  1. This is just my opinion !! Its not unheard of for the VA to make an offer, it happens all the time. However, I would never agree to an offer until I knew exactly what I was agreeing to. Once you accept an agreement then it becomes very hard to change. Good Luck !!!!!
  2. I agree with all that has been posted here about the rules and regs about hereditary diseases but I also know from experience that every Rater in the VA claims system will try to use anything that is hereditary AGAINST a veterans claim. The VA is NOT known to be a true follower of their on rules and regs. Handle your claim any way that you want but if it were me I would be very careful with the hereditary stuff. Even though you may win through appeals it could become a very long and trying period of time. Good luck with your claim and I do hope that you succede.
  3. Yes......He was accepted as fit by the DOD however the DOD and the VBA are two totally seperate animals and they both think completely different when it comes to veterans claims for service connection !!!!!!!!
  4. I hate to be the one, but be careful with the statement in the C&P about the "Family History" because the VA will do everything that they can to use that statement to deny you your benifits. They like to use family history as a reason and basis for a denial. Good Luck and I hope it is a Slam Dunk.
  5. Visiting his brother and catching the mumps would not quailify as a service induced injury. You next a nexus connecting the injury or disease to his militay service !!
  6. Retired.........I understand your flustration and I hope that you receive your benifits sooner rather than later. This post was for those that think the Nemher Vets are causing the delay in claims. The delay in claims (including nemher claims) is the result of a very badly broken VBA system. Good Luck with your claim and I hope that you get the settlement soon !!
  7. Most applicants for SSDI will be seen by an SS doctor. Don't worry, my experince with them has been good. They usually do what they can to help a veteran. Also, if you are granted SSDI you will be reevaluated by their doctor in 3 to 5 years. After that they gerneraly don't request any more reviews.
  8. For all Veterans that have pending claims I sincerely hope that your claim is processed as soon as possible and that you get every benifit that you are entitled too. You have already earned those benifits and there is no reason that you should have to wait Months and Years to receive them. I have noticed here on Hadit (as well as other websites) that is seems as though a lot of Vets are blaming the Vietnam Nehmer Vets because their claims are being delayed. PLEASE keep in mind that these Vets have been fighting for their benifits for 5, 10, 20, 30 years and some even longer. The problem is not with the Nehmer vets but with the VA system itself. Mine was a Nemher case that started in 1992 and it was finished in April 2011. I was awarded 100%schedular plus SMC. Thats 19 years that it took for me to finally get the benifits that I deserved. I hope that each one will place the blame on the system and not on these vets because they have fought and suffered for many years just to survive long enough to get their benifits. Good luck to everyone on your claim and I hope that you don't have to go through what the Nemher vets have been through.
  9. Handler..........If you are already rated at 60% for IHD then the next highest rating is 100%. In order to be granted the 100% you must have medical evidence from a doctor that shows your LVEF is 30% or less or your METS are 3 or less. That is the standard that the VA uses for the rating. Good luck and keep up the fight.
  10. It would be great just to get claims back to the 6-12 Month range. BUT 28 days?????????????????
  11. JIM..... If you feel that you were low-balled on the ratings you should file a NOD and request a DRO De Novo review. The DRO can change your rating once he/she reviews the record. This worked very well for me. If this doesn't work, you can still appeal to the VBA. The DRO review will go through much faster than an appeal to the VBA which can take years.. Good Luck and I hope this works for you.
  12. TEXAL1.......... The application for S-DVI insurance must be made within 2 Years form the date that an SC disibility is awarded. Also, you must be in good health except for your SC disibilities. It does not include TDIU or increases in existing disibilities. Hope this helps. Good Luck
  13. Tomahawk, If you are looking for help and assistance with your NOD you have come to the right place. The veterans here at Hadit have a world of experince and knowledge in dealing with the VA Claims process. They have given you some excellent advice and its up to you as to chose if you want to use that advice to your advantage. I used their advice and it helped me get everything that I was entitled to. However, if you just want someone to concur with what you already have, then I'm afraid you have come to the wrong place. The Veterans here will be more than happy to help but it is up to you to use their help to your advantage. Good Luck With your NOD and I hope that it is successful !!!!
  14. Thanks Bonzai.... This is what I was looking for. Hadit is a Great Place for Information..
