  1. I'll say it again and again, I do not like VSO spys being on this board, all they do is stir up trouble and cause havoc. This VSO person is here only to cause problem and continually get people off point. dont trust him!!!!
  2. My point exactly Berta... Liz just does not realize how many Lawyers I have contacted over the last twenty years trying to fight my case. Also, as a poor black man I never stood a chance anyway. I had to finally buckle down and do the work myself but first I had to find a VA doctor willing to help me take that next step. I thank my lucky stars for meeting that person working for the VA because I'd be in the same boat and pain that I was in for so many years with nothing to show for it.
  3. Thats the best NOD I've ever seen. I always go a step further and resubmit the evidence again, make sure you do that so they cant say they lost it. With that many recopies in my file it should be real thick.
  4. I'd say that is a increase in disability!!! It's been operated on and worse in my book. Question? Why are you explaining to them that it worsened after the surgery and that they are relying on faulty data to make decisions about a situation that is now worse.... treat um like they are kids remember.... Bigvic
  5. I agree with you 100% Terry but my problem is getting past the little brained sucker making decisions on my case. Every time a get one of their stupid excuses for denying my claim I do kind of laugh and can't resist pointing out why there decision just does not make sense but they always come back with another stupid reason that looked just as dumb as the last one. I OFTEN ASK MYSELF ARE THESE PEOPLE REALLY THIS STUPID. They just dont get it or they just dont want to get it. Bigvic 100% P/T Severe Spinal Canal Stenosis...
  6. So what you are saying is if I win on the FTCA claim I'll lose my VA comp? Geez, I know I have them cold on the iissues. OK, 1151 claim then, I can't lose my comp no matter how much it would net me to have to try and fight and get it back later....
  7. OK How do I file a FTCA claim then...? I'd like to see them try and disprove the evidence I have against the VA...
  8. Hi Leroy, Please hang in there you are very close to proving your point just think of the best way to word your response to them. If they want to act like twelve year olds then treat them like twelve year olds. But make sure you prove your point. I know about getting bummed out it often happens to me six or seven times a day and I become uneffective and cant think straight but I also realize that a lot of how I feel is from the meds I take also so I just have to fight throught it...
  9. You simply repeated what I said. heheheheh...
  10. Here is what has cleared up a lot for me. I've found that the VA medical facilities and their medical decisions are independent of the VA administrative and legal aspect. They fight with each other. When you get a medical opinion in your favor the Administrative section sets out to disprove it. Simple as that.... It should not be that way but it is. When the administrative section of the VA can't disprove your medical opinion then they try to bury it in deceptive wording. It is completely up to you at that point to be as clear as you can and stay on point about what they continue to try to cover up until they cant cover it up any more and it's as clear as a bell. Just my opinion!!! B)
  11. Is a ftca claim against the VA for malpractice the same as an 1151?
  12. Is ther a form 1151, I can't seem to find one anywhere. I just read a appeal on Tinnitus that was won that made up my mind to try and get some results in my own case. Different diagnosis but very simular circumstances. Bigvic 100% P/T Severe Spinal Canal Stenosis...
  13. I understand that you ended up 100% but if they send you a SOC saying that it's the max that you can get for that SC injury can you get more?
  14. You are absolutly right, I was trying to go overboard trying to please them and was just saying thanks for the little support I did get in the past. It's not like they really wanted to help me you know. You would think they'd be happy that I was out of their hair for support. I dont get it but I no longer care. Since I've been home they never visit or call me anyway. I spend most of my time by myself and in my condition theres not much I can do about that or how they feel. Oh well...
