MAN, what the heck. Also they stated they based their decision on all medical documents, VA, Specialty docs, Pain doc, and the Local ER records. I have a hard time believing that because my Pain managment doc have me on Exalgo ( hydramorphine) and he told me I cannot work. The claim is as follows, 1. Depression (50% VA) 2. Back Pain ( 20%) 3. Medication intake 4. Prostate (40%) these are just what I claimed for SSD however I have multiple 10% claims that equal up to 100% Sc. I spoke to a friend earlier today and he stated that I shuldn't have put my education on the Paper. An Assoc. degree my goodness, I feel sorry for those you out there who have a Masters. You should have failed a few courses (lol)... I will keep everyone posted. Toothpic- how log ago did you apply and what happened at the ALJ appearance? Thanks
  4. I don't know if this is the right forum however I wanted to post an update. I am currently 100% Sc and I applied for SSD back in March of this year (2011), I hired a law firm to represent me throughout the SSD process and the following is a timeline of what occurred during that time. I was just denied again today so here goes. 1.Hired Lawyer and Applied for SSD March 2011 2. Received first response from SSD in June 2011 (Denied) 3. Lawyer applied for an appeal (June 2011) 4. SSD notified me of the appeal notification and SSD stated that they (SSD) were notified in writing that stated Law firm was respresenting me (June 2011). 5. SSD contacted me and requested more evidence i.e, any new meds or new doctors (July 2011) notifed me by phone. 6. SSD contacted me and stated that my appeal was denied again and that I have 60 days from the date of the letter (25 August 2011) to request a hearing in front of an ALJ (Administrative Law Judge). Received denial letter today 29 August 2011. From what my lawyer briefed me on, because of my age (40) and my education (Assoc. Degree), I would probably be denied all the way up until I see an ALJ. No luck needed I know I will eventually prevail. Vet2010
  5. I see my Pyschiatrist once a month, also he recently raised the dosage on my prescription...
  6. I am 100% Sc and I was awarded 50 Depression and 40% Prostatis along with many more ailments. Since I retired from the Army in Oct 2010 I have been put on Zoloft to control my Depression and I wear an Adult Diaper for my Prostate. What is the best route to take when filing for P and T for these two claims? I want to get the ball rolling next week at my local DAV and I want to make sure I have my ducks in order to make one shot one kill. Also how long does the process take to file for P and T and will I need to go through another C and P exam? I went to my first VA appt back in June and my doctor stated that she will see me back in one year. Thanks for the info... vet2010
  7. Can I file for Unemployment if I am retired military and rated and receive compensation for 100% sc, I filed for SSD however no word back yet? Live in GA... vet2010
  8. I know I asked this question earlier however I cannot locate the previous post. I retired from the military in 2010 and received a 100% rating in Feb 2011, I had my first VA appt on June 13 and my doctor told me she will see me in 1 year. I have two claims that are rated at 50% (more claims make up 100%) each and they both state that VA will schedule me for another exam to re-evaluate my condition. My question is when should I expect this exam? or how soon do you think VA will schedule it? Thanks 1. Prostatis 2. Depression and Anxiety Vet2010
  9. The funny thing is that I have several notes and documents that were included in the original claim from my Orthopedic Surgeon stating that I needed a 3 or 4 level fusion. My orthodpedic surgeon stated that I needed the surgery but he would not perform it because of my age. he stated that I was to young (39) to undergo that type of surgery because in his opinion in 5 years I would need another fusion on top of that one. So with that information what options do I have? Thanks for the help... vet2010
  10. The date I received my letter was Feb of 2011 so I have plenty of time however I want to get in by Oct. Will the VA accept a letter written by my Pain Management Doc stating that I cannot work? Also Thank you all for the help. Vet2010
  11. I think my Pain Managment Doc will agree with me that I cannot hold gainful employment do to my Lower Back Pain. Will it be possible to try and kill two birds with one stone in that I can file a NOD for my 20% Lower Back and File for P and T at the same time or do you think I need to wait until I hear back from my NOD before I file for P and T? vet2010
  12. I havel been member of this site for while and I did not see any questions pertaining to the following. If there are post that exit please guide me ti them before answering, Thans... I retired from the Army in Oct 2010 and I received a 100% sc rating in Feb 2011. I need to know which route to take to maxamize the best results, money and family perks. Here goes, 1. 50% depression / Anxiety - VA state this could get better, I dont think so, I am now seeing a civilian doc and he put me Zoloft. 2. 50 Sleep Apnea 3. 40% Prostatis- VA state this could get better, my civilian urologist don't think so 4. 20% Gerd 5. 10% Tinnittis 6. Many 10% claims to equal 94.85 rounding me to the 95-100% mark. 7. 20% lower Back pain (L4-5 L3-4 and many more) docs stated I need a complete fusion however I refused it. My doc put me on Hydramorphine. I recently filed for and was denied SSD however my lawyer is working the case. I worked for two weeks back in Feb and I couldn't maintain due to my depression and Anxiety so I quit. Questions... 1. TDIU or P and T, which one would get me the most of everything? 2. Would it be best for me to file or get a VFW to help me, I think I could do it myself? 3. I recently had my first VA appt and I was in and out in an hour, my doc stated she would see me in 1 year. Do I need to continue to see my Civilian docs or to help my claim of P and T do I need to schedule all appts with VA, I really don't want to that? 4. I take over 8 pills a day and two of those are narcotics, on a really bad day I take over 13 pills, however day are as needed. Can I file a claim for this, taking meds that keep me in a state of confusion? 5. I was recently put on High Blood pressure and Cholestaral meds (VA doc) of which both were denied on my original claim. Woud this help my case of P and T? 6. I was denied my claim for Hemmoroids and I am filing a NOD would this help my claim? I know this is a lot to answer but I really need the help. Vet2010

  14. I see multiple specialist 2-3 times per month, from Psych docs to pain management for my Lower Back. I am worried that Va will reduce my Depression which is now 50%. I am working on getting P and T and I filed for SSD of which I wsa just denied 2 weeks ago however my Lawyers are on the case. Can you tell me about how long it usaully take for someone to get P and T status and if so what are the odds of getting it for Depression and Anxiety? vet2010
  15. Thanks for the great advice. I recently had a friend who had an appt and he went in and told them he felt great, I told him that he just screwed himself and that he should never tell VA he is doing great. Not that he should lie, I think you should always tell them how you feel on your worse day, for me my worse day just so happen to be every other day. When I see the VA or any other doctor I like to do something such as Play Golf or push a mower the day before, something simple as that will have me bent over in pain... I want the Docs to OBSERVE me ON MY WORSE DAY... vet2010
  16. I recently went to my first VA appt after retireing from the Army, the appt was to get me in the system and for me to meet my new doctor. After the appt my doctor stated if there is nothing else she will see me next year (June 12, 2012), do I have anything to worry about as far as my comp. being reduced based on this appt and is this how VA treat all Vets? vet2010
  17. I received 0 % for blood pressure and High Cholestarol, The VA recently put me on meds for the two, do your blood pressure has to be in a certain range before they grant you a raise? vet2010
  18. I know this question has been asked before however I cannot locate it. When does the one year mark begin to file a NOD, I retird on 31 Oct 2010 and I received my benefits Feb 24 2011? I have several claims I want to persue... vet2010
  19. I was denied SSD and the reason for the denial is based on it specifically stated that I don't meet their definition of disabled outlined in/on there disability list. It is amazing how that can be denied yet I am seeing a pain managment specialist and he states that I can nolonger work. Now for the hard part like anything else, the Fight is just beginning.   21. I was recently turned down for SSD, I have a lawyer and I want to know how long does it usaully take to get awarded after you are orginally turned down? I know I will eventually get it I am wondering how long does it usaully take. I am 100% sc from the VA... vet2010
  22. I was denied my claim for high blood pressure and high cholestarol, I knew I would be denied because I never received medication while in the military. Now that I am retired and I just retired in Oct 2010 I recently went to my first VA appt and the doctors put me on Blood Pressure and Cholestarol medication. Can I file a NOD for the two claims or is this a waiste of time? I am already at 100% but I am not P and T, my 100% is actually 94.85 and one drop would send me down. What should I do? vet2010
  23. First congrats to you... Now for the questions, Can you please elaborate on the SSD claim and why it took so long? I recently filed for SSD (march 2011) and I am wondering if my claim will take the same route as yours. Did the S.S. Admin, deny your claim the first time around? I hired a lawyer to represent me so I hope that will speed up the process. vet2010
  24. I recently went to my first VA appt since retiring from the Military and I must say I was glad to see how I was treated. I am 100% Sc and I heard all these stories about how they will try and reduce your claim and I must say that didn't happen. I went in and she asked me a few questions about my conditions and after 3 hours she stated "o.k, we will see you in one year". I am glad that I don't have to keep going back month after month. Break My friend retired from the Army in Jan 2011 and he haven't received his rating back, he lives in Georgia and as much as we been digging and asking questions, no one from GA has received there rating back if they retired in 2011. Is this normal? vet2010
